  • Jon Phillips and Sarah Berry

Jon PhillipsIs it possible for an entire family to be made up of individuals whose best traits would be normally be considered character flaws?

    It’s possible.

Take the family of 26-year-old Jon Phillips and his 22-year-old common-law wife Sarah Berry, for instance. At best, they could be described as incompetent parents. At worst…

    Evil.

Jon Phillips was the guardian of 7-year-old Chandler Grafner. Chandler was given into “Daddy Jon’s” custody after Chandler’s mother was arrested during a traffic stop on the 26th of March, 2007, for possessing drug paraphernalia. During that traffic stop, Chandler’s mom, who used to be in a relationship with Jon Phillips, had her sons in the back seat. According to the officer who made the arrest, both boys looked very thin and complained of being hungry. In the officer’s report, he wrote that the boys had told him they hadn’t eaten in three days.

Chandler Grafner at 7Well the children needed someone to stay with while mommy was in jail and the courts eventually decided that Chandler Grafner would stay with Jon Phillips, who was the brother of Chandler’s father.

It would seem that the family tree is more like a vine of some kind.

Dominic Phillips, Jon Phillips’ son, was happy to have Chandler around. Dominic finally had a big brother.

While some brothers have a hard time getting along, it’s usually because one beats up on the other. One can usually beat up on the other because one is bigger, stronger, more energetic. Chandler and Dominic didn’t have that problem, because Jon Phillips and Sarah Berry were starving Chandler, and Chandler was too weak to beat anyone up.

It’s hard to starve a 7-year-old, it really is. They cry, steal food, ask neighbors for food and just make general nuisances of themselves. Eventually you just have to lock them in a closet and forget about them. If you have the determination to do it, however, it can be done - despite the safeguards in place that are designed to detect it.

Chandler Grafner, a kindergärtner at Holm Elementary School in southeast Denver, attended Denver Public Schools from the 15th of September 2006 to the 13th of April, 2007. Teachers noticed possible signs of abuse, and reported it, but nothing was ever really done about it.

Sarah BerryJon Phillips and Sarah Berry mostly kept Chandler Grafner locked in a dark closet. While Chandler, telling his younger brother that Chandler was being bad. Chandler stayed in the closet for days. He was given no food or water. The boy didn’t have a chance to use the restroom and really annoyed Jon and Sarah when he pooped himself and ended up smearing it on the closet walls.

Jon and Sarah would regularly punish Chandler Grafner with a “mean shower.” Mean showers were very, very cold. Usually, more closet time followed the “mean showers.”

Dominic Phillips and Chandler Grafner started out getting breakfast, lunch and dinner. Meals for both boys usually consisted of Cap’n Crunch cereal, but sometimes they had actual food given to them.

    They loved tacos.

Eventually, Jon Phillips and Sarah Berry started to “forget” to give the boys lunch. Then, dinners started to become less and less frequent. When dinner was served, the boys ate oatmeal.

While 5-year-old Dominic enjoyed delicious oatmeal on a regular basis and never had his food supply completely eliminated, Chandler wasn’t so lucky. When Chandler complained, he would be locked in the closet. Sometimes he was given some oatmeal in the closet.

Chandler, while locked in the closet, would regularly beg his younger half-brother to get him some food while their parents were asleep. According to Dominic:

He said, ‘Dominic, go get me food.’ I didn’t get him any. I told him, ‘I don’t want to get into trouble.’

Easter dinner was awkward in the Phillips’ house that year. While everyone was enjoying the meal, on the 8th of April, 2007, Chandler was eating oatmeal. Again. According to Jon Phillips and Sarah Berry, Chandler had been acting up again at home and at school and part of his punishment was to eat oatmeal instead of what everyone else was eating.

During that family gathering, everyone commented that Chandler looked really thin.

    Really thin.

Too thin to go to school.

Jon Phillips pulled Chandler out of school on the 13th of April, 2007.

The closet was used with greater frequency. Food came less frequently.

On the 4th of May, 2007, Chandler Grafner was given food - and locked in the closet - for the last time. He stayed there, in the closet, without food or water until the 6th of May - a Sunday.

Jon Phillips noticed that Chandler had stopped doing much of anything and checked in on him. Realizing that the boy was dead, Jon took Chandler’s body out of the closet, carried him to the middle of the living room and placed him on the floor. While Dominic watched, Jon took the litter box that Chandler had been ordered to use and the curtain that had kept the light out of the closet and threw them in a nearby dumpster.

With the evidence disposed of, Jon Phillips and Sarah Berry changed the dead boy’s clothes, then called 911.

The call came in at a few minutes until 3 in the afternoon that day. Paramedics who arrived on the scene were told by Sarah Berry that Chandler had seemed to have the flu for about five days. She told them that the boy wouldn’t eat, that his weight had been dropping and that earlier that morning he had been foaming at the mouth. She mentioned to police that Chandler liked to hide in the closet and that he may had vomited into the litter box they kept there.

Jon Phillips had a slightly different story, telling police that Chandler had been sick for 10 days. According to Jon, the 7-year-old had been eating oatmeal and drinking Gatorade but that he, “may have lost a little weight.”

    Yeah. A little.

Chandler weighed 34 pounds when he was weighed at the hospital. Doctors recognized the symptoms of abuse and concluded that the boy had died due to starvation and dehydration. They also revealed to police that the physical wasting that was evident in Chandler’s body, the loss of weight and muscle mass, could only have happened over a long period of time - months.

Jon Phillips and Sarah Berry were arrested and charged with two counts of first-degree murder and one count of child abuse resulting in death. One of the first-degree murder charges is related to the charge of caused the death of a child under 12. The second is because they committed murder after deliberation.

Jon Phillips and Sarah Berry are eating just fine in jail. They have pled not-guilty, claiming that Chandler died of undetected diabetes.

    Their trial is currently underway.

Dominic Phillips was, at one point, asked by the detectives about who lived in the home. Dominic told the detectives:

I had a big brother but my big brother’s dead so he went to heaven. He’s an angel now.

Do Jon Phillips and Sarah Berry deserve Hell?

When this story broke here in Denver it was among the 12 deaths of children that were among “cases” that were with Social Services. It made me sick, still makes me sick. How anyone could do anything like this to a child is beyond my comprehension. Since then social services has said they have “restructured” and implemented new policies and procedures…..well I find it very sad that it took the deaths of 12 small children to “restructure”. The trial is currently happening and I hope they hang this son of a bitch and his bitch of a common law wife too, I would gladly attend that lynching…….what this story didn’t tell you is that Chandler had many other family members that would have gladly taken him in and given him the love he so deserved, his biological father was never told anything of his son until he was told that his child was dead. So sad, so very very sad. My heart bleeds for Chandler and for the other children born into incompetent, unloving and evil families and who are snared in a troubled and failed system. Most of these children are doomed and it doesn’t appear that anyone really gives a shit!!!

It pisses me off more that ‘normal’ people were alerted and did nothing. How could someone do that? If I was notified that a child was going through this, I would do something. Even if it meant kidnapping the poor boy. How could they just let this happen? I hope those shitty excuses for caretakers starve to death themselves for this.

This story truly pisses me off in so many ways. I do hope these assholes rot in hell and food should be withheld from them while they rot in prison.

This is another case of where home school hides abuse. Something has to be done with our current home school system (which is basically non existent). I am not saying every parent that home school is an abuser. What I am saying is people who abuse hide behind Home Schooling as a tool to continue abuse.

Just as an FYI - The POS that birthed this child is due to give birth again any day now. Unbelievable eh?

This is beyond disgusting. Were they getting money for taking care of the kid? I bet you anything that they were.

I am sick and tired of reading about these twisted fuckers who take kids for the state money, and then abuse or neglect the kids. There HAS to be a better way!

It is such a vicious cycle. What’s going to happen to the younger boy now? We may as well face it - he is going to have the same miserable life as his entire inbred clan. He will either go off to a relative who will lock HIM in the closet to play with his own shit, or he’ll go off to a foster home, where he is statistically likely to be abused or neglected.

Either way, unless a miracle intervenes, expect to see Dominic Phillips in a courtroom, or on a mortician’s slab before he’s 21. He is basically doomed. Another generation of trash. It’s fucking sad.

After reading the Grand Jury report on Danieal Kelly, the 14 year old girl with Cerebral Palsy in Philadelphia who was starved to death by her mother while DCF workers faked their required visits (http://media.philly.com/documents/Grand_Jury_DHS_new.pdf) [Warning: Graphic], I come over to my favorite blog and see this. I swear some days I don’t know whether to eat a bullet or get a sniper rifle and start picking off assholes like these people one be one till I get caught. I’m praying right now there really is a hell, and that there is a special place there for those who torture children. Dear God, there must be, because I can’t punish these people, and we just don’t have enough people on this blog to get every asshole who starves, beats, boils, microwaves, steam cleans, shocks, or uses for an ash tray, punching bag, lover, sex toy, football, etc, etc…..

I know this much: Most child molesters show their true colors the very 1st time they get caught, and they should be removed from society quickly & permanently. DENVER - Chandler Grafner’s weight at the time of his death was on par with a 3-year-old’s weight, according to a doctor who testified during the Jon Phillip’s murder trial on Tuesday.
Chandler Grafner was 7 years old when he showed up lifeless at Swedish Hospital on May 6, 2007.
“His weight was about the 50th percentile for a 3-year-old, which would mean about 50 percent of all 3 year olds in this country weighed more than Chandler when he died,” said Dr. Joel Haas, a pediatric pathologist who on Tuesday was testifying for the prosecution.
Prosecutors have charged the boy’s legal guardian Jon Phillips with, among other things, first-degree murder. They believe Phillips kept the boy locked in a closet for days and days without food or water

Liz Sanchez reply on August 6th, 2008:

Denver Police Detective Larry Moore told a jury the door to the linen closet had a rope around one of the door knobs and screws in place to prevent the door from folding open. Inside the closet, Moore testified, he found feces on the sides of the walls and underneath the bottom shelf.

During opening statements on Tuesday, prosecutors told the jury it is their belief the 7-year-old boy was locked inside the closet underneath the bottom shelf for days. They said the space was not much bigger than what one might find in an oven.

Krebs proceeded to point out specific details on the autopsy photos which she says allowed her to reach that conclusion. As he has done in the past, Phillips did not look at the presentation.

DENVER - On Thursday Ellis, a child psychologist that spoke with Chandlers half brother in the weeks and months during the investigation, told the jury the boy told her a number of things about how the crime might have been committed.

“When Chandler stole food,” Ellis said, “he had to go in the closet.”

“Who did (Chandler’s half-brother) say put him in there?” asked the prosecutor.

“His parents put him in there,” Ellis answered as she read of notes from their meetings.

Ellis also showed the jury a number of pictures the boy drew for her during their meetings.

“What did he say he was drawing?” asked the prosecutor.

“Chandler in the closet,” replied Ellis.

In one picture the boy drew “squiggly” lines going away from a boy said to be Chandler. The boy told Ellis “those are Chandler’s screams.”

DENVER – A woman accused of helping to starve 7-year-old Chandler Grafner to death pleaded guilty on Monday afternoon and and agreed to a 48-year in prison sentence.
Sarah Berry’s first-degree murder trial in the case was expected to start on Tuesday, but the 23-year-old pleaded guilty to second-degree murder after meeting with the judge on Monday. She will be officially sentenced to 48 years in prison in late September.
The news came hours after the jury started deliberations in the trial against Jon Phillips, Berry’s boyfriend, who is charged with first-degree murder. If he is convicted, he will be sentenced to life in prison without the possibility of parole. The jury went home without a verdict on Monday, but is expected to resume deliberations on Tuesday morning.
Monday morning, Phillips told Judge John Madden he did not wish to testify in his defense.
Both sides then delivered their closing arguments and the judge gave the jury its instructions before they began weighing whether Phillips will spend the rest of his life in jail.

I am guessing that the evidence was so compelling in Phillips case that there was no doubt he will be found guilty - which is why his charming girlfriend pled. The timing is not a coincidence.

Liz Sanchez reply on August 12th, 2008:

      **UPDATE**
DENVER - A jury has found Jon Phillips, 27, guilty of first-degree murder in the death of 7-year-old Chandler Grafner.

The jury reached its decision after nearly four hours of deliberations.

Prosecutors told the jury Phillips kept Grafner locked inside a linen closet for days without food or water. The boy weighed just 34 pounds when his lifeless body was rushed to Swedish Hospital on May 6, 2007. Phillips had custody of the boy at the time.

On Monday, Phillips’ live-in girlfriend unexpectedly pleaded guilty to one count of second-degree murder. Prosecutors had originally charged Sarah Berry with first-degree murder.

The sentencing phase of the trial began immediately, and Phillips will receive a mandatory sentence of life in prison without the possibility of parole.

*** YAY!!! Those bastards are DONE, justice for Chandler! I have to say I am stoked about this outcome, Chandler is in heaven and knows that jury was on his side!***

Why should they get the comfort of three meals and a bed when their crime was to deprive a poor little boy of food and forced him to live in squalor. Their cells will seem like penthouses in comparison to the little closet he was shoved in.

These people are sick! They shouldn’t have the chance to live their life - It should be taken away from them through death. Slowly………….. Infact scrub that! Throw all child murderers and abusers into general population with a bright pink jump suit on and then all the guards go on their coffee breaks? ……………Now that works for me!

FYI, the jury today found John Phillips guilty of the 1st Degree Murder of 7 year old Chandler Grafner, after 4 hours of deliberations. Boo-Yah! Score one for the good guys.
More info to come, plus hopefully a link to the rendering of the verdict.

It’s been my pleasure kristina…this case was special to me, and I’m glad he got the max. John’s going to quickly discover just how popular baby killers are in the Prison, and he’ll be wishing he fed those two kids surf & turf every night.

      “Daddy John” was sentenced today.

      Life plus 48 years.

His little hottie (puke, wretch, gag) got 40-something years.

Too bad we will have to pay to take care of them but at least they are being punished.

      Sick fuckers!

My sentiments exactly. Not enough bad shit can happen to this loser in prison. As if the life sentence wasn’t enough, he also got and additional 45 years consecutively for felony child abuse, plus one year for tampering with evidence. I’m tellin’ you folks, I love this judge.
As for the waste of skin that is his live-in girlfriend and co-defendant, Sarah Berry-the-kid-I-starved-to-death, must have seen the handwriting on the wall, because she copped a plea Monday to 2nd Degree Murder. She’ll be sentenced sometime in September.

The only thing that makes me feel good about this whole thing is that there are men and women in prison who are seperated from their own children. These prisoners no doubt will exact some sort of revenge on Sara and John. I doubt though that there is any punishment they can deal out that would even up the score.

      This one made me cry.

Wow, I’ve read A LOT of posts on this site already and this is one of the very few that actually made me nauseated (the woman who microwaved her baby to death, and men who rape babies were the most heinous) but intentionally starving and basically caging a child? WTF? “I am not equipped to care for this child.” How hard is that to say in court? It wasn’t even their kid! Had to be money, why the fuck else…?
