    UPDATE: Jury finds woman guilty of misdemeanor in MySpace hoax trial

    LOS ANGELES — A jury has convicted a Missouri mother of lesser, misdemeanor crimes in the MySpace cyber-bullying case linked to a 13-year-old girl’s suicide.

    The Los Angeles federal court jury this afternoon rejected felony charges of accessing a computer without authorization to inflict emotional distress on young Megan Meier.

    However, the jury found defendant Lori Drew guilty of three counts of the lesser offense of accessing a computer without authorization.

    The jurors could not reach a verdict on a conspiracy count.

    Prosecutors said Drew violated the MySpace terms of service by conspiring with her young daughter and a business assistant to create a fictitious profile of a teen boy on the MySpace social networking site to harass Megan.

    Megan, who had been treated for depression, hanged herself in 2006 after receiving a message saying the world would be better without her.

    Jury Gets Case of Woman Accused of MySpace Hoax (11-25-08)

    LOS ANGELES — A federal jury was given the case Monday of a Missouri mother accused of conspiring with her daughter and an assistant to harass a 13-year-old girl on the Internet, allegedly precipitating the teen’s suicide.

    “Lori Drew decided to humiliate a child,” U.S. Attorney Thomas O’Brien said. “The only way she could harm this pretty little girl was with a computer. She chose to use a computer to hurt a little girl, and for four weeks she enjoyed it.”

    Drew, 49, listened to the argument impassively. Her lawyer, Dean Steward, said jurors must remember she is not charged with homicide in the death of Megan Meier, who hanged herself after receiving a message that the world would be better off without her.

    “If you hadn’t heard the indictment read to you, you’d think this was a homicide case,” he said. “And it’s not a homicide case. This, ladies and gentlemen, is a computer case, and that’s what you need to decide.”

    The defense attorney insisted the only question is whether Drew violated the terms-of-service agreement of the MySpace social networking site. He said that Drew, her young daughter Sarah and assistant Ashley Grills never read the seven-page agreement.

    “Nobody reads these things, nobody,” he said. “… How can you violate something when you haven’t even read it? End of case. The case is over.”

    Drew has pleaded not guilty to conspiracy and accessing computers without authorization. She could be sentenced to as many as 20 years in prison if convicted of all counts. The jury was scheduled to begin deliberations Tuesday.

    Assistant U.S. Attorney Mark Krause, in closing arguments, said Drew was responsible for devising the plan to invent an imaginary boy called Josh Evans who would communicate online with Megan, the daughter of a neighbor and once Sarah’s best friend. Prosecutors say Drew wanted to find out whether Megan was spreading rumors about Sarah.

    The prosecution showed the jury the photo that was used on the fake MySpace profile — a bare-chested boy with tousled brown hair.

    Krause said Drew told her daughter and the then-18-year-old Grills what to write, to make the messages “flirty.”

    In so doing, he said, she violated the MySpace rules.

    “The rules are fairly simple,” he said. “You don’t lie. You don’t pretend to be someone else. You don’t use the site to harass others. They harassed Megan Meier.”

    Krause also said Drew was warned by others that what she was doing was wrong, and Grills herself told Drew it might be illegal.

    “She knew she was violating the rules and yet she told these two kids to keep doing it,” he said.

    Both prosecutors made references to testimony that Megan had been under treatment for depression, and Sarah, in testimony before final arguments, said she was aware Megan had been taking medication and seeing a psychiatrist.

    “The defendant knew that she was dealing with a troubled little girl who was extremely fragile, and yet she did it anyway,” Krause said.

    “It went beyond a simple prank,” said Krause, “to get her so hooked on this young man that she would be crushed when she found out he didn’t exist.”

    Steward, in his response, said Drew had little to do with the content of the messages and was actually out of her home on the day of the final message, which was sent just before the suicide. He also said the message, which was quoted through out the trial, has never been found but was actually sent via AOL, not the MySpace site.

    “My client, Lori Drew, was not home when all the electronic nastiness was going on,” he said.

    Steward also attacked Grills, the prosecution’s star witness, as untrustworthy because she testified under a grant of immunity.

    “Grills, bless her heart, is pathetic,” he said. “Grills is a sad character who carries a lot of guilt.”

    He also blamed Megan’s mother, Tina Meier, for allowing her daughter to continue the MySpace conversation with the invented Josh Evans after she learned it was going on. He faulted her for allowing Megan to register on MySpace and for not watching closely enough.

    O’Brien reminded jurors how the tragedy began. He said Grills received a message from Megan suggesting Drew’s daughter was ugly and a lesbian, leading Drew to concoct the plan.

    “She could have walked four doors down and told Megan’s mother to knock it off,” he said.

    Prosecutor: Lori Drew Intended to ‘Prey’ on Girl’s Psyche

    LOS ANGELES — The woman accused of making unauthorized use of MySpace to  inflict emotional harm on a 13-year-old girl, who then committed suicide, “fully intended to hurt and prey on Megan Meier’s psyche,” a prosecutor charged Wednesday, as opening statements began in the first federal cyber-bullying trial.

    After some initial problems finding unbiased jurors, a jury of six men and six women was finally impaneled in the trial Wednesday afternoon. Prosecutor Thomas O’Brien immediately launched into his opening argument, in which he previewed the case he plans to present in the days ahead.

    Defendant Lori Drew, a 49-year-old Missouri woman, watched O’Brien’s opening salvo wide-eyed from the defense table, jotting notes occasionally on a notepad, until O’Brien reached the details of Meier’s suicide and its aftermath. Then Drew began scribbling intently on the pad, averting her eyes from the prosecutor and jury.

    O’Brien claimed that Drew actively conspired with two others in creating and maintaining a MySpace profile for a nonexistent 16-year-old boy named “Josh Evans” in September 2006. The Evans account was used by multiple people to flirt with, befriend and ultimately reject 13-year-old Megan Meier, who’d had a falling-out with Drew’s daughter.

    One of the users of the account, Ashley Grills, a then-18-year-old woman employed by Drew and her husband, has admitted to sending a final, cruel message to Meier while posing as Evans: “The world would be a better place without you. Have a shitty rest of your life.” Meier then hanged herself in her bedroom.

    Grills has been granted immunity from prosecution in exchange for her cooperation with the government, and is scheduled to testify against Drew.

    Though the prosecution concedes that Drew did not send that final message, O’Brien argued that the whole purpose of the hoax from the start was to inflict emotional distress on a vulnerable young girl.

    O’Brien said he’d offer testimony that Drew conspired with her daughter, Sarah, and with Grills to humiliate Meier, and was heard laughing about the hoax they were perpetrating on the girl.

    Drew discussed using Meier’s personal notes to “Evans” to humiliate her at school, and conspired at one point to lure the girl to a nearby mall to meet Evans, whereupon Meier would similarly be confronted with the messages she’d sent the nonexistent boy, said O’Brien.

    After Meier’s death, Drew’s hairdresser allegedly asked Drew why she was going to the wake, given her role in the cyber-bullying. Drew’s response, O’Brien said, was, “It’s not like I pulled the trigger.”

    At that point in the opening argument, one of the jury alternates, an elderly woman, visibly cringed.

    Defense attorney H. Dean Steward, delivering his opening remarks, painted a very different picture. He claimed that Drew knew about the plan to create the hoax MySpace profile and manipulate Meier, but neither encouraged nor participated in it.

    Steward told the jury that forensics evidence will prove the account was not created from Drew’s computer, and that no messages were sent by Drew.

      Perhaps L. Lort Cipe is Lori Drew or related to her. I don’t know how anyone could sympathize with that woman. The accomplices were teenagers–I can understand their lack of judgment–but a grown woman allowing, even if not participating in, the emotional harrassment of a child whom she knew was on anti-depressants to begin with? No excuse whatsover. I hope she gets jail time.

          Idon’t knoe if anyone’s noticed or not, but L. Lort Cipe’s comments have been removed from this message board. If he continues to try and post here, I will continue to delete his comments. I’ve found lots of people obnoxious (noyou and I have had our disagreements), but I would never ban someone for having a controversial opinion. Cipe however, is a troll, and one who tries to be a hurtful as possible. The best way to deal with these assholes is to ignore them, but since he’s seems to touch a lot of raw nerves. I’ve made the very very rare decision to ban him. I may get overruled by admin, but until then, he’s done. The Baby P comment was the last straw, and I haven’t regretted doing it since. So there it is folks. Noyou is in absolutely no danger of being banned. If you’re gonna take him on, you better know what you’re talking about or he will eat you up. He’s a very intelligent individual. I only mention this so folks won’t think I’ve gone mad with power of something. I probably won’t ban another person again, at least that’s my hope.

      I’m not sure what to think about this case. I know if my child were in the same situation, I would definitely look to place blame anywhere. Cyber-bullying happens a lot. Just like on here. But it’s not like I’m going to go hang myself because one of you people stuck in my computer call me a name or say that the world is a better place without me cause I know that’s bullshit. But either way, it’s sad that a grown woman had nothing better to do than pick on a little girl who she KNEW was an easy target and very vunerable. It’s pathetic on the Drew’s part.

        I have read people who have known and encountered Lori Drew. They describe her as mean, abrasive, and at the same really sociable, but really annoying. People were often resentful of her, especially when she got her daughter involved.

      This woman is the new low of society. In the past, humanity haven’t invented computer and Internet so the bullies were done in open manner- on field with some punches here and there, accompannied by insults and openly slander. We all know that after decades, we finally have the law for these kind of bullying.

      But then we have Internet……and the new way to bully is opened up, a wormhole thats not yet overseen by the laws.
      If she walks away from this unscathed, there will be more and more Lori Drew-and-friends wannabes, and there will be more and more future Megans committed suicide. You know who I meant…….girls and boys with disorders, who battle with their own demon everyday of their lives (And Lori-and-friends drowning them further, “What you do to ‘enemies’ who were almost drowned? Hold a water tube and sprout more water to their mouth and nose so they drown faster.”)

      While it’s true tat it’s probably hard to find the means to punish this woman, we hope the judge wise enough to realize that this case will serve as the future’s example. If she walks away, then humanity means no more, and we may as well step back to prior-civillization era.

      No mothers in this world gave birth to their children, just to see them pushed to the edge of cliff by other humans, and no mother will say they give their children lives so some mad-(wo)men can kill them.

      In the end, remember what Martin Luther King say long time ago:

      This story is so sad and ridiculous..i will never understand why some parents feel the need to relive their middle/high school days when it comes to their kids squabbles. Unfortunatley my own mother is that way to some degree and it made me miserable growing up. The communications with Megan went on for six weeks I think I read in the article. Does anyone know if Megan ever even mentioned Lori’s daughter? If not why would it have continued so long? It sounds like Lori was just out to hurt Megan using her daughter as a cover.

      So i was looking into this case a little more..and I came across something that troubled me. During that last mypace altercation Tina Meier did nothing to comfort her already troubled daughters ego when she needed it most. Megan was probably hysterical when she realized this was all a ruse. Tina, like the reports say, simply berated her for violating her rules and participating in the argument. Any way what i came across what megan said to Tina “you are my mother, your are supposed to be on my side” Now I hate Lori Drew and also want to see her punished but maybe just maybe while Lori did drive Megan to the edge maybe TINA pushed her over. What do you guys think..I am open to other interpretations.

        Maybe Tina was tired of her daugher Meagan having virtual friends as opposed to real human beings for friends. Because Meagan decided not ignore such advice and then ask for support to continue doing what her mother told her not to, Tina decided to not shield her daughter from the consequences, maybe even wanted her daugher to acknowledge what was really happening.
        So I do not fault Tina for giving Meagan a stern “told you so”

      I may be wrong, but I think Lori Drew is going to be convicted. Yesterday the Jury suggested in a note to the judge that they’ve reached verdicts on three of the four counts against her. I’m pretty good at reading juries, and this suggests to me that they’re guilty verdicts. I can’t explain why, but in most similar cases, this is the way things go. Personally, I”ll be pleased if she goes down… It really bothers me when people won’t take responsibility for their actions, and it especially bugs me when, as many of Drew’s supporters have done, they try to shift some or all of the blame on to the victim or the victim’s family. Irregardless of what the Megan Meir or her family did afterwards, Drew and her little minions got the ball rolling, and no one’s can convince me that this fat slob didn’t enjoy setting the poor kid up and then destroying her psychologically. Someone has to answer for a torturing a 13 year old girl until she couldn’t take it any more and wound up hanging by her neck from a belt in her bedroom closet.

I suppose someone has to do it because of the whole innocent until proven guilty bit, but it get’s a lot worse then this. There are worse crimes. I could actually see his point on this case, it’s an easy argument, sorry.

        Remember now, I just like to put things into perspective, I am by no means saying this woman should get off with just a misdemeanor.

Also, I don’t think Megan realized it was all a ruse–she evidentally believed the last email she received from the fake boyfriend in which he told her the world would be better without her in it, because she hung herself shortly after reading it. I am so hoping that Lori Drew will spend at least 5 years in jail…enough time for some self-reflection and to own up to her role in this tragedy. She needs to find Jesus, or get a butt kicking from other inmates, or both.

      Max- I really hope that wasn’t directed at me. If so you REALLY hurt my feelings by calling me a “drew supporter”:-( I was misunderstood. I teared up a little as I am anything but. I’m not trying to “shift blame” to her parents because NOTHING would have happend if Lori hadn’t started the whole thing. Like I stated I want that bitch punished for SOMETHING if we can’t get her for causing Megan’s suicide. I guess i commented on that statement because I have been there. I could feel Megan’s anguish.       I just read that Lori will probably not do any jail time, and the defense will probably try to get the misdemenors dismissed. I’m disappointed that she wasn’t found guilty of a felony charge–she’s getting no more than a slap on the wrist.
      Lena, actually, I did find some links about Tina Meier’s testimony, and apparently she did scold Megan about being on the computer after being told to shut it down. I imagine that Tina’s had to deal with her own guilty feelings about not having been more sympathetic that day. But the mom surely didn’t realize HOW distraught Megan was, and never meant to cause her harm, whereas Lori Drew meant to cause harm. I still can’t believe the jury found her not guilty of intent to hurt Megan (the felony charge)!!

      Even if she doesn’t get the maximum penalty, we can still do something about it. Ostracise her and her family, if the justice system is lax in dealing with them, doesn’t mean that she cannot be punished in a civil manner. Preventing her from working, stripping her of assets and forcing her onto the streets can be just as effective if enough people are made aware of who she is.

            You know, i used to be a ‘big girl’. ( i have lost 34kg and counting) and i am proud to say that i never dressed as badly or had such a terrible hair cut as Lori. There is no excuse for bad hair…they invented gel, hairdryers, hairspray and straightening irons years ago, and i know some big ladies who are very well dressed at all times…She is not only fat, but she also has no style.

      I don’t know, Penny. I don’t look at it as the “government controlling morality” What Lori did WAS wrong and she needs to punished and made an example of so this doesn’t happen again. It simply wasn’t illegal because the laws haven’t caught up. I mean what they got her for was illegal they were just “reaching” a little.         In my opinion, Lori Drew did break the law. Stalking, harassment, and manslaughter and those are existing laws. Anyways, Drew is screwed for life and she is a prisoner, prison or not and that’s her own doing. Also, she will have to answer to God.

        Also, I do not like the idea of government getting involved in morality. I don’t know why the federal government charged for her TOS violations, which I thought was kinda weak. It made MySpace a victim. I think MySpace and the Meiers should sue Lori Drew and company.

          The censors are in place due to the fact that the site does not charge or verify age so I have to keep the site PG. As a Social Networking Site it has to comply or it will end up as nothing but a breeding ground for insults and hate… Those sites do not make any money unfortunately….

      In all honesty, I believe the mother should be charged with ONLY harassment charges. Think about it, she didn’t physically murder that girl, the dumbass killed herself.
      It’s the girls fault completely. If she didn’t like being harassed on myspace, there is a red x in the corner of your browser for that.
      The mother was trying to be involved with her daughter, and I agree, harassing another girl isn’t a great bonding solution, but she didn’t actually use a force to kill someone else.
      They committed suicide, that’s their problem.

So that part is working, so far.

      The world should remain relentless on this horrible old witch, at least until she takes some responsibility, shows a glimmer of remorse, does something to help her victim’s family get on with their lives. I don’t see that coming any time soon.

        You are also right about the heroic actions of the US Attorneys. I don’t always agree with them, but in this case Drew deserved punishment, and just because the laws didn’t anticipate her level of criminal behavior, she should not have been allowed to walk away scott free.

        All I know is that Karma is a bitch, and Lori Drew is getting a taste of it now.

      This has truly been a dreadful case, i’ve not followed it all, more like picked up snippets like on this site, but my gut feeling is that as parents we do need to be pro-active in raising our children, either we take our responsibility full on or we allow our kids to be raised by mtv, myspace, bebo etc and at risk of being labelled nosey by my kids i think its essential to monitor their site use! I’m not blaming megans mum btw, drew was responsible, but as parents we need to ensure our kids are as safe in cyberspace as much as we do out in the real world… This was really cruel of drew tho, i have teenage girls, all hormones and giggles, they are an easy target as their emotions all up and down. Shame on you lori drew, you are unfit to parent any child… :(

        I don’t disagree with your general point, Loula Cherry. But as a hard-core victims-rights type, I have to remind everyone that in this particular case, Tina Meier did way more things right than most parents. Megan didn’t know the password to her MySpace account. She could only log on with her mother’s knowledge and permission. And Tina kept up on what was happening with Megan’s online world.

        There is simply no way to prepare for the eventuality that the fat old mom next door has targeted your child and has no psychological barriers to sexually stimulating 13-year-old girls. How could anyone expect anything like that? Sometimes you’re just in the wrong place at the wrong time, and that’s what happened to the Meiers.

        The only way to keep stuff like this from happening is through deterrence. It seems very possible the judge will dismiss the charges against Lori on July 2. Lori clearly believes that if she can beat the charges on technicalities that everyone will have to apologize to her and start buying ad space in the fucking Drew Advantage again. It’s up to all of us to show her she’s wrong.
