Daryush Omar
The case of Daryush Omar is so disturbing, so frustrating, that I’m still not sure who is going to get nominated for a free trip to Hell. It’s a nightmare of impotent immigration policies combined with the revolving door of the American Justice system.
Omar, 24, of Queens, New York, is an illegal immigrant from Afghanistan. His mother snuck him into the United States when he was a baby, and the U.S. Has been trying to throw him out ever since. Check out the trials and travails of Daryush Omar and The United States Immigration Service.
* Omar came to the US illegally as a child, flying into JFK Airport with his mother on July 6, 1989.
* In 1992, an immigration judge denied his mother’s asylum application and ordered Omar “excluded” from the United States.
* He was ordered out again in February 1994, but didn’t leave.
* In October 2004, Omar was picked up by the Nassau County Police Department on an outstanding ICE warrant, and arrested the next day by federal agents.
* That same month, ICE officials made the first of several requests for travel documents from Afghan officials to deport Omar.
* On Nov. 30, 2004, Omar was taken into custody in Ocean County, NJ, on another outstanding warrant for
driving while impaired and using offensive language. He was convicted Dec. 10 on the latter charge and returned to ICE custody.
* In September 2005, an immigration judge again ordered him deported; the order was finalized that October.
* In 2005, Omar allegedly renounced his Afghan citizenship in an effort to thwart deportation efforts.
* On Feb. 17, 2006, ICE – still without the paperwork to send him to Afghanistan – let Omar out on supervised release.
* From October 2006 through January 2008, ICE officials made a series of requests to Afghan officials, again requesting travel documents and asking the status on Omar’s renunciation request.
* In February 2008, Afghan officials here told ICE they still hadn’t made a decision of Omar’s renunciation request.
During this period, Daryush Omar did not behave himself.
A 24-year-old Investment Banker, Thomas Whitney, asked Omar for directions on the morning of May 21, 2006; witnesses told police they saw the Omar bash Whitney’s head with a steel bar and steal his wallet. He died hours later. Omar and two accomplices, Najib Noor, 19, and Walliullah Hashimi, 22, both of Queens, were later identified on surveillance footage using his credit cards – to buy gas, clothing and sneakers.
But although Daryush Omar and his friends were charged with Murder and Robbery, prosecutor have yet to try him, and he was released without bail soon after his arrest because none of the witnesses from that night have come forward in the two years since Whitney was beaten to death. Not one. They just haven’t got enough evidence to try this guy, and no none who can really do anything about that apparently seems to care.
Well, perhaps they’ll care now.
At approximately 3AM on the morning of November 16th, 2008, Daryush Omar was driving his 2004 Range Rover at high speed southbound on 34th Street in Brooklyn when he ran a red light and slammed into a livery cab. The passenger in the cab, Panayiota Demetriou, 30, of Queens, and the driver, Bessy Velásquez, 41, of Brooklyn, were both severely injured.
Panayiota Demetriou had legally immigrated from Cyprus and was studying for graduate degree in child psychology at Pace University. Bessy Velásquez, a single mother of two teenaged girls, was working her second job driving for Myrtle Car Service – she also worked as a cleaner for Jet Blue Airlines at LaGuardia Airport.
Both women were pronounced dead a short while later at Mount Sinai Hospital of Queens.
Daryush Omar was drunk.
Omar has been charged with 2 counts of Vehicular Manslaughter, 2 counts of First Degree Criminally Negligent Homicide, 2 counts of Second Degree Criminally Negligent Homicide, Operating a Motor Vehicle While Intoxicated and several motor vehicle violations. He is being held at Riker’s Island without bail.
Why was this guy on the street? With two previous DWI convictions, a murder indictment and a court order to deport him, why was he not sitting in a jail cell waiting for his walking papers. Even if they couldn’t prosecute him for Thomas Whitney’s murder, I don’t understand why he couldn’t be held in some kind of protective custody (for our protection) until Afghanistan was ready to take his ass back. And they’re was always Guantanamo Bay – This guy was a much of a terrorist as anyone held there.

This is absoutely horrible, but I hear all the time about law abiding citizens from Mexico that come over here, work two or three jobs, pay taxes and get deported just because thier job gets “raided” by INS. I am so horrified. I don’t blame the mother though, she probably had no idea what kind of monster she had given birth to. I don’t blame the witnesses because they were probably just scared shitless, but I do blame everyone else, especially the DA?!? How can you NOT prosecute someone when you have video evidence of them using the murder victims credit cards?! How would you justify that? Astounding! yet another reason why we need a complete overhaul of the immigration system laws. In my opinion, as soon as you are convicted of ANY crime, except a city ordinance violation, you should have to be on “immigration probation” where they can monitor you closely, subject you to drug tests and deport your ass if you fuck up again. This is so sad. I will pray for the families of the victims.
i agree with you on everything EXCEPT the blaming the mom… now i don’t know for a fact, but i have dated arabic men before and i know from first hand experience their moms worship the ground they walk on… my ex could do NO wrong in her eyes, everything was always someone elses fault (including mine, hence we didn’t work out).. like i said, maybe this mom was diff. but in that culture its usually the men running the show..

I visted England one time and my first inclinations were that I was in an extremely advanced society in terms of its humane treatment of its citizens and the wisdom which the general population carries as a whole. Although there exists a Queen, the people’s interests are taken into consideration far more than they are here, even with our elected officals. Democracy can be a joke-especially when mixed with heavy, heavy, capitalism. England has progressed through the thousands of years it has existed and is wiser as a result. This world has no ‘utopia’. Every country has it’s problems, and I agree that the U.S. has and does do things that I don’t agree with. However, the Unites States gets a HORRIBLE rap by the world community because we are the only superpower, so anytime we do anything we get slandered. It sucks. Everyone loves to insult those in power. Much like my job as a police officer.
I think it’s so ironic that while so many people that world over insult the US and call us ‘warmongers’, ‘western devil’, etc., our borders seem to overflow with so many people wanting to get IN to our great country.

I also believe, from years of first hand experience on the streets, that our nation has reached a crossroads. I would love everyone to come to our great country and enjoy our magnificent way of life. HOWEVER, so many immigrants come here to take ADVANTAGE of our system, not take PART of it. Perhaps that poem on the statue of liberty should have another line that says:

I think that our open borders WOULD be great if everyone that crossed into them wanted to be a productive part of our country. But too many, like this asshole, only committed crimes and made life miserable for other good citizens.
I’m being long winded; I’ll get to the point. Our country is just like any other organization. If you want to be a part of it, you need to play by the rules or you will have to leave. So many people get mad about deportation, but consider this. How is going to prison for the rest of your life different from deportation? It really isn’t; either way your are being removed from society.
I’m probably going to hear it for this next statement, but I am proud to have succesfully placed numerous people on ICE holds that led to their deportation from this country. I did it because they were not a citizen, therefore not my countrymen, and they were making life miserable by victimizing the good citizens that I have sworn to protect. They didn’t play by the rules, so they had to leave my country. Fair, simple justice. I love it.

I do want to say that parts of me agree with you stormy weathers. I do believe that it is hard for middle eastern people to believe in our country when they are watching us blow up their country. I also do not support the war in Iraq but support the troops. I give them a bow for their courage and for their hard work. On the other hand, a war was started on us with 9/11. I believe that a war needed to take place but not the one that did. I do not believe in war so it is with difficulty that I say that on 9/12/02 while the people in Afghanistan were cheering in the streets for our thousands dead that we should have dropped a bomb and destoyed this country. We as a country have to take a stand and I for one am tired of being ashamed of not being a minority.
I had nothing to do with the overtaking of the indians but yes I do feel bad about that part of our history. I feel bad for every minority that has been judged unfairly and taken advantage of but why do I now get taken advantage of and judged unfairly? I am not rascist, nor I do judge by color. I believe that a person is more than skin color but yet repeatedly I look at white children being told that they have to pay 100% for that schooling while someone else gets to partake in affirmative action. While I do agree that this guy deserves hell.. Im a little torn on wether or not he should of been deported.. He had lived here since he was a baby, this is the country he has known.. Now that he is in Riker’s I hope that everyone involved forgets to move forward with any legal proceedings. Then he can die in prison which is what he deserved in the first place.
Regarding other comments, just because he has been in the country for so many years does not make his residence legal . A crime is a crime. Illegal immigration is a crime. This guy is an illegal immigrant. Does murder become okay and accepted just because a certain number of years have passed ?

While I don’t agree with the xenophobic nutjobs who want to close our borders to all immigrants, I’m totally against a policy that coddles people who enter this country illegally. I went to middle and high school with this loser. And how is it that he didn’t get in trouble for being here from 1994 to 2004, ten years later? This is Panayiota Demetrious’ brother … I have just come accross your blog and I want to thank the one who wrote it and all of you for your support. I dont know if you are aware but the murderer, I cant even say his name, was heard muttering after they told him that Bessy and my sister were .. dead “TWO LESS BITCHES TO WORRY ABOUT” I never really hated anyone in my life, but this bastard has destroyed my family and 2 other homes, and a lot of people have been affaected by this story. My family’s aim is to keep her memory alive and see him rot in jail, but unfortunately the recent news is that he will get a maximum of 7 years and then an immediate deportation back to the shithole he belongs. When I came to New York in February – March, reporters were asking us what we would do if we had him in front of us. Your replies on this post reflect your views, for if I had him in front of him I would torture him as much as I can in the most horrible ways before letting him die .. THERE IS NO JUSTICE IN THIS WORLD. 3 LIVES, 3 BROKEN HOMES FOR 7 YEARS?
Mr. Demetriou, thank you for your kind words, and please let me say how sorry we all are here at PYSIH over the death of your sister Panayiota. I can tell from you reaction that she must have been a fine woman and a great sister. I wrote this story, and I agree that it’s incredibly frustrating that Daryush Omar was even in this country and able to be driving a car drunk.
I did some research for you concerning Omar’s potential sentence, and although I’m not a lawyer, I’m pretty confident that he faces much more time than 7 years. The most severe charges he faces is 2 counts of Vehicular Manslaughter, a Class “C” felony in New York State. It’s true the minimum sentence he could receive for those two offenses is 7 years in prison. However if the judge decides to sentence him to the maximum term of 15 years for each count, and orders the two sentences to be served consecutively, he’ll end up with 30 years. And that doesn’t even take into account the DUI charge, which could tack on a couple of more years.
The 30 years is good possibility too, for a couple of reasons. This is his second DUI, and he already has a record for violent crime. He’s also facing the murder and robbery charges for Thomas Whitney’s death, which the judge may take into account.
I’m not trying to get your hopes up, but this is the reality of the situation. Whatever the case, we all wish you the best of luck, and everyone here hopes Omar gets all the prison time he possibly can. get.
Thank you for the work you are doing. My goal is to keep my sister’s memory alive and see this monster behind bars for as long as it takes. My sister was a wonderful person, the kind you met once and never forgot about her. Seeing videos and photos from her last night is a testimony to how fully she lived her life, always adventurous, and out there to make a difference. Everywhere I go and I tell them who I am, they know about my sister’s story because of its tragedy, even after so many months. He hasnt just destroyed my life but also my brothers’, parents’ and extended family. The funeral was packed with people, like her memorial in NY. Her grave is undoubtedly the most beautiful in that cemetary, and I am talking about the biggest in the city. She was a wander, an angel that we had the luck of having her for 30 years, a gift to the family that was robbed from us. Reading Bessy Velasquez’s story and her daughters’ agony without her, as well as Thomas Whitney’s father makes me even more furious. Three famolies, three exceptional people, taken by a monster. There have been news on the case but I don;t think they are out officially yet. He will plead guilty (whereas in the beggining he was saying that he didnt do anything wrong!!) so that he gets minimum sentence. If both families don’t agree then he could be sentenced to much less years than already thought. We only know for sure that once his sentence is over, he will be deported to Afghanistan. I hope the other guys in prison make his life a living hell for that’s what he has caused upon our families. Sometimes I think, where the hell is that life penalty sentence … and then I change my mind, wanting to see him suffer for the rest of his life. He will get one of the two, I am sure.
I don’t care where this f**ker grew up, lived or lives he shouldn’t have been on the street. Now he is in jail where he always belonged and that’s where he should remain to rot!!! No deportation, no nothing just rot in jail and then in hell…

For killing 2 people he got less time in jail than some people go to college for. He got less time than a habitual shoplifter doing nothing mor than swiping a few CD’s.
