Justin P. Shine
I’d like all of you to meet 26-year-old Justin Shine. Justin Shine likes children, and he especially enjoys playing silly games with the neighborhood kids. Wow, it sounds like Justin Shine is a really sweet guy, doesn’t it?
On June 29th, 2009, Justin Shine saw a six-year-old girl who lived in the same Hanover Woods apartment complex as his ex-girlfriend. Shine’s ex-girlfriend, Holly Hersh, kicked Shine out of the apartment two weeks prior to the attack after he became hooked on drugs and she found a hypodermic needle in the apartment they shared with her young son, but he broke in over the weekend.
She was riding her pink bicycle when Justin Shine shouted down from the apartment window and asked her if she’d like to see some cute little gerbils. The child knew Justin as the father of a little boy she often played with. Well we all know how much little kids love small furry creatures – the little girl jumped at the chance.
Justin Shine took the girl inside and showed her the family’s pet gerbils. Shine then asked the girl if she’d like to play a game. A very special game.
Justin Shine bound her hands with duct tape, gagged her and shackled her legs. He took a syringe filled with cocaine and injected the drug into her thigh. The little girl immediately felt woozy and lightheaded.
Fortunately for Justin Shine’s intended victim, and unlike so many of the so-called mothers you read about on PYSIH, this young girl’s mom noticed the girl was missing right away and immediately called the Hanover, Massachusetts police. The cops, along with other residents of the apartment complex began an intensive, door-to-door search of the area. Some started knocking on the doors of the complex.
Inside the apartment, Justin Shine heard the knocking, and as it began getting louder, realized he was in big, big trouble. He panicked, made a half-hearted attempt at slicing open his left wrist, cut the tape off the girls hands and shoved her out the back door.
She was soon spotted by rescuers, sans gag but still shackled at the ankles. When she was asked what had happened to her, she pointed to the apartment Justin Shine was in and said, “The man took me.”
Police kicked in the door Justin Shine’s hiding place and found him cowering in the bathroom. Officer David J. Zemotel described the arrest in his report. After he lunged at the cops, he was struck in the head with the gun of one of the officers:
“The suspect was momentarily stunned, as we attempted to place him into custody he began to fight and resist us again.” I continued to yell at the suspect to ‘Stop resisting’ as the fight took us into the master bedroom. Officer Smith, Officer Torino, and I were finally able to subdue the suspect on the floor and place him in handcuffs.”
Inside the apartment, police found the the 6-year-old girl’s pink bike and Barbie helmet, as well as condoms, hypodermic needles, ropes and chains and other sexual bondage items. Looks like Justin Shine was planing to play a very adult version of “Pirates Of The Caribbean” with the kid.
Justin P. Shine was charged with kidnapping, attempted rape, assault and battery, and resisting arrest. During a hearing to decide if Shine was an danger to society and should not be granted bail, Assistant Plymouth County District Attorney Sharon Donatelle called the girl’s abduction a “deliberate, premeditated act” and asked he remain in jail pending trial:
“He is dangerous because of the trickery and deception he used to lure this girl into his apartment. His choice of weapon in this case was a loaded syringe, a syringe that could have certainly disabled her.”
“Clearly this defendant had an evil attempt to disable her and cause harm to her.”
“His attempt to commit suicide shows that he is certainly mentally unbalanced.’’
Justin Shine’s attorney, William Leonard (The older gentleman pictured above), who has given us one more reason to hate lawyers, asked the court to hold his client on $5,000 cash bail, saying the incident was a “one-time aberration.”
“He’s gone through a lot in the last couple of days and I’m sure it’s knocked some sense into him. If he is released, I’m sure he will not be a threat to anybody.”
Well, maybe he can stay with you, counselor – what do you say?
Hingham District Court Judge Ronald F. Moynahan wasn’t buying that bill of goods. As he ordered Justin Shine held without bail until trial, he had this to say about the defendant:
“I think this man reaps terror on 6-year-old little girls. I have heard enough here to find that Mr. Shine being released would cause a terror to the Commonwealth. I have no hesitance holding him without bail.’’
Justin Shine could be sentenced up to 15 years in prison if convicted on the kidnapping charge alone, and prosecutors say there is probable cause to file additional charges of drugging the girl to kidnap her, drugging her to have sexual intercourse, assault and battery with a hypodermic needle and aggravated assault and battery with a dangerous weapon on a child. If he’s convicted of those charges too, he faces decades more of imprisonment.
It looks like we won’t have to worry about Justin Shine for a very, very long time.

Hmmm. I tend to disagree with you. I think people who plan on drugging, binding and raping little girls, but just don’t get the chance because a non-loser mom sounds the alarm, should go straight to hell. The fact that this POS actually accomplished the first two objectives only strenghtens my opinion.

Obviously sicko boy needs to go to hell and be devoured by hungry alligators but the attorney-How could anyone with any sort of soul argue that this guy should be on bail knowing what he was going to do to that girl??? I think the items found with him pretty much spell our his intent and that anyone could argue he would not be a danger is insane!!
Yeah I know, the attorney was just doing his job-whatever-I could not-for any amount of $- stand there and argue for this guys freedom knowing -it was luck the child isn’t dead and that he was interrupted before raping/torturing her and that odds are on bail he will likely try it again.
I would think it would be hard to prove a deliberate pre-meditated attack. It would take too much co-ordination to break into the apt. when his ex wasn’t home at the same time the girl would be out riding her bike. Unless both stuck to rigid time frames, that would require too much luck and planning for a junkie. The fact that his weapon of choice was his own needle of drugs makes me think it was more of an impulsive action too.
I think it is more likely that he broke into the apt for some other reason and then saw her out there and decided to act on it.

How would that evidence make it hard to prove a premediated attack…? Most people don’t randomly carry that shit around. The needle was used to render his victim unconscious, which would have probably been used had the attack been premeditated or not. The guy was obviously planning to attack SOMEONE that day.
I agree he was looking to go after someone that day. I was just speculating on the girl being his intended target all along.
And do we know he actually showed up with that stuff? We already know there were needles in the place as that was why he got kicked out. It was his ex-gf’s place so there were likely condoms. All that stuff could have been things that were already in the house that he got together after he lured the girl in.
Thinking it out, the scenario painted by the news doesn’t seem too likely. He broke into his ex’s apartment with all that stuff in tow? Crazy people aren’t always rational, especially those on drugs. It just doesn’t seem all that practical. What was he going to do with all that? I don’t think it is likely he originally intended strangers as targets. So that would make the gf his likely target. But then I’m sure there would have been easier ways to get close to her without breaking in.

That’s still premeditated. He lured his victim to the location and had tools prepared for the act. Don’t use what you “think” is the definition. Use the actual definition. What you see on TV has very little to do with the law.

The legal definition of “premeditated” is not the same as the common understanding.
First degree murder requires two parts: premeditation and malice aforethought. Premeditation means “with planning or deliberation”. There is no standard for the amount of time needed. It must be long enough after forming the intent to kill, for the killer to have been fully conscious of the intent and to have considered the killing. That can happen in a split second, depending on the person and the circumstances. The second part – malice aforethought means “to kill either deliberately and intentionally, or recklessly with extreme disregard for human life.” So, say a drunk driver can have malice aforethought without premeditation, which is why he can’t be charged with first degree murder under most circumstances.
So, while he may not have gone into the apartment planning to kidnap and rape that little girl, it is easily still premeditated. When he saw her and called her up the premeditation began. And if not then, certainly by the time he restrained her and drugged her, the premeditation was clear. Had he killed her, he would have been looking at capital murder without a doubt.
Regardless, there is no attempted rape or murder charge against him, though there should be. It doesn’t really matter though – they have plenty to lock him up for a long-ass time AND put him on the RSO list if he ever gets out. Trying him for attempted rape and/or murder would be a really hard sell to a judge or jury and could backfire. This way the conviction is almost signed, sealed and delivered, and the little victim may not even have to testify.
oooh my bad. He WAS charged with attempted rape. However, there is no required element of premeditation for rape. (At least not in my state.) But as I posted, even if there is one in his state, he clearly meets it.

I have to somewhat agree with Stapler here…… As far as court goes Stapler is right….. it’s hard to prove that everything was done to target this little girl….. maybe the indented victim was the girlfriend BUT the little girl was going to be something that this POS was going to do as to kill time……
So what happened to the girl IS INTENTIONAL, but again she may not have been the initial intended victim; the premeditated crime may have been intended for the girlfriend……

To me, the fact that he would do something like this so horrible just to kill time makes him even more dangerious because this child had no real part in the fact that he was kicked out – she was just someone who was in he wrong place at the wrong time and uninformed!

Example A: A criminal gets a gun, and breaks in the door of the first house he comes to, then rapes and kills two people inside. He chooses them at random, but he shows up with a gun to kill people.
Example B: A criminal fires a gun 10 times at the horizon, and one of those bullets on a ballistic trajectory kills a 4 year old in a playground he did not know was there.
Example C: A criminal sprays bullets from an automatic weapon at a playground where his ex-girlfriend works, killing 10 children and wounding seven others, but his ex-girlfriend wasn’t at work that day, and he didn’t know that before he started shooting.
Example D; A man robs a store at gunpoint and shoots the clerk as he reaches for the telephone.
A and C are premeditated murders. B and D are not premeditated murders, but there are premeditated criminal actions, none of which make the murders premeditated.
Here are the questions that can be asked of an expert witness (usually a specialist on the psychology of rape) that can confirm the state of the suspects mind.
1. Was the defendant, in your expert opinion, planning on raping the child, given the type of restraints and the nature of the chemical injection he gave her?
2. Was there a method to his actions? Did he prepare his victim?
3. Was the nature of the lure, intended to invite the victim into a secure location to perform a rape?
There are going to be objections, but an expert psychologist who has studied hundreds of rape cases is going to sit up there with all of his degrees and he’s going to put his stamp on this case as premeditated, and the defense is going to put another psychologist, who has interviewed the defendant up there, and try and prove a negative in the face of the above questions. And the defense is going to fail to sow doubt about the nature of his actions. It doesn’t matter in this case if his original target was the ex-girlfriend, because the action will show intention aforethought on this victim. From the lure, which is a classic one (“I have a puppy in my car, would you like to see him” is the iconic ancestor to the hamsters) and the victim is going to be shown in a short video or interviewed in front of the court, and the defense will be powerless to attack her testimony, because of her age and the nature of the jury’s (not misplaced) sympathies to a child. That child is going to say: “He got me to come up here with Hamsters, and then he tried to do a bad thing.”
And it will demolish him in front of a jury, so his defense attorney will start out with a bunch of motions to prevent a trial in which those events occur. He will attack the chain of custody on evidence, continue and continue, and then ask for some sort of plea deal that will minimize his client’s exposure. The DA will probably demand a plea of guilty to premeditated rape of a child, at the minimum, because it will mean after the 3 or 4 years he gets in jail, he’ll almost never get off the sex offender registry.
KIDS!!! How often do you have:
1. A syringe full of cocaine
2. A bunch of condoms
3. Ropes, chains, and other sexual items
4. Duct tape
5. An imaginary gerbil
And how often do you:
1. Take all those items and break into someone else’s house with them?

As a mother of a 6 year old, this story makes me sick. This is exactly why I do not let my daughter out of my sight. My husband thinks I am overprotective, but this story proves my point-you cannot rely on people to be good, upstanding members of society.
If something like this happened to my daughter, I would be in jail for what I would do to the person that tried to hurt/hurt my daughter. Trust.
Lori, I never let my daughter out of my sight either. And believe me, I heard from friends that I was being “overprotective”. It was mostly from people who I felt were way too lax with their kids, from plopping them into daycare to letting their 6 year olds run to the neighborhood playground alone. I ignored them, and I am glad to say that I have a very healthy, un-molested, happy teenager who is confident and capable of avoiding danger, yet I who trust would be able to handle it if it ever came her way.
The trick is in not letting the CHILD know that you are overprotective, lol. If you can balance it so the child is given age-appropriate information, and is never put into a dangerous situation, they won’t notice till they are about the age when you CAN start rewarding them with small steps of freedom. It’s a win-win situation.
Mazzi & LoriC…..I also was told by many people that I was overprotective of my daughter. As a victim of child sexual abuse and of rape, I am going to do everything in my power to make sure that these things do not happen to my daughter. I do not care what other people think or their opinions…..all I care about is that my daughter is safe and that she’s happy. My daughter is now 13 and I am so happy to see that she is getting to be a normal teenager that has grown up normally. She doesn’t have to deal with all the things that I did growing up and watching her grow up has helped me to heal in a lot of ways. I am very proud of my daughter. I agree with everything that you both said and don’t let others tell you that your overprotective. You are just being a good mother. Also, this is definitely not the same world that we grew up in as children, so you can’t be as laid back about things as parents used to be.
It isn’t just girls. I do not let my boys out of my sight when they are with me. My eldest wanted to go to a friends house when I found out the parents were not there, only a babysitter. Nope. I don’t know that babysitter. It boggles my mind the things my ex allows the boys to do when they are with him. Obviously I am not the most popular mother amongst the kid’s friends. I insist on things like knowing where my kids are and who is around them. I’m such a loser. The upside is that my kids have not been abused or molested yet.

You know, in the neighborhood I grew up in I was alone a lot.. I’d ride my bike to the store at the age of 8 .. I’d go to the park, and swing by myself.. no adults, no other kids (I was kind of a loner).. and there were a few times that I was approached by people who made me feel.. suspicious.. One guy called me over to his car.. I stopped about 8 to 10 feet away.. he told me “you’re a very pretty girl”.. I said “thanks”, and ran away.. I still remember that clear as day after all these years.. Another guy pulled over on the side of the road because he saw me wearing headphones and riding a bicycle.. Because I was a kid I stopped.. he wanted to tell me it was dangerous, and thats all he ended up doing, but he could just have easily snatched me up off my bike..
I dont know.. it’s a scary world sometimes.. and it pays to be watchful, and to teach your kids to be smart.. I think thats the key.. teaching your kids to be smart, not scared..

I really hope they keep this creep off the streets for as long as possible. Thankfully he wasn’t able to go through with his plans this time- but in general, people like this tend to try again and again- it’s only a matter of time till he follows through. What a fuckin creep.
I used to work as a legal assistant to some good attornies, but there were also some really bad ones also! Luckily, I was able to leave the profession and work from home as a seamstress and corsetmaker. This also allowed me to be home with my daughter. I have never missed working with scumbag attornies like William Leonard. Lawyers like this would sell out their own mothers souls to make a couple of bucks. They have no problem with letting a rapist, killer, or hell…..even a serial-killing rapist out on the street as long as their check clears. But these lawyers damn sure wouldn’t want the guys their defending to stay with them.
Justin Shine definitely needs to be kept locked up. It’s always good to read that the victim was found alive. Thankfully, this perv didn’t have a chance to rape the victim. I hope that she will be okay and not suffer any problems as a result of the drugs he injected her with since she was only six years old. As for Justin Shine, may you rot in hell and get the ass kicking you deserve by an inmate posse! Justin Shine is nothing but a punk ass bitch!

Omg, the Raynham auto mile! I went to high school in Taunton, and everyone always ate at the nasty Raynham Mandarin after sports events. In Taunton, the local hospital is Morton. During french class, we were learning the word “morte” (death) and to help us remember it, our teacher told us that if we went to “Mort”on hospital, we would die. Worked like a charm! As messed up as MA is though it’s still better than Rhode Island. Worst drivers in the world. Even Quincy is getting bad.
I’ve got it! The worst place in Boston! Jamiaca Plain!!! My truck got towed from in front of my friend’s house, because his room mate didn’t know it was mine! It cost me over $200 to get the damn thing back… $180 in cab fare and $135 for the towing charge and $80 for the parking ticket. (I guess I was in an assigned spot or something, but it sucked ass)

Here’s a question I can’t quite grasp ….. Why the hell are the penalties for ATTEMPTED rape/murder less than those for the actual offences?
Is it just me or are we somehow rewarding these arseholes for their own incompetence …? it’s NOT a lesser offence … he didn’t NOT rape this poor little girl because of any action on his part. It was only the presence of mind of her mother and the actions of the neighbours and police that stopped him from doing whatever the hell it was he intended to do.
I mean I get the fact that the damage that COULD have ocurred had he not been stopped didn’t ….. but not through any action of this POS.
I know some people are going to bleat about how we can’t punish people/lock people up for what they MIGHT do (a la our Photo-shop Principal) but bugger me …. why the hell do we have to let these people actually rape/molest/murder someone when we know full well they have that capability?
I can be such a facist when I get going – but there has to be some balance between the totalitarian state where the thought police can arrest you because of the fact you disagree with the government and the place we are at now where scumbags who we just know are likely to do some harm get to raom free beacuse they haven’t done anything YET. (I loves my caps … one day I will find out how to bold things)
Several philosophies on this.
1. There’s this line between action and deed. Actually killing someone or raping them is worse than a failed attempt, and we should punish people who actually accomplish something like this more. I get where you’re coming from, but we have to set a heuristic in law, where we say one is worse than the other and we define that through punishment.
2. We try to prevent attempts from being successful, by giving a last minute “out” to the criminal where he/she knows they will be punished, but that the punishment will be less if they somehow manage not to actually commit the crime.
3. We lower the bar for evidence in the attempt rather than in the act to speed the process of law. An attempt is harder to prove, but the case actually is often easier given the limited burden of proof.
I personally wouldn’t put this in the same boat as photo shop principle. The principle got caught with FAKE pictures…this guy practically got caught red handed. Other then that…the attempt is just that, an attempt and really, like Jason said should get a lesser sentence then actually commiting the crime. I attempted to murder you but failed so you are at my trial saying how I tried to kill you. OR I killed you and now there has to be a mountain of evidence to prove it.
You know Kenny, it’s not that I just know you that makes me respect your opinion on the photo-shop guy. I get that you don’t see it the same way, but you say things like “I personally wouldn’t put…” or some other limiting factor on it. When the law is listed, you don’t refute that the sky is blue, you call it a bad law.
