To any parents out there who are thinking of leaving their children with a babysitter for any length of time:
Please don’t.
Take your child with you at all possible. The screaming and crying may suck, especially if you’re anywhere that silence is expected, but it’s better to spend an hour or two outside calming your baby than spending your lifetime wondering if there was anything you missed when you hired James Allen Wamsley to babysit for you.
Seriously, if you absolutely must allow the child of a friend of a friend to watch your own children, please - at least do several things.
- Search for their MySpace or Facebook profile and go over it with a fine-toothed comb.
- If you subscribe to a criminal background check service, run a quick background check on them.
- Get references.
MySpace and Facebook profiles will show you the side of this person that only comes out when they’re around their friends.
A background check will tell you if they’ve been in trouble before with the law.
References will hopefully keep you from being the first on the block to have your nine-month-old baby boy raped.
On the 25th of May, 2007, 17-year-old James Allen Wamsley was asked to babysit a neighbor’s 3-year-old toddler and 9-month-old baby while this neighbor was off at a Memorial Day family barbecue get-together.
James Wamsley was happy to help out, and took charge of the kids as their mother drove off to go visiting with friends and relatives.
This woman returned at 11:20 at night and walked into her house to find what is probably every parent’s worst nightmare - her baby had been severely injured.
She immediately called 911 and paramedics arrived at 11:30 to find this little guy with internal injuries that were raw and bleeding. The 9-month-old baby was rushed to a local hospital where doctors attempted to treat him for sexual assault.
Unfortunately, due to the extensive nature of the baby’s injuries, the local doctors were unequipped to perform the level of surgery on an infant that was required and the decision was made to airlift the child to the Sacred Heart Medical Center in Spokane, where due to privacy laws, further information on the baby’s status is unattainable.
Perhaps that is for the best, really. I hope that child never remembers what James Wamsley did to him. I hope that the infant grows up into a normal boy, like any other boy who was untouched by James Wamsley’s perversion.
Initially, due to the fact that was only 17 at the time of this act, James Allen Wamsley was booked into the Franklin Juvenile Justice Center. Shortly after, however, the decision was made to try him as an adult on first-degree child rape charges, a class “A” felony.
James Allen Wamsley pled guilty, and the aggravating factor of how vulnerable this child was at the time of the rape was added in with the plea.
The lawyers fought for a while over a second aggravating factor - how severe the injuries to the baby were - but the judge in James Wamsley’s case eventually ruled that James was also guilty of that aggravating factor as well.
The minimum sentence for child rape is 10 years, but due to the fact that this is a class “A” felony and that it has two aggravating factors…well, we could see James Allen Wamsley sentenced to life in prison.
The award for the most obvious statement of the day goes to JoDee Garretson, Executive Director of the Sexual Assault Response Center:
It’s certainly shocking, the degree of the violence and the fact that it was a baby because we don’t see that very often, and a baby, of course, is so helpless. I don’t believe someone is a healthy, well-adjusted individual and then one day snaps and rapes a baby.

It’s not worth it and leads to stuff like this. I am not sexist-but most of the kids I take care of at work that are injured while being cared for were being taken care of by dads. Dads who were taking a nap or on the computer or tinkering with a project. To one tract minded to mind the kids. I left my daughter with my father today, who is a great guy by all counts, and when I got home after a few hours gone and asked what she had eaten, he got this blank look on his face. I repeated myself, and he told me that she never told him she was hungry. It’s a -little- funny now, but I was NOT amused at the time. Poor girl was starving.
Anyway, I don’t give a good god damn what has happened to that kid in his life, he deserves a looong and slow death. Seriously. General population is too kind. I hope this asshole gets what’s coming to him in prison. I’m glad they upped his treatment from juvenille to adult. Fred- What’s sad is that when all those books you’re talking about were written, children weren’t really treated as consequential. When you die in your 30s-40s like people supposedly did back then (after the age of 600year old bible icons and such), I think the goal was to have as many as possible and cross your fingers some of them lived. No idea really, how well they treated the ones who did.

When I was a little kid, the only people allowed to watch me if my parents were gone for the evening were my older sister or grandparents…my mom’s philosophy was that if it’s outside the fam, you really don’t know who you’re entrusting w/your kids (and given the stories of abusive nannies, etc. that started making the news in the mid-90s, who’s to say she was wrong?).
As for punishment, I think Wamsley should do life w/o parole…given the status of child molesters in the prison food chain, I think it’s safe to say he’ll be getting a taste of his own medicine…and how!

As Moen returned to her seat, she leaned down to hug McBean and kissed her on the cheek.
After the hearing, McBean said she didn’t hold any grudge against Wamsley’s family and still considers Moen a friend.
But the events have taken an emotional toll on the young mother. “I’ve been fired from two jobs,” she said. “I don’t get along as well with people.”

Wamsley’s attorney, Shelley Ajax, told Swisher the teen has been very remorseful and has asked for help.
“His history includes sexual abuse,” Ajax said. “He’s not telling the court that’s why he did this. He’s been confused and oftentimes emotional.”
Swisher said although the standard range for the offense is 93 months to 123 months, he was imposing an exceptional 162-month sentence requested by Deputy Prosecutor Terry Bloor.
“The facts just warrant it,” Swisher said.
Swisher also recommended sexual offender treatment for Wamsley and signed an order prohibiting him from having any contact with the victim for the rest of his life.
