    Richard Kern, Alex Cruz and Andrew Morales

    This weeping man is Michael Mineo, a 24 year old tattooist who likes to smoke the odd joint after a hard day of inking. That is exactly what he was doing at the Prospect Park subway station when he was spotted by police.

    Being that smoking marijuana is illegal, Mineo ditched the joint and took off running and was chased by Officers Kevin Maloney, Richard Kern, Alex Cruz and Andrew Morales. Talking to investigators and the Grand Jury, Officer Maloney, 26 said he spotted cops chasing Michael Mineo and subduing him in the Prospect Park subway station.

    He said he was cuffing Mineo when Officer Richard Kern, 25, unfolded his NYPD-issued baton and poked Mineo on the left buttock. As Mineo struggled his pants and underwear rode down further and further until Kern was able to maneuver the 2 feet long, 1¼ inches in diameter baton between Mineo’s buttocks.

    When this happened, witnesses say Mineo screamed out, “What are you doing? Sticking a radio up my arse?”

    The entire incident took only seconds and Mineo was soon hustled upstairs by Kern, Cruz, 26 and Morales, 26.

    Back at the station, Mineo was released with a summons for disorderly conduct despite having two open arrests.

    Mineo then took himself off to Brookdale Hospital where he was admitted and treated for “rectal tears” as a result of the alleged assault.

    Less than a week after leaving hospital, he was readmitted to Brooklyn Hospital because he was still bleeding.

    Sources who have unofficially spoken with Alex Cruz, the 26-year-old officer identified by Mineo as an assailant, said he was adamant that no one abused Mineo. Cruz, on the force for less than three years, “was the one who pointed out all the cameras, and described witnesses who were watching,” a source said.

    Cruz insists that Mineo was in sight of civilians at all times “during the entire chase and arrest,” the source said. “He said he was glad there were so many people around.”

    Maloney’s lawyer, Paul Martin said his client didn’t at first realize what he had seen but came forward when he read newspaper accounts of the incident. He waived immunity for testifying before the Grand Jury, but is unlikely to be charged.

    Two other witnesses stated that the didn’t believe Mineo was assaulted, and NYPD Internal Affairs Detectives failed to find any physical evidence in the Patrolmen’s patrol car. However, two other cops testified against the officers before a grand jury, and authorities said Mineo’s DNA was found on the baton, although they did not say where on the baton it was found. Since witnesses on both sides testified that Mineo was jabbed on the thigh and buttocks several times, Lawyers for Kern, Cruz and Morales didn’t seemed too worried.

    “We don’t know what the people’s proof is, but as far as I’m concerned my client is not guilty,” said Kern’s lawyer, John Patten.

    Richard Kern, Alex Cruz and Andrew Morales were indicted by a Grand Jury on December 9th, 2008. Kern, 25, faces the most serious charges, including aggravated sexual abuse in the first degree, assault in the first degree and hindering prosecution. The abuse charge could bring a sentence of up to 25 years in prison. Morales and Cruz, both 26, face charges that include hindering prosecution and official misconduct. Kern was released on 15,000 dollars bail, while the other two officers were let go without bail.

        Thanks Lena…and i have my doubts about his being honest. I mean, he is milking it for all its worth. How many rape victims do you see holding TV interviews from their hospital room?
        If the cops are guilty, then yeah, throw the book at em…but i smell something rotten here.
        And im wondering if the baton has recieved any councelling;)

          Sometimes getting the truth out takes tv interviews. The cops could have just covered it up.

          It also says in your article, that witnesses didn’t come out until they heard the news.

      Has anyone seen Sleepers? Although they have sworn “To protect & serve” alot of times it is to protect their own ass’s and serve their own warped needs. More times than not these officers are screwing or raping prostitutes, taking cuts from the drug dealers and murdering. Remember the idiot cop & his wife that stole marijuana from the evidence locker, made brownies out of it and called 911 because they got too high LMAO? Cops are just as human as the next one and these three look like they got bullied a lot in school… maybe they had a score to settle with no one in particular and this guy just happened to be breaking the law. I would say the guy was puffing on a joint and that is why he ran. That is no reason to get a baton shoved up his ass. That is RAPE straight up. Send them to Hell.

        Believe me, i have thought about this from all angles. Like you said, if he wasnt raped, how did he get the rectal tears.
        What also bothers me is that there were wittnesses standing around, yet they claim to not realise what they were seeing until after the news broke. How do you not realise that a cop is sticking his baton up someones arse, when its right in front of you?
        You’d like to think that the poeple that get paid to serve and protect would do exactly that. I mean, isnt that what we pay taxes for? And i know that all cops are not good cops, for these guys to do this so publiclly, putting themselves at risk of getting caught, would be really, really stupid!
        Were they really on that much of a power trip that they thought they were THAT untouchable?
        Like you, I’m stumped…but it makes for a good discussion:)

          If you really think about there are 3 cops taking down a perp, so the crowd that gathers will keep their distance to a point. With 3 cops on one (obviously small, skinny guy) then they are going to obstruct the view of anyone watching because they were holding him down and hunched over him I’m sure. The guy yelled out in pain during the confrontation and his DNA was id’d on the officers baton… if the witness reports & the DNA is true. Seems pretty cut & dry to me.

      Bill-I thought of that too! The story is very outrageous, but if it didn’t happen then…why was his ass bleeding? I don’t know this just sounds hinky:) I wasn’t surprised to see Al Sharpton on his side. Hopefully for old Al’s sake Mr. Mineo is telling the truth, he doesn’t need to be part of another Tawana Brawley case:)

      What… the hell? I don’t know what to make of this one either, Amy. You are right, you don’t often see a rape victim giving an interview from a hospital bed, especially a MALE rape victim. I guess rape by a cop would bring a little more publicity than the average rape, though. This one just seems weirder than usual.

      I know this is gonna sound terrible, but that in itself could make him look like a liar. I read a few other articles on this. Sounds like he will probably win his case, with the DNA. If this went down the way he says, I hope he gets the justice he deserves.

          Agreed. Sharpton makes it seem like a joke. I read that he (Al Sharpton) had some kind of rally set up for Mineo to ‘thank the community’ yesterday, and Mineo didn’t show up. Maybe he realized he made the wrong decision in involving Sharpton? Who knows.

            If the guy has any sense at all he will ditch the Rev, who in my humble opinion is looking for publicity and ratings for his radio show.

          He is straight, and has made two previous complaints against the police. This one catipulted him to the front page of the New York Times tho.
          He has previous arrest, but nothing too sinister, one for credit card fraud and one for marijuana posession. Not that that makes him a liar…just giving some background info.

            Actually, by all accounts from people who knew him as a kid, he is a pretty nice guy. Big hearted, funny and generous.
            His parents both died from drug overdoses and he was shipped off to live with his grandparents. they too dies and he then moved in with an Aunt and Uncle. I think he moved to NY after getting himself into some trouble he couldnt get out of.
            Sounds like he had a pretty sad life if ya ask me.

            Now that Sharpton is involved it will get messy. Wether the cops are guilty or not their careers and their private lives are over with. Sharpton will make damn sure of that.

      I’m kinda torn on this one. I can see a cop poking and prodding the guy with the nightstick, but actually shoving it up his ass? On the street? Why did the witnesses need to be reminded of what happened? Admittedly, the DA is proceeding and they seem to have a case but this Mineo guy is a pothead that has filed complaints before. And he did run. And I generally side with the law regardless because I have a hard time empathizing with tattooed, pothead, commie lawbreakers. Especially when they whine and cry as much as this guy has, he’s milking this. And he’s hanging with Sharpton. I really am disgusted by that POS. He’s the one that needs his ass kicked – or something, maybe involving a nightstick. Course, Sharpton already acts like he’s got a stick shoved up his ass, so maybe that’s not the solution.
      Anyway, back to the pothead – he’s milking it – and if more cops will willing to shove a nightstick up some criminals ass, the streets would be safer. A better America for all. Just sayin’.

          I heard about a cartoon concerning the wrong Reverend Al that you might like Mulch. The first frame showed him praying for a “world without racism”, and the second frame shows him disappearing into thin air. Great illustration of the old saying “Be careful what you pray for”.
          I agree with you, and I can’t stand reverse racism either. In the hands of a person like Sharpton it can be more divisive than racism itself. It’s been his M.O. since I first heard of him: Don’t trust whitey, all police are corrupt, the System is out to get minorities, and on and on ad nauseum. The trouble is these things are true just often enough to make him look like a he has other people’s best interests at heart, when the reality he only does things that benefit Al Sharpton. So it all really goes back to the original sin of racism, pure and simple.       So I just read Amy’s comment about them not even being able to find the weed he supposedly had. So if you take that away you have: A guy who has made previous complaints against N.Y.P.D sitting in a park. He sees police and takes off running(knowing that if you take off running from the cops they will chase you). After that big scene he struggles while being taken down(and probably gets beat up a little) and makes loud accusations about stuff being shoved in his ass, witnesses say. Then he presses charges sayin he was raped and calls Mr. Al Sharpton into the mix. I really wouldn’t believe him but the fact that he DID have injuries is throwing me off.:’( .Wouldnt the subway video have cleared this up?

      idk, you guys. i;m going to reserve my opinion for later details. when i first heard this story, i didn’t believe it, anal tears notwithstanding. i figured he got roughed up a little by the cops, and tried to pin his extracurriculars on them for payback/payout. but the discovery of his dna on the baton leaves me straddling the fence. ordinarily, that would make me believe him. i’m just having a hard time believing cops would be so stupid as to commit such an act on a subway platform with witnesses around.

        They found DNA – no fecal material, blood – DNA can come from anywhere – nightstick may have been wiped clean, but…………..
        But yeah, I’m straddling the fence – I have trouble with the credibility of this guy and I have lots of trouble with Sharpton’s credibility.
        I have a hard time believing a cop would do this on a subway platform but people do some pretty stupid things. With Abner Louima at least they waited until he was in a restroom.
        Mineo and Sharpton are going to suck this one dry – whether it happened or not. And regardless, I think a cop’s career is in the toilet.

            Much as I dislike Sharpton, I gotta admit he’s got some influence and he could cause a lot of trouble for the NYPD. They may be erring on the side of caution or even throwing Sharpton a bone. Kern is done, I’ll wager – he won’t get a fair shake with Sharpton involved, I’m afraid. I’m not defending the cop – if he did it, then fuck him. Sharpton and Mineo are prosecuting him in the court of public opinion right now, and they’re doing a damn fine job.

            Now, if you don’t mind, I’d like to go back to refering to Mineo as a goddam, reefer toking, pinko, commie bastard.

He’s probably had run-in’s with these officers before, which is why he ran from them…his intuitions were right on target. If there’s DNA on the baton, and if his rectum was so torn that he needed to be hospitalized, this is a cut-and-dry case–why is anyone questioning it? The look of pain on his face in those photos is horrible. He deserves whatever compensation he can get. And this story needs to be publicized because some police officers think they’re above the law and can do whatever the hell they want to to whomever…I hope the officer who stuck the baton up this man’s butt gets a lengthy jail sentence where he may find many an object inserted up his butt.

        Any comment with a link to another website gets moderated by the WordPress software automatically, as does a comment with certain words like the “N” word. There’s nothing we can do about that because it’s built into the software and not selectable.
        FYI, I approve all moderated comments, no matter how offensive. I banned one guy, but felt badly about it afterwards, and basically got talked out of ever doing it again.

      Dude is trying to sue for $200 million. His lawyer is obviously using the broomstick guy as an example saying that the Brooklyn officers “didn’t learn.” Unfortunately, Broomstick man settled out of court, so Mineo wont have any precedence set in his favor… Or against it… However you look at it I suppose.

      It’s a real classic example of “the victim looks like an ass, so nothing unjust could really have happened to him”. There are more details not being released, including the type of dna substance found on the baton which I’m sure is playing a BIG role in Kern’s case.

      as for how a crime can be committed with a crowd around and no one is sure what they witnessed? it happens everyday for the same idea the people in the crowd have. “I’m surely not seeing anything wrong, not with all these people about watching it too.”

      Just as many people if not more choose to witness and not act/not get involved then to do something.

      As I recall from my NYC days, Prospect Park isn’t a particularly good neighborhood. I know that when I used to ride the subways, I kept my distance from people and avoided eye contact. The people in the subway station probably did not want to get involved–they did not want to confront 3 armed police officers about police brutality. If the perpetrators hadn’t been officers, then there’s a chance the passersby would have tried to do something to help. I’m not excusing their actions–I’m just explaining it. Also, I think 200 million dollars is too much–who ends up paying that–the city’s tax payers? The victim should get some kind of compensation, but that seems an exorbitant amount.

      Lewbell- Being that the baton itself is not that big around (we’re not talking the old nightsticks here, this is the ASP collapsible baton) it would not be like being raped by a horse. (for that matter, why would suggest it would feel that way? has this happened to you? It’s kind of difficult to be raped by a horse, from what I have heard…) A baton is smaller around than most dicks.
      And it was less than a week. He went back in LESS than a week. Read the story thoroughly next time. You usually make good comments, so I was disappointed in you when I read this one.

      Okay i am related 2 Richard hes mi cousin once removed. But in a simpler way he is mi cusins cousin. And i never liked him. Take it from me the Kern family is low.
