Well, apparently Mr. Moore has once more found his refuge in the courts. The Nebraska Supreme Court has issued a stay of execution for this charming man.
There was a very interesting passage from the Supremes’ statement. I’ll share it with you here.
While we have previously concluded that electrocution is constitutional, we have also noticed a changing legal landscape that raises a question regarding the continuing vitality of that conclusion.
Ok that’s good. The Supremes are aware that public opinion and laws change. They have their fingers on the pulse of America. We are being well-served.
Were we to conclude that electrocution is no longer constitutional, then we would have undeniably permitted a cruel and unusual punishment only a few months
earlier.
Uh oh. Logic has reared its ugly head. Of course, one could argue that if electrocution was found to be constitutional, telling Mr. Moore that he will die on a certain day and then not killing him when that time came would be cruel and unusual, which might just keep him safe and alive in the court system for another 20 some-odd years.
The damage to Moore, and to the integrity of the judicial process, would be irreparable.
Can anyone read that sentence and not giggle a little? “The damage to Moore would be irreparable.”
You think?
Maybe if they could just kind of shock him a little bit at a time, then repair him. Then shock him a little more, and repair him again. And so on, for several months. The damage wouldn’t be irreparable, after all.
All in all, this is not a big setback for justice.
He’s in prison and he will not get out. He may possibly be executed sometime this year if everyone gets their ducks in a row.

He’s going to leave us very soon. May 8th, to be exact.
Nebraska is all broken up about it.
Mr. Moore killed cab drivers Maynard Helgeland and Reuel Van Ness 28 years ago.
The prison is planning a midmorning execution and a light brunch afterwards.
