Nicholas Hernandez
It’s been a long, difficult week here at PYSIH, and I’ve been pretty stressed out at times. But God has a way of taking care of me, even when I’m too stupid to take care of myself. While researching another story I was writing, I came across this little gem, which I had to share with you guys, if only because it’s not often when Justice gets served the way it does in the movies.
You know the kind of justice I’m talking about, don’t you? It’s that, poetic, full of irony, thank you Jesus kind of Justice that, speaking for myself anyway, reaffirms my faith in a Higher Power that cares about what’s going on down here on Earth.
The young, handsome fellow pictured here is 25-year-old Nicholas Hernandez. Nicholas likes to party, like most young men his age. He also likes to drink and, unfortunately, get behind the wheel of a car afterwards. Hernandez was convicted of driving while intoxicated in 2002 and again in 2003, but as July became August during the Summer of 2008, it appears Nicholas Hernandez had turned the corner.
Sadly, for the families of James Kelleher, 26 and Susan Penland, 23, this turned out not to be true. Harris County (Texas) Assistant District Attorney Brent Mayr said Hernandez was driving a Chevrolet Impala the wrong way on the highway and had a blood alcohol concentration of .30, more than three times the legal limit, when he hit Kelleher and Penland head-on as they drove south on Texas 288, killing them both.
Because a third DWI would be a felony, Assistant D.A. Mayr said Hernandez was charged in last year’s wreck with felony murder, which carries a sentence ranging from probation to 99 years or life in prison. He had been released from jail on $100,000 bond. Mayr said he was going to ask jurors to sentence Hernandez to life in prison.
It appears that wasn’t good enough for The Almighty, or maybe He was feeling especially playful on Thursday, February 12th. We all know about The Lord and His famous sense of humor.
Because Nicholas Hernandez was a passenger in a black Ford Mustang that struck a light pole and rolled several times Thursday, ejecting him from the car. Now that in itself isn’t funny. Actually, there’s nothing at all funny about a guy getting killed in an honest accident.
The punchline for the little mishap that cost Nicholas Hernandez a shot at a life sentence was that Police believe the driver, Jose Resendez, 27, was – drumroll please – yes, that’s right, DRINKING and expect him to be charged with intoxication manslaughter. Nyuk, nyuk, nyuk.
I still smile when I think about it, and I wonder what Nicholas Hernandez’s last thought’s were as he flew through the air and realized he was going to end up as roadkill. Unfortunately, I haven’t had a decent face to face conversation with God since I did some great microdot Acid back in the late 1970′s, so I have no idea, but I bet it was pretty damn comical.
And so we bid a fond fare-thee-well to Nick Hernandez. You killed two people drinking and driving, but I think you life ledger board is even now, what with all the abuse your reputation has had to endure because of the way you died. Good luck to you Nicholas Hernandez, wherever you are.

Max, what a story. I needed something like this. Payback is a bitch. I like payback even more when it comes to the ever-deserving in the swift form of “divine intervention”. It doesn’t happen enough, in my opinion. Maybe a subjective view, but hey, it does make me feel like someone is watching, too. Fucker definately got what he deserved. Poetic justice. Beautiful.

Ironic isn’t it? He was a drunk driver that killed people only to die at the hand of another drunk driver. That’s karma for ya!
This story is delightful because of the poetic justice… But sucks because it just illustrates what a problem drunk drivers have become. They are everywhere. Next time all you people start to defend them, just remember that it could be you or your child next. The best part of this, I think is that now, TWO drunk drivers are off the road, at least until the shitbag that killed this shitbag gets outta jail. Thanks for the story, Max.
Nick was in a coma after the accident that killed those two people, maybe he was supposed to go then….
drunk driving is terrible. An incredibly awful phenomena that has just proliferated to the nth degree (if my assumptions are correct). It’s everywhere, it tears families apart, it ruins lives and corrupts those who get away with it into thinking that it’s ok! I, for one, PRAY TO GOD for the day when once again drivers will have the courage to run down their victims while they’re completely sober. Alcohol is just a crutch people!

Amy, the only thing I ever found at the bottom of a glass Tequila is that damn worm. And why do these nut jobs always ‘find” God. Sorry sof, but I save my empathy and compassion for Nicholas Hernandez’s victims. You do realize this guy already had two DUI convictions on his record BEFORE he killed James Kelleher and Susan Penland? You didn’t forget he was driving the wrong way on the highway, with a BAC nearly three times the legal limit, when he hit their car head on, did you?
I wrote it with my tongue planted firmly in my cheek – by no means am I glad anyone was killed. I saw it as a humorous case of divine justice, and that’s how I wrote it up. I knew their was a chance Nick’s family would see this story when I wrote it, and I didn’t really care. You’re bound to catch a little hell when you have a family member who is a chronic alcoholic and serial drunk driver who has no consideration for anyone but himself.
I’m a very direct person – I find it’s the only way to get through to people like this man’s sister, who is in so much denial about her brother she can’t see how evil his actions were. Not once did she show any compassion for her brother’s victims or their families. Her post was all about making excuses for what he did, and I responded in a harsh but appropriate manner. She tried to play the religious card, so I played the obscenely crude card – It was a calculated response to her holier-than-thou hypocrisy. You have a right to your opinion, but I know I wouldn’t have handled it any other way.
I never defended Hernandez, nor will I. He was a terrible person, and I have no empathy for him. It’s his family that I feel for, along with the families of his victims. My comment had nothing to do with the entry — I was referring to the things being said about his sister after she posted here.
I don’t see how his family’s pain is any less heartbreaking than that of his victim’s families. Yes, there is some poetic justice in what happened to him, but it does not change the fact that he was killed in the very same circumstances as James Kelleher and Susan Penland. Why should his family be less deserving of empathy just because HE was a bastard? They obviously loved him, and felt a profound loss when he was killed. This doesn’t make them bad people — it makes them human. Regardless of how we feel about HIM, it shouldn’t impact the way we treat his family.
She didn’t show sensitivity to the other families in her post, but I think that’s forgivable under the circumstances. It’s difficult to think of anything other than your own grief when you lose a loved one. I haven’t seen any sympathy for his sister coming from the other family, and again, that’s perfectly understandable. It’s unfair to criticize someone for the way they act while they’re in grief. Frankly, I think your response to her was more than just “direct” — it was blatantly cruel. Would you say the same thing to James Kelleher and Susan Penland’s families if they didn’t show empathy for Hernadez’s family? Of course not.
I don’t see why people feel they must “save” their empathy, as if they only have a limited supply. You can still feel compassion for the families of James Kelleher and Susan Penland while also acknowledging that the Hernadez family is suffering too — it’s not like empathy has to take sides.
I apologize for the long rant, but I had to say something about all of this. I don’t understand how you guys can have so much compassion for one family and so little for another, when both are in the same situation.

If your brother received the lord, than I suppose by your Christian standards, he’s not in hell. I don’t care if he’s in hell – I don’t wish him to suffer eternally for our suffering. However, the Bible says ‘eye for an eye..’ well, in any sense of that metaphor, than we can conclude that this extends to ‘life for a life.’ Or in our case two innocent lives for one irresponsible one.
Has the writer of this article never been behind a wheel while inder the influence, or known someone that has been? What if you too woke up out of a coma and realized there had been a horrible accident, do you believe you should “rot in hell?” Come on, it’s not like he went out that summer day in August and was like “im going to take some lives today.” Accidents so horrible have happened to some of the greatest people and I wouldn’t be saying karma if I were you. I am pretty sure that one of those days back in the 70s when you were having your acidtrip, if something remotely like that wouldve happened, you wouldnt feel you have the right to write about how people deserve to rot in hell. And anyone who comments “karma” on this story also should take a step back and say, “damn that couldve happened to me last saturday night” or “that couldve been my friend after the party we went to.” Nick had demons, thats for sure, but his wife, children, parents, family & friends do not need to see this. Have a little respect even for the smallest most innocent victims.
I can’t speak for Max, but I know damn well I haven’t. I doubt anyone would condone it no matter who it is. My uncle had a major drinking problem, and he once tried to drive under the influence. I absolutely did not let him. I demanded he stay home. We have the upmost respect for his family, but damn him. If he didn’t want to be frowned upon for what he did he shouldn’t have done it. Ummm. no, I promise you it could NOT be me. There is no way on God’s green earth that I would drive after even a single glass of wine. I have enough self control and enough sense of responsibility that I do not drink if I might have to drive, and I absolutely do not drive if I have been drinking. If I ever found myself in a situation like that, I would call a taxi, or a friend – hell – I might even call the cops. But I WOULD NOT DRIVE.
And, frankly, I am terrified of people like you who seem to think that this was an “accident”. It was not – it was terrible tragedy caused by a stupid fuck who took chances with OTHER PEOPLES LIVES. Someone wants to kill themself? Be my guest – but when they do shit that puts others in jeopardy, then they are a miserable, shitty, sniveling worm, in my opinion. And when people try to defend the worm’s actions because “everyone does it” then they are lower than dirt as well. And, yes – I do mean YOU.
You know what jenn? The chances of me killing someone with a car wile tripping were pretty remote, since I knew enough even then not to drive a car while I was hallucinating – if you think people jump off buildings and don’t have control over their actions on acid, then you watched too much Dragnet.
I wrote this story tongue in cheek, don’t blame me for the subject matter. Nick chose the the lifestyle he lived, and set himself up as the biggest joke to come out of Texas since G.W. Bush. I don’t care if you don’t or can’t appreciate the humor – it’s too bad that you don’t. I don’t care if I upset his family, but I do care about the families of the two people he killed.
And while we’re at it, how can you possible call what Nicholas did an accident. After not one, but TWO DUI’s, he gets behind the wheel of a car while he’s drunk AGAIN, .30 worth of drunk, drives the wrong way on a highway and hits James Kelleher and Susan Penland head on and kills them. That’s no accident sweetheart, that’s murder.
Most of all, I don’t five a flying fuck what you think of me or my story. I write what I write for the benefit of the people who frequent this website. If I can get under the skin of stupid people like yourself, well that’s just a bonus.

I personaly have never driven under the influence. I have way too much respect for human life. But just say that i did, and i killed someone, i wouldnt want to wake up from a coma, and i think that the guilt alone would kill me…if not naturally, then with the help of a noose.

I am 23 years old and I go out drinking just about every weekend…never have I once got behind the wheel. I have a DD or I call a cab…its not that difficult. And I live in the freakin country, so walking home is WAY out of the question, and I still find it easy to get home in one piece and without killing anybody. Oh and here’s a little secret that maybe Nicholas didn’t know, and maybe you should be let in on…. If you don’t HAVE a ride, DONT. DRINK. What a concept!!
Drunk driving is a crime and when people get killed it is homicide. Accidents are not illegal.

Obviously, he didn’t care that much about his wife or his kids since he continued to make choices to put his and other’s lives in danger. It is gonna be some heavy stuff when his kids do get older and realize that their daddy killed people while driving under the influence and then, invariably was killed by a drunk driver. They should not be lied to and made to believe that their dad was a wonderful person, because he was not. Just ask his victims familes and they will tell you.

That’s really very understanding of you and I am sure that Jose appreciates your support. I trust that you will go stand up for him when he goes on trial for killing Nick. It was just a mistake, and could happen to anyone, right? Surely Nick would forgive his buddy for killing him and depriving his wife and children of their husband and father. After all it was just a little bad decision that Jose made that night when he decided to drink and drive. Could happen to anyone.

There was a story kind of similar to this today in NYC. Last night A pimp and one of his prostitutes were beating another one of his hoes with a bat in downtown manhattan. The cops came and him and his main hoe jumped in a car and sped away… problem was, when they hit the intersection the car was smashed by a garbage truck… the pimp is dead and the hoe is in critical condition. The prostitute they beat up has a broken arm… and hopefully a new lease on life. Now thats KARMA!

Just thought I would throw that out there before I get down to the business of commenting on this ass hat. I have to be honest here. I have gotten behind the wheel tipsy a few times. Yeah I know, I’m stupid. Guess what though. I learned my lesson and NOT by killing someone, thank God! I just finally realized that I COULD end up killing someone, or killing myself, so I have never, ever done it again. I will either walk, call a cab or call a friend. If I can’t get anyone to come get me, I will sleep in my car or on the sidewalk, etc. But I can promise you this, nobody will ever ever die because I was stupid enough to drive drunk EVER again. I’m so glad that I didn’t have to learn my lesson the hard way. It would be a horrible lesson to learn. I have a really good friend that was in his own truck that was being driven by a drunk friend because my friend felt like he was too drunk to drive. Guess what. The truck ended up in a ditch and the driver ended up dead. My friend has had 4 back surgeries for a severed spinal cord and has to give his vehicle a blow job before it will even start. He was also being investigated for intoxication manslaughter. After seeing his scars and listening to his stories, I realized that my time was coming if I didn’t stop. I’m scared to death that my boys are going to be out driving around and get hit by a drunk driver. I think it is poetic justice that this guy got what he had coming to him in the same way he took out two innocent people. DON’T DRINK AND DRIVE PEOPLE!!!! Thank you. :)

Nicholas is a murderer no question. You keep refering to an accident but what Nichollas did was no accident it was pre meditated. If after the first DUI he kept doing it, then that shows he didn’t care and does anyone believe poor little St.Nichollas only drove drunk three times and got caught for each of them. I work at camps for people with disabilities and it is amazing how many of them suffer brain damage at the hands of drunk drivers. I don’t fault anyone for having a drinking problem, but after two DUI’s, he should have checked himself into a rehab center. Also, after 2 DUI’s, his license would have been suspended, no? So he shouldn’t have gotten behind the wheel of a car anyway. I hope someday ALL steering wheels of cars of convicted DUI offenders are hooked up to breathalyzers. Think of all the lives it would save.

It’s a perfect example of a danger in religion. Stupid people catch the words that they can understand, but never bother to examine the meanings.
My favorite is “only God can judge” or “judge not lest ye be judged”. There are many many references to man’s right and even his obligation to judge others in the Bible. There is one reference to not judging others. And even this reference does not mean what the ignorant think it does. It means that we need to look at our own actions BEFORE we judge another. ie: If I am a murdering baby-raper, I should think hard about my OWN actions before I judge another murdering baby-raper. It does not mean that that the other scumball is OK.
Carrying it further – religions say that God will judge you for entry to the Kingdom of Heaven. OK. But where does ANYTHING say that man can’t judge you too? The two judgments are not mutually exclusive. Presumably, God will not make mistakes in judging, whereas man might. So, if you are innocent of a crime for which man had judged you, take comfort in the fact that God will not make the same mistake.
Anyway, the ignorant masses go sit in church every so often, and think that they somehow get showered with good graces by osmosis, just by sitting there. They pick out the words that comfort them, especially if they personally have a guilty heart about something. Shoplifted something from a store? Lied to cover your relatives ass? Cheated the government? Sold a few drugs? Then the concept “only God can judge” is a comfort, because God presumably knows how hard it was for you (the victim) down here. Boy are they gonna be in for a BIG surprise when they finally look their God eye-to-eye.

As someone who lost her 18 year old brother to a drunk driver, I can honestly say I have no sympathy whatsoever. Nick wasn’t a man. He was nothing but an ignorant ass drunk who didn’t give 2 shits about his NUMEROUS DUIs, his children, or the people he could kill because he wanted to get shitfaced. Well, now he’s worm food. Life goes on. He got his, and his family knows it. He’s left no legacy (I doubt “Ignorant Skidmark Memorial Scholarship” is going to be in high demand), and his children will remember nothing about him (except that he was a drunk asshole). And honestly, who puts themselves in that situation as a responsible parent? I have a toddler and can barely bring myself to enjoy a glass of wine, let alone have time to rack up DUIs and you know, drive around killing people. But ohhhhh that’s right. Little Nicky didn’t give a shit about being a good father. He didn’t think about the children he would leave behind, the families he would destroy. Or maybe he did think about it. Nicholas had no right to break the law. Further, he had no right to take these special people from our lives. The reason Nicholas life is over is because he chose to be irresponsible for at least the 3rd time – by putting his life in Jose’s inebriated arms.

There’s an old saying I picked up in AA that says “God watches over little children and drunks.” He watched over Nicholas Hernandez much longer than he deserved. Finally, Nick made one dumb decision too many, and he free-willed two innocent people into their graves.

Me and my mother were hit by a drunk driver when I was 14yrs old and then he tried to run me over when I got out of the car to try and get his license plate number when he decided to leave the scene of the wreck! They’re all pieces of shit! When you’re sober and head for a bar or wherever knowing you are going to drink and your only ride home is driving yourself there then it’s surely NOT a mistake! You might as well loaded a gun and played russian roulette with the public!
