Jack McClellan Leaving California Soon
Where will he be moving to? Only time will tell.
Jack McClellan was arrested earlier this month by UCLA police near a campus child-care center. This was about a week after a restraining order had been issued for Jack, prohibiting him from going within 30 feet of any children in the state of California.
Mr. McClellan was released after spending five days in jail when the city attorney’s office claimed that the criminal case could not be prosecuted because the original court order had been written incorrectly. Evidently Judge Melvin Sandvig had failed to schedule and give McClellan proper notice of a hearing required to argue the restraining order’s merits.
On Friday the 24th of August, 2007, Superior Court Judge Melvin Sandvig modified his original order. Now there is a restraining order prohibiting Jack from going within 30 feet of anywhere children gather or congregate, such as pools, parks, schools or day care centers.
The order specifically states that McClellan cannot follow, stalk, photograph or chat with children on the Internet. He also cannot get information about where children live through third-party data services.
Mr. McClellan feels this is inappropriate, even Orwellian.
Homeless and living out of his blue Ford Escort, Jack McClellan has stated that he is leaving California because he no longer has a life there.
McClellan has stated, “I think the whole thing is kind of ridiculous when you look at it from a 1st Amendment kind of perspective. I’ve never heard anything like it. I’m not even a convicted sex offender.”
“I have to leave the state, really, I can’t live here under this Orwellian protocol. It’s nightmarish.”
