PARENTS OF BOY WHO STARVED TO DEATH FILE LAWSUIT

The parents of a 7-year-old boy who starved to death in the care of his mother’s ex-boyfriend have filed a wrongful-death lawsuit against the agencies that administer child-welfare services in Denver and Jefferson counties.
Christina Grafner (HER MYSPACE PAGE) and Joshua Norris filed suit Tuesday in federal court in Denver against the Department of Human Services in each county. Grafner and Norris are the biological parents of Chandler Grafner, who weighed 34 pounds when he died in May 2007.
Court records say Chandler starved to death after being locked in a closet for days without food or water in the home of Christina Grafner’s ex-boyfriend Jon Phillips and his girlfriend, Sarah Berry.
A jury in August convicted Phillips of first-degree murder, fatal child abuse and evidence tampering in the boy’s death, while Berry pleaded guilty to second-degree murder.
The lawsuit alleges the Jefferson County DHS took Chandler from his mother against her will and placed him with Phillips and Berry, in Denver County, without adequately investigating whether they were fit foster parents.
The suit says the human services departments in both counties then failed in their responsibility to keep Chandler safe and monitor his well-being, including mishandling reports from the boy’s school that he suffered abuse.
The agencies “had an affirmative duty to act on behalf of Chandler Grafner in the administration of Chandler Grafner’s welfare, including preventing or remedying neglect, abuse or exploitation of Chandler Grafner, or preserving, rehabilitating or reuniting Chandler Grafner’s biological family,” the lawsuit says.
The departments weren’t available for comment late Tuesday. The suit also names Margaret Booker, who headed investigation of child maltreatment and intake services for the Denver County DHS; and Mary Peagler, Denver County DHS case record supervisor.
Also listed as a plaintiff is Melissa R. Schwartz, a representative of Chandler’s estate.
The lawsuit seeks a jury trial and unspecified damages.
This actually isn’t a new story. These two “parents” sent a letter to the court announcing their intention to files this lawsuit back in 2007. One of their main points was that Colorado DHS didn’t try to place the children with other family members after Chandler and his half-brother Dominic were taken from Christina after she was arrested for driving on a suspended license and possession of drug paraphernalia.
I found a Blog called Colton Levi Clark which explains why this is not true, and some of the reasons why DHS ended up placing Chandler Gardner with Jon Phillips and Sarah Berry:
In October 2004 the Arapahoe County Department of Human Services received a referral call regarding Chandler and his younger half brother, Dominic. According to the report, Chandler was four years of age and still not potty trained. He was still drinking from a bottle and had expressed fear of his “Dad” (referring to Jon Phillips who was living with Christina at the time and the father of his half brother Dominic.) Those allegations were considered unfounded and the case was closed in January 2005 with a risk level of medium.
In September 2005, Chandler who was then age five and a neighbor child, aged three were found walking in a busy intersection around 9:30AM in the morning. The children had been missing for almost an hour. Christina Grafner was charged with Child Abuse and pleaded guilty to this charge on November 2, 2005. She was placed on one-year probation and the case was closed a year later. The children were still residing with her.
For the remainder 2005, several referrals were made to DHS regarding the two boys and some of those calls were from Christina’s mother Sandra Younger. In December of 2005 Sandra Younger reported to DHS that Christina and the boys were no longer residing with her and had moved to Jefferson County. Because Jefferson County could not find a valid address for Christina and the boys, the assessment was closed.
In March of 2006, a Wheat Ridge police officer responded to a call of a vehicle blocking traffic. It was found that Christina Grafner appeared to be under the influence of cocaine or meth and found a crack pipe in her vehicle. Her two boys, Chandler and Dominic were in the vehicle with her at the time. They were not in car seats and were not wearing shoes and according to the officer looked neglected. He noted that Chandler looked extremely thin and it was found that the boys had not eaten in at least a day (some reports state three days). The officer also noted that Chandler’s teeth were decayed. (This was probably Bottle Rot since he was drinking a bottle at least until the age of four years old).
Christina was arrested and DHS signed temporary custody to the Grandmother, Sandra Younger. The placement with Ms. Younger did not last long however because when an assessment of the home uncovered that Sandra Younger allowed unsupervised visits with Christina, which violated the court order. It also found that Sandra Younger was transporting the children without a legal driver’s license and insurance and did not provide car seats for the children. In addition, Ms. Younger was found to be living with someone with a criminal history.
The Jefferson County DHS was granted temporary custody of both Chandler and Dominic. A treatment plan was devised for both Christina Grafner and Jon Phillips. In the meantime DHS placed the boys with Phillips, with the approval of Sandra Younger.
Christina Grafner did not abide by any of the plan DHS laid out and according to an investigative assessment into DHS and the role they played in Chandler’s death, critical mistakes were made in placing the children with Phillips as well.
Joshua Norris also complained that no attempt was ever made to place Chandler with him. Well, gee whiz Josh, maybe it had something to do with this arrest for Stalking, or this arrest for Domestic Violence (in fairness, the DA did dismiss it), or this one for Violation of a Restraining Order. All of this happened in 2007, according to the court records I accessed. Then there are the 4 speeding tickets over the last 10 years, the two most recent for doing 85 MPH in a 55 MPH zone.
There’s little doubt that Colorado DHS bungled the Chandler Gardner case while Christina Grafner and Jon Phillips abused and eventually starved the poor kid to death. But it takes a lot of chutzpa to claim that you’ve suddenly become caring, loving parents after years of abuse and neglect, just in time to cash in on a big fat lawsuit. There is some consolation in the fact that Colorado State law limits the amount Grafner and Norris can collect to 150,000 dollars each.
That still a lot of crack, ain’t it Christina? That is if Josh doesn’t kick your ass and take it from you.

My father was a quartermaster on a US Navy minesweeper back in the day. He mentioned that the only time he ever met a Coast Guard vessel, it was attempting to warn his ship out of mine infested waters(what Coasties were doing in southeast asian waters at that time, was a history lesson in and of itself), by blaring a bull horns, and attempting to raise the “quiet” minesweeper on the radio.
They built minesweepers out of wood in those days, and minesweepers turned off radios just before they did runs to avoid interference with their mine detection equipment, or to avoid setting off mines.

What a couple of pieces of shit. These poor children were neglected, abused, starved, and forgotten. Now just because they gave up a sperm and an egg they think they are entitled? They decided the drugs were more important than the children. And now they want to be paid? That poor little boy died thinking that no one, NO ONE cared about him. Sadly, no one that was supposed to care, did.
You know, surprisingly I’m going to have to go with NO on this one, simply because the vote includes both nimrods.
Now before anyone decides to put a bag of flaming dog shit on my front porch, here’s why:
There is NO PROOF here telling me that the bio dad Mr. Josh Norris would have been a WORSE parent than Ms. Grafner. There’s some implications, but no real proof. AND he couldn’t possibly have been any worse than “Daddy Jon” and his live in. It’s very clear that the kids mom was a crackhead. And Joshua Norris DID obviously leave his kid with her, which is a fat point against him. But the court is corrupt; I’ve seen first hand what people say in court about others just for their own motives, and I’ve had the “privilege” of sitting in on many many many custody and divorce cases. Unless there is tangible proof of the stalking AND the DV (because if you didn’t know, there is a bias in the DV courts in more than one direction for one, and for two, did you know that LANGUAGE can be considered abuse in the matter of custody at least???). And even if he DID smack the crackhead around, as per at least one custody case I’ve read about and more I’ve witnessed: there is no proof he would have smacked his kids around too…
Either way: smacked around or dead? Terrible choice isn’t it, but if I was that poor boy I’d have voted for “smacked around and alive” with sperm donor Joshua.
This is why, btw, that not everyone should breed.
Edit: Let me finish off by saying that maybe Egg Donor is trying to get some cash for new rock, and possibly the dad is too, but out of the both of them I might find a small smidgen of belief that MAYBE the dad is just hurt that his son is dead. Maybe they both are scum. /Shrug

Okay, this is obviously a case close to my heart and I have been following it and crying about it since day one. My thoughts are this, the courts should be laughing these two fuckwads out of the building. Neither one gave a crap enough to try to provide a happy, stable, safe home for these INNOCENT children who didn’t ask to be put on this earth. They did NOTHING to any of the “adults” involved in this case except exist. Now all of the sudden it’s time to point fingers and perhaps cash in?? Why is it even being entertained? I hope and pray and plead that the courts or a jury does the right thing here and throws this shit right out the window and into the dumpster where it belongs. NO ONE should profit in any form for this poor baby’s horrible, torturous death, if anything some heads, many of them, should be rolling instead. In my opinion ANYONE and I mean ANYONE, including grandparents, teachers, pastors, DHS, doctors, neighbors…..ANYONE, who didn’t SCREAM loud enough for this helpless boy and KNEW he was in danger or being mistreated should be held accountable in some way for his death. All of those people should be feeling quite ashamed…..THIS is what happens when “no one wants to get involved” THIS is what happens “when people turn the other cheek and mind their own business.” Well I for one hope that this can be a lesson to us all that THIS IS what happens and WE SHOULD get involved and WE SHOULDN’T turn the other cheek. People KNEW, many people knew, or had an idea at the very least and no one fought hard enough for Chandler and that saddens me soo much because he WAS worth it and no one cared enough, not his “biological parents” not his neighbors, not his teachers, not his GRANDPARENTS, no one. IF it was me I would have been breaking down doors and on the phone 24/7 raising holy hell making MYSELF BE HEARD. I guess it was too much of a burden or cut into too much soap opera or sports center time. This is why the world is fucked up, because quite frankly when it comes down to brass tacks……no one cares anymore!!

Dad sounds like a bit of a looser – not worth much and he definately dipped the wick into a bad hole…… Should have played “bedroom golf” on a much better course!
With that said, he and I could have had a lot in common with the key difference being that my X had something to loose by screwing with me too hard while this poor bastard may have been a victim of open season. My X threated to tel police all sorts of bull and get a restraining order against me, then she was going to rent the house out to her sister…… I assured her that as soon as I was kicked out, I would have the house condemned.
Also jail time wold have a real impact on my paycheck….
I let her know that if I was forced to live with my parents again, I would make it a point to work at McDonald’s as that was the only “major” employer within a decent & safe walking distance from their house…..
So their father was not perfect, but some poeple are way better parents than they are people… I had a girlfriend who was a real piece of work, but as a mother she did OK by the kids. Although as adults the kids do not like her, but don’t seem to hate her.

I totally agree. If these parents had cared at all, this never would have happened. It is so sad that they only care now, when they can get some money out of it. Ideally, they would stop using drugs because of this ordeal, straightening up and realizing that it was ultimately their fault that the child died. Instead, they are blaming everyone else. He was in town in 2007, because all the arrests were in Adams County, Colorado. It appears from his court records he’s been living there for at least 10 years, except for a stint in the military that I haven’t been able to verify. Maybe Liz knows more about that.

It is impossible to imagine that DHS made no contact attempt with the bio dad. No matter how irresponsible the paperpushers at agencys are they would do that. Their little forms and boxes require it, and that’s all they can really do well.
So, either sperm donor was completely unfit, unfindable or unwilling to take his kid. Or, he refused to take the other kid, and DHS thought it best to keep them together if at all possible. PLACING the kids with stepdaddy/real daddy was not a bad decision (on paper), it was the lack of followup action. But even that – how can we blame DHS for what two murdering scumballs did? To paraphrase: DHS doesn’t kill kids – toxic adults kill kids. (And you guys know how I feel about DHS, lol)

No, you read it right. Christina Grafner and Joshua Norris are the biological parents of Chandler Grafner. Jon Phillips was the father of Christina Grafner’s other son, Dominic, and Sarah Berry is his girlfriend/common law wife. When Christina Grafner lost custody of Chandler, DCF gave physical custody of the boy to Jon Phillips, because he seemed to be the best option available.

The cast iron pan is tempting, but I refer long slow pain in a case like this. That’s why I mam such a fan of “stoning to death”. All those little stones.. plunk plunk plunk… each one leaving a mark and a shot of pain… and then finally wearing them down. If that was a punishment, I swear a lot of people would think hard before committing their crimes. Lethal injection and the chair are so abstract, but people can relate to stoning. Plus, the victims and loved ones could participate. (If only I were queen of the world *sigh*)

This little boy was failed by EVERYONE involved. This case sucks. I have almost gone into a panic attck trying to imagine being thirsty, hungry, and trapped in a small and dark space for hours/days at a time. These “parents” should be ashamed of themselves. If not for their own neglect/crackheadedness, Chandler would not have been taken from them in the first place. As far as I’m concerned these are a coupla crackheads trying to cash in on their sons death WHICH THEY CONTRIBUTED TO. Send to hell? F**kin A!!! Burn baby burn!!! They should not get ONE DOLLAR of blood money for that poor kid. If anyone should get money it’s his poor brother Dominic who will probably always regret not sneaking food to Chandler when he begged for it. Should Chandler have been placed with me Yes. Why You ask well here is why. Since I have all these charges against me why don’t you check the dates on those charges. While you are doing that be sure to check the date that my son was murdered. Tell me if it all adds up to you. If you really want I can give you the phone number to the girl that all these charges were against. The charges happened in Boulder County oh and by the way her aunt is chief deputy district attorney for Boulder County. I think it’s amazing how you can pull my arrest record and assume you know everything about me. The driving thing yeah I do speed but I don’t have any accidents so does that really mean I am an unsafe driver? Before you start badmouthing other people why don’t you look into my naval history and look at all the things I have done to help people out. I am a colorado state taxpayer even when I was in the navy, and I am a registered voter in Jefferson County.
From 2000 to 2004 I was in the Navy after february 28th 2004 i moved back to colorado I was never arrested til after Chandler died if you must know. I am going to hazard a guess and say that DCS doesn’t want a child in a vehicle doing 30 over the limit. Especially since 15 over is called RECKLESS ENDANGERMENT! However, they should have given you a nod and maybe some refresher classes in drivers’ education.
I do disagree with the title of the article. No, you did not have a hand in the abuse of Chandler.

By the way a DD 214 is the discharge paperwork for the entire military, it is not just for the Navy.

I know that the DD214 is for all the military I was just specifying that I was in the Navy. My tickets were not for 30 over most of them were 10 to 19 and I believe one was for 20 to 25. I definitely do not drive that way when kids are in the car and yes my girlfriend does have a kid so she would tell you that. I do understand that speeding is a bad thing, but I do do it. Oh and by the way my dd214 is an RE-R1 which is an honorable discharge just in case if someone thought it might be different

I am going to go ahead and assume that you didn’t know Christina was high all the time and that Chandler wasn’t being fed or cared for properly by the meth head. I am going to assume that for some reason you did not know that Chandler was removed from her care and that DHS was trying to place him. Because of course, I assume that you would have jumped into DHS offices and demanded your son, surely you would have.
I am going to assume that you were exercising liberal visitation with Chandler when he was living with Jon Phillips. I will assume that you just thought that his slight 34 lb frame was a mild problem that didn’t require a physician’s assessment. I am going to assume that when you were performing all of these responsibilities and duties and probably asking Chandler how his health and home were, that he, being the manipulative little 7 year old that he was (I know, I have one. He is just a master liar, NOT) that he put on an oscar-worthy performance to convince you that all was well in his life.
Hmpf.
Now I am going to do something I have never done before and will never do again. Defend somebody on this site.
I had the chance to get to know Josh Norris over the past year, and due to extenuating circumstance which I am not at liberty to disclose, I am going to back him up and say that the last half of your paragraph is completely off the mark.
Far be it from me to defend the reprehensible, but Norris is not one of that multitude. Having spoken with him, Sailor to Sailor, I am convinced that he truly had little idea of what was going on in the Phillips/Berry household. And having dug a little deeper than just talking (i.e. checking records) I am further convinced that he is just what he seems, a little rough around the edges, but not at all a “bad” person. He had nothing to do with what happened to Chandler.
The blame belongs squarely on Christina Grafner’s shoulders. She is a disgusting waste of flesh and should be shot on sight. Phillips and Berry should be doused in gasoline and chased with lit cigarettes. The victims in this situation are Chandler, and his father, Josh Norris.
That being said, I will repeat, I am not going to defend other folks on this site, EVER. Max, please don’t smack me… I went out on a limb and offered sympathy. I’m convinced beyond shadow of a doubt that Josh’s grief is real, his regret is real, and his love for his son isn’t just for show.
Thank you I appreciate the vote of confidence. I have always told people get to know me before you just assume things about me. I truly wish I would have known what my son was going through and I truly wish that I could live through that hell instead of him. Most days I still wonder why him and why not me, but I can’t change it. I still wish I had never left for the Navy and I still wish I could give every breath in my body to him, but I can’t I can only live every day living for him and doing every thing I can to make the changes so this does not ever happen to another child. I want to let everyone know chandlers old teacher Amy Domanski has started a thing called For the love of cupcakes you can order cupcakes and most of it goes to make cupcakes for other programs such as abused children and other things. They are looking for help and donations they are also dedicating a chapter in their cookbook to chandler. I am not asking anyone to help just to show their support on Facebook. Just search and type in For the love of cupcakes. Thank you all for your time.

Well, Christy, unfortunatly in the military, word does not always travel as fast as it should. And sometimes we are in places where word can not get to us. I am reasonably confident that such was the case in this situation.

Thanks, Christy. I know that word travels slow from experience. It took my old command four years to tell me that they had dropped the charges against my ex-fiancee for conspiracy to commit murder. So now I have to go through the process of getting an MPO (Military Protection Order) sworn against him.
I’ve been following this site for quite a while and but have just recently joined. I think it’s great and love finding people that are just as horrified by these crimes as I am. I am an American living abroad and see these things happen all around me in a country where there is no justice system in place and it kills me. I work with NGO’s mainly contracting out, but it seems no matter how many hours I put in, my voice never makes a vast difference. And then I found this site, and even though the punishment given in courts to these fucked up, evil criminals will never even come close to bringing back these innocent little babies, it’s so refreshing to me to see all of these good people on this site giving these angels a voice. I admire all of the people on here and have so much respect for Max who tells it like it is, and Jason who I personally think is a genius, and all the others who put so much time and effort into writing and maintaining this site.
The reason I was posting on this particular case is because a) this case really upsets me and b) I was looking at this Christina’s blogs on her myspace. I want to make sure I have my facts straight before I go off, so please bear with me on this.
Apparently, she is the mother who couldn’t take care of Chandler (my heart breaks for this poor baby) or Dominic (him too), correct? They were removed from her where they were placed with the motherfuckers who starved them and murdered Chandler, right? But to me, she’s unfit and has done enough damage, and according to her blog, she’s gotten custody of Dominic. Why?!? Because all of the sudden, she’s the perfect mother because she blogs nonstop about how perfect she is now and takes classes? I feel so incredibly bad for Dominic, I cannot even put into words how bad I feel. She blogs about her ups and downs, how she is so depressed and on Zoloft, or spending the night in jail and missing her call with Dominic (before she regained custody). So what makes her so fit to be his mother again? Hasn’t enough been done to these poor boys? Why can’t Dominic just have a real shot at life?
I have made this long enough, but no matter how hard I try, I will never understand why these things happen. Crimes against children get me in a way nothing else does. I get overwhelmed by how much these things happen and how little it seems I can do or how it can be stopped. I read in another case, down in the comments section where someone said these stories get redundant, but to me, they never will because for these children, they only had one chance at life and now it’s gone. It will never cease to shock me.
I apologize for writing so much and if I didn’t make things clear enough. My mind is all over the place with all of this right now.
