This is 40-year-old Timothy Poling.
Timothy Poling is being tried for sexually molesting the young granddaughter of Debbie Cunningham - his live-in girlfriend - between April of 2002 and November of 2005. Between those dates, the now 11-year-old victim is testifying, “Grandpa Tim” first began grooming her for sexual abuse by showing her pornography, both on film and in pictures. Timothy Poling then graduated to ‘innocent’ touches on her arms and legs, then moved on to rubbing her back.
From there on, Timothy Poling pretty much raped the child.
On a regular basis.
At least once a month between April of 2002 and November of 2005, Chastity Eichele sent her daughter to visit Debbie Cunningham for a weekend. Despite being divorced with Neil Cunningham, who is serving with the Navy on an aircraft carrier in the Pacific Ocean and despite the fact that Chastity had already married someone else, Chastity felt that allowing her daughter a close relationship with her father’s mother was a good thing for the girl.
And it would have been a good thing if it hadn’t been for Timothy Poling, the child molester, living with Debbie Cunningham.
On the 19th of November, 2005, Chastity’s daughter finally told someone about the abuse she had been suffering at Timothy’s hands. She told Lisa Szparaga, a close family friend of Chastity Eichele’s and the girl’s regular baby-sitter. Lisa Szparaga kept that information to herself for two days before telling her friend that her daughter was being molested by her mother-in-law’s boyfriend.
On the 21st of November, 2005, after talking with her daughter and getting the story from her own mouth, Chastity put an end to the weekend visits. She called her local sheriff’s department and Children Services Board officials to get the ball rolling on charging the son of a bitch kiddie-diddler who thought it would be fun to seduce someone who wasn’t even out of braces yet.
Timothy Poling was arrested, jailed and, after the girl and her family was interviewed, charged with two counts of rape and 25 counts of gross sexual imposition.
Timothy Poling, of course, insisted that he didn’t do it, and demanded a trial. He posted a $50,000 bond and was released.
On the 7th of October, 2008, the trial began. Six men and six women were selected to serve in the jury.
On the 9th of October, 2008, Lisa Szparaga testified. While being cross-examined by the defense attorney, Lisa Szparaga kept to her story, adding that the little girl had cried a lot when she first told her that she was afraid of what her mother would think when she was finally told.
After Ms. Szparaga testified, Chastity Eichele went on the stand:
I only knew the basics. She was afraid I wouldn’t believe her then. She told me Tim touched her and did stuff.
Later that same day, the victim was put on the stand. The sixth grader was quiet when answering questions, and cried several times during questioning by the prosecutor and during cross-examination, during which she told the jury that the sex acts had occurred in her grandmother’s trailer-home during the weekends when she visited there.
Medical experts were brought in from the Tri-County Child Advocacy Center in Youngstown, Ohio.
Dr. Paul McPherson, the center’s medical director since 2007, and Janet Gorsuch, a nurse practitioner, spent several hours testifying that it was doubtful that the girl had lied about her accusations, which were formally taken on the 5th of December, 2005.
When asked by the defense attorney whether a child of 4, 5 or 6 years of age can remember dates well, Dr. McPherson replied that it would depend on that child’s cognitive development, with children under 6 or 7 years of age able to talk about “events happening” but usually unable to provide specific dates.
According to Dr. McPherson:
As adults, we can recall details better.
Dr. McPherson also related to the jury that the vast majority of sexually abused children will delay disclosing to anyone what occurred, usually because they feel ashamed about what happened, blaming themselves. Sometimes the disclosures are delayed because the children are fearful that they’ll be punished or disbelieved.
When the defense attorney for Timothy Poling cross-examined Dr. McPherson, the doctor was asked whether children make up things to get attention or even lie. Dr. McPherson stated that sometimes it does happen, but not in this case.
Under cross-examination, Per Due asked McPherson . McPherson said sometimes they do but disagreed in this case that the girl has lied or was pushed into making an untrue statement by overeager medical or police personnel. The center that the good doctor works at uses a team approach in interviewing abused children, which keeps the children from having to repeat their statements over and over to multiple staff members.
Incidentally, this approach was developed to provide excellent proof against coaching accusations by defense lawyers for pedophiles and child molesters.
Nurse Janet Gorsuch detailed in her report that the girl detailed “grooming techniques” which are commonly used by child molesters to gain the trust of their victims and to head the children in the sexual direction that the molester wants to go. According to statements the girl made, Timothy Poling played games or would think up tricks to get an excuse to touch her.
According to the report by Nurse Gorsuch, who personally took the girl’s medical history and conducted the child’s physical examination, the physical exam findings were “consistent with sexual abuse,” although no vaginal penetration was apparent.
The defense brought forward two witnesses. The first was Janet Persichetti - a former girlfriend of Debbie Cunningham’s son, Neil, the girl’s father. According to Janet, she frequently visited the Cunningham home with her now-13-year-old daughter, Jenna Williams, who also testified. And, as far as the two of them know, Timothy Poling never touched Jenna.
A third defense witness was Cheryl Scruton, a former first and second-grade teacher of the victim’s. Ms. Scruton described the girl as someone who was “friendly and got good grades.” The girl sometimes needed more attention than the other students, she said.

I think it’s great that the friends and family of little Timmy are so supportive of him. With their love and support, there is no reason to believe this can’t turn out to have a happy ending.
The girl has friends to fall back on, and with therapy, she to can live a happy, fulfilling life. All she needs to do is pull herself up by her bootstraps and put this behind her.
Kids are pretty resilient. Tim, on the other hand, is a bit old to be starting over and needs his family and friends more than ever.

Well thank God my 2nd and 3rd grade teacher is dead (had the same teacher for both years). I had some emotional issues one of those years and I would not want her coming to any of my custody hearings and testifying against me!

Well let’s see here. I know this person and I was in the court room. What the readers were not told:
The babysitter walked into the living room and found her husband/her man on the couch with the little girl in question. She peeked up over the couch and started to cry and the babysitter seen a adult film on the screen. Hmmm…..he sounds like the pedifile to me.
Yes the Doctor said it is a possibility this child was molested and reported redness in December while being examened. He told the court that the redness would only last a few weeks. Well, here is my question. The last time the grandparents were with her was in September, the grandaughter reported this in December. The mother, (before the grandaughter told her mother), called the grandmother and told her what her babysitter had told her. Seeing her man watching a pornographic video with the grandaughter. (this man by the way hid and would not except the court ordered paper to appear in court, did not even show up when he was suppose to show up and had a warrent out for his arrest/ fuckin looser mother fucker he is). Strikes me odd here. Alot was not put in the paper, and people are quick to be judged. I think this other man in question should be questioned further and his house be checked. Because in Tim’s house, there was not porno movies or dirty books. Only a few EZ Rider magazines. So is the prosicution saying that all people (bikers) who read this magazine are potential pedifiles?
I want to know how the mother of this daughter is not falling through with others who have been around her daughter. I want to know why this mother does not take it seriously what her babysitter had told her. I want to know why this mother is such a retard to not see all facts here and not take others into consideration. I feel the wrong person is being looked at here. This is a mother who parties and has some come and go. What is her personality like? Well.. the only stories that haven’t added up is the defense witnesses. One child testified she was there every other weekend with the 10 yr old , but then even Debbie got on the stand & said it was mostly the 10 yr old & her 1/2 brother & that the child that testified was only there a couple of times. Debbie’s own friend testified that they’ve gone to the bar while the 10 yr old was left with Tim, but Debbie said she was lying. Who’s telling the truth here? If there is nothing to hide, why lie, right? The doctor explained the disclosure process.. it comes out in bits. Sometimes you just don’t remember at the moment. How many times has it happened to any of you. He should definitely fry in hell & hopefully tomorrow there will be a verdict.

Well lets see Sickened Mother aka Chastity. I was in the court room too and I heard her friends testimony, these are her words that the Prosecuter twisted in her favor. She was asked if there was any other times she went to Debbie’s house. She said yes, to visit and then go out to go shoot some pool then come back and stayed the night, and she said after that..H**** was not there. Then the Prosecutor asked Debbie if her and her friend ever went out and left H**** alone with Tim, she said no. Then she said, “then if your friend said you both went out and left H**** alone with Time would she be lying” and Debbie said “Yes”. So get your story straight. There was no exact proof that this took place. It came down to her word or his. If H**** was allways subjected to such behavior by Tim, why did she allways cry when it was time to go back home. She begged to stay another night. Why don’t you check out the sick mother fucker who happens to be your babysitters husband. I bet you will be serprised. Do a sweep on his homested. But keep the books and the videos you find away from your mother, because she just might decide she loves cock better then pussy. So put the damn pot down and pay attention to you child. I’ve followed all the articles, sat in court through testimony once i was on the stand, then i did a google search for timothy poling and found this site. i intended on keeping my 2 cents to myself but i guess the door has been opened. yes i’m the mother of the victim and yes i also believe her. if this were your own child trust me you would have sat down and gone through every possibility. did i want to believe tim had done this? the answer is no. i knew him very well. did i question it? yes i did. not once not twice but over and over. even explained to my daughter that she may never see her grandfather again. it was her choice to go to trial. i didn’t force her. i talked to her and her father and we both decided to leave the decision up to her. since i was not involved in the interview at the advocacy center i did not have a clue the whole details- hearing about just the touching was enough for me. do you realize we have waited for 3 years for this and i just found out details for the first time? i was not present during h*****’s testimony but what has been relayed is so sick. why you are attacking me is beyond realization. i didn’t rape my daughter nor did i tell tim to do it nor did i know about it or allow it. instead i put a stop to it as soon as i was made aware.
And diabla or kelly or whoever you are i’m not sure where you received the story about the babysitter’s husband. mr perdue himself called and spoke to him and told him to disregard the subpoena. on top of that he didn’t refuse to accept it. his wife refused to accept it at her place of business which by the way is not a legal delivery. also mr perdue never even called him up to the stand. another point, the babysitter’s husband works 3rd shift. you want to know his schedule? home at 7:30-7:40 am, stays up until around 2-3 pm, sleeps until 9 pm and out the door for work around 10 pm. never alone with my daughter, and also she’s only stayed the night i believe a total of 3 times. to attack me because someone else can also see what the hell is going on is both childish and ignorant. you should be worried about the child’s wellbeing or even someone else’s child’s wellbeing. fortunately it will be a while before he’s able to hurt another innocent victim.
in closing, keep in mind if you speak the truth it’s not a crime.

Thanks max we appreciate it as much as our daughter. justice has been served, myself and my daughter watching his head drop as the first rape charge was read as guilty then reaching into his pocket taking out his belongings removing his glasses and turning around to whisper his i love you to debbie cunningham as sweat was pouring from his face and tears from his eyes. 5 sherriff deputies there in the court room handcuffs placed on him and he was escorted out. i think that was some but not all of the closure my daughter needed. she was so afraid nobody would believe her and it turns out the one who didn’t was her own biological grandmother. my daughter has lost alot from this- a grandma, grandpa, & the whole load of her father’s family. far from a way to gain attention. if anything it’s been cut in half.
I would also like to add, diablo, you can attack me all you want. i’m at home with my daughter everyday, she attends school, receives straight A’s for the most part, gets along well with others and is very caring. i have taught her that and sent her to private Christian school for a reason. How do you know how you would react. I have worked with women who are survivours of rape, and i can tell you they all react differently. I have watched some women nervously laugh, some go on to be very promiscuous. Other become fridgid, and can no longer have a healthy sex life. Some kill themselves, some turn to drugs, and yet others i have seen pull themselves back from teh trauma and go on to help other survivours. Everyone reacts differently.
And for the record, it takes a hell of a lot of “guts” to go into a courtroom and sit and face your attacker and a jury of your peers and talk about what happened. So im not surprised that you wouldnt have the guts. You seem like a weak little piss ant.

Let me just say we are all bashing each other here out of anger. That is what this site is made for. But I’d like to speak on Debbie and Tim’s behalf. This is hard on everyone. I don’t doubt that this might have happened to H****, but I believe not by Tim. I feel, from what I know that he did not do this to her. He loved her as much as Debbie did. And you the mother know this, you have pondered the thoughts as well. Debbie was and is a good grandmother and Tim was good to her too. He loved her and she loved him. You couldn’t wipe the smile off of her face. She was a very happy child there when visiting. She would beg to stay another night, but Debbie said no, she had to go home. She loved her very much. And all this hurts Debbie as well. She also loves Tim and knows in her heart he did not do this. Both sides of the fence here. And of course he was crying and sweating, he is innocent and went down for what someone else possibly did. This is devistating to him and to Debbie. Debbie and Tim remember the phone call you made to them about your babysitters husband. How can you deny ever calling and telling your daughters grandmother about what she had told you? It’s not defamation of character or slander, it is what you said to Debbie. Is she lying about you making that phone call to her? Because she told me the next day. Debbie does not lie or make up stories. She is upfront and to the point. And you know that about her.
We are upset about all of this also. I have a relative as well who was molested, and let me just say, this child did not want to be around this person at all. Became withdrawn and grades dropped tremendously. The signs were like a bolt of lightning. Never smiled and never wanted to be near this man and threw a absolute fit when being brought over to visit. I never seen H**** act in that manner. She ran around and played and had a blast. There were several niece’s that went over there, if this is true, he would of hurt the others too. Why just H****? All the kids loved him dearly and had fun going over there to stay the night when H**** was there.
All this makes me sick and I truely believe he was wrongly accused. He will have another trial and we all will be there again to do this over. I feel bad for the kids that get abused, but at the same time, I feel bad for the ones who are wrongly accused. It happens. We see this in the papers alot and we all automatically believe it and say, “What a sick fuck”. I do. But I know Tim is innocent of this crime handed down to him. So we may all just sit around and say hateful stuff all we want to, but in the end, we all have feelings. And believe me, Tim and Debbie are very upset over this. Debbie is a good person and does not deserve such shit talk. And you know that Chastity. You know in your heart that they both are kind hearted people. She was a good grandmother and mother and raised her boys well. You actually can put your head on your pillow and feel justice is served when knowing these people? You don’t feel that maybe H**** (being at a young age) could possibly be confused? Her stories changed 3 times and on the stand she got confused and could not remember certain events. And I don’t doubt she was scared. Tim was even in shock at what he was hearing. He is absolutely in shock at all of this. Do you even realize how he must of felt listening to this and being accused of this? He swears to his hand on a bible that he did not do this. And that is a life sentence alone. He loved his grandchildren, nieces, nephews, and Debbie’s boys. And as far as Kelly, she is a good person. We are all in shock over this too. We stand by Tim and Debbie and her family and will support them. I also want to add, that I too frequent the bars myself. And we all would meet out. If her friend came up, Tim would have his buddies over and they would come out to meet us out. She never had H**** over there and left her with a house full of Tim’s buddies. The Prosecutor got that shit all twisted. They had no actual evidence so she fished and twisted the testimony.
I’m tellin ya, the wrong man went down for this. I really hope you can sleep at night actually feeling if Tim was the right culprit. Can you say 100% that you feel he did this crime? I’m sorry, I feel for whatever has happened here, but I have to stand by my decision as well. I do not believe he did this.
I won’t come on here again. I do not like to say hateful things to others. I only did it out of anger, like everyone else here does. Since we are talking about hell here, Lucifer feeds off of hate and negativity. This is what he loves. So I’m out. Peace.

I must say I’m not bashing anybody. i am speaking the truth and standing up for my child. Tim raped my daughter, debbie stood by his side. way to go, grandma. facts are facts. do i think my daughter lied or even just doesn’t remember who did this? NO. first of all, my daughter is brighter than most children. she was reading at a 1st grade level when she was 3 and started school at 4. if i felt any information she gave had been fabricated i wouldn’t have allowed this trial to go on. i am standing behind my daughter 100% as she’s no moron. i’d hope you’d stand behind your child as well. so what her other grandmother had a lesbian affair. this has been thrown in the air like it means something. the child isn’t describing anything to do with a lesbian affair. also, do i think the babysitter’s husband did this? fact is, i met the babysitter in summer of 04. we spent time going to bingo, not hanging at her house. she began babysitting periodically in the summer of 05 which is pretty much when we really met her husband.he was always sleeping in the day time because he worked 3rd shift. there were no other men in my household, just myself and child. the rape occurred while my child was in 1st grade not 3 years ago (when i filed the charges). hear say has been thrown around way too much. i have no reason to lie. do i want to see an innocent man in prision especially being accused of a sex crime and on a child at that? no because i know what happens to their kind. tim is facing mandatory life without parole. i wouldn’t do that to anybody if i had the slightest doubt. think what you want to think about me, but i do have morals and smarts.
I did in fact call debbie when i learned of this incident to see if anything had happened at her house.. a fight between her & tim or my child & tim or anything that may have made her mad. debbie straight told me no, but got on the stand and testified she didn’t have the conversation with me. i made the long distance call and i heard her myself. how good is her memory? this was less than 3 years ago. i filed a statement with the sherriffs dept Nov. 23, 2005. or perhaps she doesn’t want to remember. that makes more sense.
even after the guilty verdicts were in, she still walked by myself and my child looking at us saying “this is BS.” she is still defending the pedophile and my daughter is looking at her in disbelief. my daughter was afraid of not being believed and even after the GUILTY verdicts were in, she was still not believed by her grandmother or ex step mother.
A jury of 12 people went over evidence, testimony, and also took into account the credibility of witnesses. they heard greusome details for 6 days before deliberating for hours on a verdict.
I guess if you don’t like the justice then stay out of the system! write to your local, state and federal officials and see if they will change the laws just for you.
