I have been coming to this site for quite some time now. Like most people here, I started out as a “lurker”. My relationship with this site has progressed into my submitting articles and has started to become more serious. Maybe it’s just me, but I feel that this relationship between myself and PYSIH has developed to the point where I need to come clean about something. This is something which has been bothering me for a long time now. This is something which I am not proud of. This is something which causes me great embarrassment, actually. But I need to be honest if I want this relationship to work. So here goes:
I watch reality television.
But I can explain. Really. My addiction began innocently enough. “Recreational” would be the right word for it. You know, limited to a weekend or two out of the month. I would make some jiffy pop and watch old re-runs of “Candid Camera”. At first, I tried to hide this, but when my parents found out that I was watching they didn’t seem to care. They also watched with me on several occasions. Which made it okay. 
When COPS first came out, my watching became more heavy, at least once a week. I started making excuses to myself as to why it was alright not hang out with friends because I all I wanted to do was watch. At that point in my life, my social domain had become negatively impacted by my watching habits. But I was still in denial. So when MTV’s the “Real World” Season One came out, I was in way over my head.
I mean, it was readily available and cheap, which just made me watch more.
It was not until “Being Bobby Brown” came out that I realized I had hit rock bottom. Years later, and after some serious commitment on my part, I am proud to say that I finally have these demons under control. To be completely honest, I do have occasional re-lapses, like when I slip up and tune into “Rock of Love” or “Hell’s Kitchen”. Those relapses are consequently followed by waves of tremendous guilt and shame. Hey, I am a work in progress. What can I say? I hope you don’t think less of me for this, but I wouldn’t blame you if you never wanted to see me again.
Devon Lynn Kile of Laguna Hills, California liked reality television, too. Let me correct myself, Devon wanted to BE reality television. Specifically, she aspired to make the cut as one of 
the “Real Housewives of Orange County.” If you break it down like this, Devon was a shoo-in for the series. After all:
-She had the money (23 million a year)
-She had the cars (Bentleys and Ferraris )
-She had the jewelry (Rolexes, Tiffany’s)
-She had several nice houses (Five of them)
-She had the clothes (Chanel, Versace, Gucci, Armani)
So what stopped this woman from realizing her ultimate dream of being featured on one of the hippest and hottest reality television series of our time?
How about the fact that she and her husband have been charged with the multiple felony counts which add up to be the largest workman’s compensation fraud case in California history? To the tune of over 38 million dollars, to be exact. Ho hum.
Devon Lynn Kile, 44 and her husband, Michael Petronella, a.k.a. Michael Constantine, 50, have been charged with 106 separate charges which relate to defrauding the state. They have been charged with an assortment of crimes which include, among others, grand theft, insurance fraud, filing false tax returns, tax evasion, misrepresenting facts to the State Compensation Insurance Fund, and making fraudulent statements.
These charges were a result of a three year investigation which was completed by the Orange County District Attorney’s Office and the Orange County Premium Fraud Task Force. The OCPFTF is a conglomeration of several investigating agencies which include, in this case, the Department of Insurance, the California Employment Development Department, the Franchise Tax Board, and the Contractor’s State License Board.
Kile’s husband worked as a roofing and general building contractor. Together, the pair owned three separate roofing businesses throughout the Southern California area. The husband and wife team are accused of obtaining Workman’s Compensation Insurance for their companies and fraudulently submitting more than forty-two claims on uninsured workers, solely for personal financial gain. The couple also neglected to report more than 29 million dollars in payroll expenditures in order to avoid paying higher insurance premiums. Authorities were alerted to suspicions of fraud in the year 2006 when an employee of one of their businesses fell from a roof and attempted to make a claim for workman’s compensation benefits. As protocol, he submitted his pay stubs, at which time, “red flags” were raised when the employer indicated on the pay stub was identified as “Western Cleanoff, Inc”, which had no record of being insured under the State Fund Workman’s Compensation.
So, basically, they would insure fictitious workers, so that they could collect money on false claims, while their real employees went without coverage. And in the event that a real employee became injured? They were dissuaded by the two from filing for workman’s compensation benefits.
State Fund Workman’s Compensation, or SFIC, is a quasi-governmental agency and was established by the California State Legislature to function as a “liaison” per se, between the injured employee, and the employer. Workman’s compensation insurance premiums are paid directly to the SCIF by California employers. When an employee becomes injured, they make their claims and receive their benefits directly from the SCIF.
On April 29th, 2009, authorities made their move. Kile’s dream of television stardom ended abruptly when she and her husband’s luxurious Laguna Beach home was raided that morning. Along with five other properties belonging to the pair, which included various storage units and business throughout Southern California. Over 51 thousand dollars in cash was seized, along with several luxury vehicles, lavish wardrobes comprised of thousands of dollars in designer clothing, a half a million dollars worth of jewelry, and, most importantly: Kile’s completed application for the “Real Housewives of Orange County”. Tragic. Orange County D.A. Tony Rackauckas summed it up perfectly.
“The ‘Real Citizens of Orange County’ are struggling to keep their houses, put food on the table, and pay for necessities. This husband and wife team was living a lavish lifestyle. How? By committing more than 38 million dollars in premium insurance fraud and not paying their taxes.”

Sure, I can admit that Kile and Petronella are not as hell-worthy as our regular run of the mill child molester, murderer, or drunk driver featured on this site. I know that. But, when you consider that these two people so brazenly and greedily stole from residents of this state-where so many people are barely hanging on by the skin of their teeth to keep what they have EARNED- you have to, at minimum, feel disgusted.
I mean, who the hell needs TWO Bentley’s? That is just plain greedy.
Oh well, maybe Kile can commission the House of Versace to design her some couture jumpsuits for her stay in jail. I have a feeling that she is going to be there long time. Especially when you consider that she and her husband are looking at upwards of 102 years in prison for their deceptive actions.

All they had to do was self insure with the state, it seems like they had enough money to do that. There total of 43 cases was only $243,000. They could have paid that with a smile, and had NO premiums!!!!

I think they both deserve hell, sure, but what disturbs me the most about this story is the fact that they apparently face more jail time than many of the trash you report on who kill people. What kind of message does this send? Kill someone, get 20 years, steal our money, get 100 years! That really disturbs me…of course, reality TV disturbs me too. Except Hells Kitchen. That one makes me giggle.

Then, when they go back to their cells, they can’t eat anything but extremely high fat chocolate fudge…and they have to eat all 10 lbs of it…this is to ensure that all that rock breaking doesn’t result in a nice physique…and also to promote dental decay. They also have to tend to any wounds they receive as a result of said rock breaking (which will hopefully lead to some ugly scars). They have to do this for ten years. They also have to give all their money to the state. This way, when they get out, there will be no personal trainers or plastic surgeons to get rid of all the damage done by the hard labor IN THE SUN and all the fudge. They will be poor and ugly (hopefully fat too) and they will have nothing. OK…I know this is ridiculously far fetched, but you said imaginative.

I love this article Poptart. Makes me chuckle. I guess because I grew up poor and have no real attachment to material possessions, it makes it difficult for me to understand the pure greed. Even if I could afford one, I would never want a Bentley. I drive cars until they blow up or the door falls off and hits me in the foot. Clothing, ok business suits I spare no expense because that is work related, but everything else, nope. I can’t fathom anyone paying more than $50 for a handbag or a pair of shoes. I just never understood the need. But then when I see something that is outside of my usual price range, I am automatically calculating how many hours of work it will take me to earn the money to pay for the object.
It’s just pure greed. Gluttony and excess. You can see it on their faces. She probably has about 500 thousand dollars of plastic surgery and she ended up looking like Michael Jackson. LOL.
The sins of gluttony and sloth are two sins that I never understood. My grandmother taught me a very valuable lesson when I was young. She told me “don’t get attached to THINGS. Things get broken, lost, and forgotten. In the end, your things can never bring you happiness.” I always took that to heart. Given a choice between a really expensive handbag or a bag of M&M’s, I would always choose the M&M’s.
My Grandmother taught me “always be satisfied with what you have”. That was such a valuable lesson, and she was so right. I pity people who spend their lives always looking for the next ‘thing’. If they get that “thing” they will immediately start lusting over something else, and never appreciate whatever it was they wanted anyway.
Coveting is like a drug. They always need a bigger fix. I say, stick with M&M’s.

I didn’t find this story so offensive just based on the fact that insurance companies rip people off everyday but yet we keep paying our premiums to them. I actually kind of like the fact that they got ripped off this time.
In a way Lewbelle, it is a form of poetic justice. But, someone has to pay for the fraud and that is usually the consumer. The consumer that can’t afford the hike in premiums. With all of the stories of abject greed and gluttony that face us every day now because of the financial crisis, it just makes me sick to think that people made money while their own workers, the ones that need the insurance, got screwed. It’s so interesting that everybody on this forum boasts about growing up all poor and humble, taking pride in this, and pouring scorn on the ostentatiously rich. It strangely coincides with the current American zeitgeist, which frowns on the rich.

“Everyone” on this forum? I grew up poor. I’m not proud of it. My mom did not have the work ethic that I’d prefer she had, that I will say. I am a mom who struggles, currently working on my B.S., and later a Masters, possibly a doctorate. I hate many people, poor and rich for many various reasons. Am I jealous of rich people? No, many of them got everything handed to them and/or got it easy. As for a lot of poor people? Well they either made mistakes or didn’t excel when they should have. I made mistakes, and/or choices that make my life a struggle to get to where I want. I am neither proud nor ashamed of it, I simply accept it and know that there is much of a journey left to go.
I could care less about the popularity of my attitude. So that being said, don’t stereotype all of us on the website by your own narrow minded perception.

As a side note to Tagnuzlsx, I did grow up lower middle class. I worked very hard to have what I have, and it’s more than I grew up with, but I pay my taxes, earn my paychecks, donate and volunteer my time and money.
If you’re out of work or just want to learn Computer software, I teach for free. I feel comfortable in my own skin, I don’t have to buy more things to fill the void in my soul or have more rooms than I could possibly eat, defecate or sleep in to hide from my demons. There are rich people who try to look rich, and then there are people like Warren Buffett, who is one of the richest people on the planet and live in a house half the size of this thieving couple.

Even then, I have been lucky to have a safety net. But the way which my family made their money was by working hard. Putting in 20 hour days sometimes. Let me clarify. I love nice cars. I love jewelry. I love expensive electronics. I love phat houses. I love expensive trips. If these two would have made their money legitimately, fine. But that was not the case. They stole from vulnerable, injured employees throughout the state of California. They stole from legitimate small business owners who are struggling to keep their companies afloat but have to pay higher premiums because these two peacocks didnt pay up. Why? Because they decided that they needed more designer clothing and “stuff”. They did not pay their taxes. They thought that they were too good for that and they decided that they were ABOVE the law. But they were not.

It’s not about greedy rich people. It’s about THIEVES! Being greedy and rich is not a crime in and of itself. It’s HOW they got rich that is the problem. They stole. It’s as simple as that. How they stole just makes the whole story that much more vulgar, but stealing is stealing whether you are successful at it or not.
To clarify, these two goofballs can get upwards of the 102 years, but could receive as little as five years according to the D.A.
And I agree, child molesters, rapists, and murderers should receive harsher penalties than they do.
I grew up poor…I’m very glad I’m no longer poor. I work hard for my money and enjoy my big screen t-v. I don’t think there’s any virtue in being and staying poor. As others have said, I don’t have a problem with people who work hard and get rich–I have a problem with people who steal, especially from the poor. As far as envying Devon goes, I don’t, for two reasons. First of all, she’s ugly. Second, she’s going to jail, and even if it’s only for 5 years, it will be five long and miserable years for her.

As much as I hated to go back on my word about not banning people Maz, Spanky was begging for it. Yeah, I wasn’t ashamed of being poor as a kid either because my mom was a single mom and worked her butt off during a time when this wasn’t so common. She taught us all how to be self-sufficient in an honest way. A few years before she died, she was able to buy her first car–she was really proud of that.

That must make the difference for me then. I like my water at room temperature, so I just leave all my earth killing plastic bottles in the pantry and pull them out as needed.
I don’t worry so much about the environmental impact, but I do worry about that plastic touching things we ingest. They are made of tons of toxic chemicals, and I am not truly confident that the toxins don’t leach out, at least to some degree.
So – I’ll drink the stuff on occasion, but I normally just use a hardcore sand/salt/charcoal filtration system.

Comon Ken, don’t come here now and try and grab the high road. You were the one who threatened a lawsuit against me, my writer, and this website. We based our story on what was released by the DA and what we could find out on our own through independent research, and in my opinion it doesn’t look good for the defendants. This is way beyond “a mistake on their income tax”.
You also state that, basically, everybody does it. Well, I doubt it. Most business owners obey the law, or they end up sitting in jail cells next to Devon and Mike. And even if everybody does do it – what kind of defense is that? I haven’t heard something that lame since my kids were young. And the only people to blame for all the workers who are out of work and haven’t been paid are the two people who chose to enrich themselves at those employee’s expenses.

Hey Ken, All the confiscated real estate etc. is that NOT recovered money, at some point that will be turned into cash by the STATE. It will be a substantial amount.
Another problem with this type of case is if one contractor does something like Petronella has, it lets them have a VERY unfair advantage at getting jobs.
Don’t know who my ex is- but the family was planning on spending the summer at “their beach house in Laguna”, and have spent many weekends there, as well (and I only know of two kids, so if there is a third, must be older and out of the house) and Niguel has an e not an a, just to keep your spelling count accurate….

BTW, if you are an illegal who happens to be developmentally disabled and eligible for regional center services, under the California Lanterman Act, we are required to PAY for day programming and program planning. There are TONS of illegals who are getting free day programming, in some cases, the programs can cost about 80-100.00 per day. Free occupational therapy. Free social worker and free case management, free transportation to and from program, social security payments, assistance with housing, free EVERYTHING. And generally the whole family lives off that disabled individual. And the services are from birth to death, so they dont stop. The state even pays for their burial.
One thing though-they are not allowed to work. They can have access to every other freaking expensive program, except employment services. Isnt that a joke???? The one program which REDUCES their need of social security dollars is the one which they cannot participate in.
In the meanwhile, we deny LEGAL citizens services who are “not retarded enough”, “not autistic enough”, etc because we have to pay for every fucking body else who is brought here because the family knows they have a golden ticket to the golden state. And there are hundreds of thousands of these illegal immigrant regional center cases in California. No one is willing to release how much it costs this state. If they did, people would FREAK.

There is a concrete difference between a business owner like that versus perpetrating posers like Mike and Devon who take advantage of the system, cheat on their taxes, and do not obide by the laws of this state. They are “fake rich people” in my eyes. Look John Berringer, Ken, Wildcat10, whoever you are, if you are accused of murder you’ll find yourself in a holding cell. If you’re accused of drunk driving you’ll probably find yourself in a holding cell. You’re being denied your freedom through due process of law. You have rights, you are absolutely correct, but those rights entitle you to an attorney to aid in your defense, but they do not entitle you to use ill-gotten gains to defend yourself. You as a person may be innocent until proven guilty, but your money and assets are not people and are not entitled to the same degree of protections because thanks to those incorporation documents you signed, they’re separate entities, or should be. One of the charges against them is that they illegally transferred funds from employment claims using their business. That’s not hard to prove, nor should it be hard to prove your innocence. One form at a time, does this person exist or not? Who filled out the paperwork? Who received the check?
Your knowledge of the law seems to extend somewhere less than the extent of your own skin. As an American citizen you’re responsible for understanding your rights. Educate yourself with the most basic of information and come back to this.

One thing that these people did (and there are a BUNCH of other things), was simple to prove. Basically it works like this:
Workers comp insurance is horribly expensive. It is especially expensive for roofers and other high risk/high injury jobs. In some cases the cost to the employer is as much as 300% of their payroll costs. So, as an example, they hire a roofer for $30,000 a year, and they have to fork out another $90,000 after that for workers comp. It’s part of the cost of doing business, and is in fact irrationally high, because of the fraud that is rampant in workers comp. (workers defrauding the system, and employers as well, like these two bastions of society). It is absolutely expensive, and impacts the cost of providing the service to the clients.
So, this scumball pair set up shell companies and showed that many of their roofers actually worked in these shell companies, even though they were really roofers. So, if a roofer had a legitimate injury, they went to the doctor and said they worked for the nice safe company, which had little workers comp cost.
THAT’S what the biggest, and easiest to prove fraud was. Imagine this – they had 100 workers. Lets say they said they actually had only 10, and that the other 90 worked for XYZ company. do the math (note: my figures are not exact, but they are certainly within reason) – 90 employees X $90,000 in unpaid WC fees = $8.1 million. Per year.
They were claiming $2.9 million in income under the roofing company, when in fact is was more like $29 million. So the payroll seemed reasonable.
There are more frauds – in fact, these sleazeballs probably defrauded every agency they possibly could, including the IRS. But this stuff is easily provable – there is a nice clean papertrail for the bulk of it.
So, this is why the authorities have every right to cut off the funds to the losers. There is no doubt that these are ill-gotten gains.
Oh, and before anyone starts whining about them having to pay that huge workers comp bill, remember this – they would have made a nice income if they had not cheated. That extra $8.1 million is certainly included in the estimates and the final costs for the customers. These scumballs, based on a $29 million gross income, even with those expenses would easily have pulled down $1 million a year – probably more like $3-4 million assuming they had any business ability at all. Instead, they had to cheat and steal to get more.
That’s what is so disgusting about all this. Had they run their business legitimately, they would have been contributing to society, and still able to live a really nice, comfortable lifestyle. Some would even say ‘rich”. But they weren’t satisfied with that – they had to be able to take baths in liquid gold, and wipe their asses with $100 bills.

And, yes – I say that without knowing them, because it is impossible that such greedy hogs could ever present themselves as anything else.
Yes mazi self insuring does take money, but it is so much cheaper than paying premiums, especially for a roofer with a high rate.
Their premiums where millions per year, self insuring would have been puting up something like 250k to a million or so depending on the loss record, in a state account, then the contractor pays his own claims though a administrator.
Their profits should have been unreal, where did they go?
And that, OMG, is yet another reason why these filthy hogs deserve hell. Because there WERE alternatives that would save them money (thus legally, morally and ethically increasing their profits) and they chose to not even take those steps.

In reference to muffburger comments. Newport Beach is a pretty small coastal community. Who ever he is he had to be someone who either was involved on the illegal side or police side with the life of Newport in the 80′s. I was there and in fact he is correct. Very few people knew all those facts other then some of us that were involved with the judicial system back then. It is actually much worse then even was stated in that story. Many of the companies and inflated home prices were fueled by drugs back then. I could tell you stories but why bother.
