Carmen Huertas
You would think that after the Diane Schuler tragedy people would have learned to a. not fill a vehicle up with children and drive while intoxicated and b. not stand by and let someone else fill up a car with children and drive while intoxicated. That’s what you would think, anyway.
Sadly, I have to report to you another case of a jackass doing just what I described in (a.) while several people, for reasons I will never understand, acted on (b.). One man in particular behaved in an especially outrageous manner in this regard, enough so that he almost earned himself a nomination to the PYSIH All-Star team. More on that later.
It all started innocently enough. Brittany Gonzalez, the 11-year-old daughter of Carmen Huertas, was halfway through a two day sleepover with six of her best friends on Saturday, October 8th, 2009. At around 7 PM, Carmen piled all 7 girls – all between the ages of 11 and 14 – and her 18-month old son into her Mercury Sable station wagon and headed to the home of her former boyfriend, who was hosting a birthday party for his niece Corinna Gonzalez. The six passenger wagon was so overloaded that three of the girls had to sit in the cargo area, where there are 
no seatbelts. In fact, there aren’t any seats either.
Although Carmen Huertas had told friends she would spend only two hours at the party, she started drinking cognac, and as soon as the buzz started kicking in, decided to stay a bit longer. In fact, it was midnight when she started loading up the car again for the ride back to her home in the Bronx, NY. By then she was visibly intoxicated, enough so that several people noticed it.
Brittany Gonzalez’s father and Carmen Huertas’ ex, Ernesto Gonzalez, was one of the people that noticed Huertas’ condition:
“”I been with her 10 years. I know when she’s been drinking. She wasn’t like drunk to the point of incapacitated, but I knew that the amount of liquor she drank, it was gonna hit her, it was gonna hit her sooner or later. It was gonna hit her especially on an empty stomach.”
“I pleaded with her not to drive and she said her man told me he was going to take care of it. He told me he had it, he said, ‘I got it, don’t worry.’”
Eduardo Henriquez went and spoke to Carmen Huertas, telling her she was too drunk to drive, but she refused to give up her keys. He finally gave up, but not before Mr. Henriquez grabbed his 18-month-old son from the car. Sadly, he did nothing about the other 7 children, according to his own stepdaughter, Brittany Gonzalez.
“He didn’t do anything. He just took the baby and left.”
Actually, Mr. Henriquez prevented three other young boys from getting into Carmen Huertas’ car. One of the boys who was also headed back up to the Bronx with Carmen Huertas – Ernesto’s son with Huertas, Ernesto Gonzalez Jr. – saw it happen where she’d parked the car two blocks from the party.
“He just like took the baby out the car and we just left.”
I don’t know how many kids Carmen Huertas planned on putting into that 5 passenger Mercury Sable station wagon, but by my count, if fate hadn’t intervened there would have been 13 people, including 11 children, a baby, and Carmen herself. Eduardo Henriquez tried to make some sense of it all;
“There would’ve been three more kids in that car. He (Gonzalez) wasn’t (thinking). Nobody was. The fault is on everybody, you can’t just blame one person… I didn’t step up, you know, I’m sorry. I apologize to everybody from the bottom of my heart, you know?”
The reason everyone was so upset that they did try harder to stop Carmen Huertas from driving while drunk with a carload of children should be painfully obvious to everyone by now. Yes, she crashed her station wagon. Yes, children were killed and injured. But the terror that these children went through at the hands of Ms. Huertas is what really qualifies her for a choice seat on the express train to Hell.
Shortly after they left the party, Carmen, obviously stinging from everyone’s insistence that she was too drunk to drive, decided to take out her anger on the 7 girls in the car. She began speeding, reaching 70 miles per hour on surface streets. The girls begged her to slow down, and she replied by taunting them:
“If you think this is bad, wait until we get on the highway.”
“I don’t care about these other kids – only my (18-month-old) baby.”
“Who thinks something’s going to happen? Raise your hands. Who thinks we’re going to get into an accident?
Nice, huh? The worst one, In my opinion, was the crack about only caring about the baby – her daughter Brittany was sitting there right next to her and asked;
“What about me, Mom? I’m your daughter.”
Carmen Huertas reportedly did not answer. How could she? This really broke my heart, thinking about how sad Brittany must have felt when she heard it.
At 12:45 AM Sunday morning, the inevitable finally happened. Carmen Huertas was traveling on the West Side Highway in New York City at more than 80 miles per hour when, according to one of the passengers, 14-year-old Yismel Rosario:
“The car started swerving back and forth. I was like, ‘Oh, my God!’ Then it flipped over. Gisele, Kayla and Leandra flew out of the car. Their eyes were closed. I got out of the car and went to my sister. I held her and said, ‘If you can hear me, nod your head.’ I told her it would be OK, that help is on the way.”
Brittany Gonzalez also described the crash;
“All three girls in the back just flew out when the trunk popped open because it just popped open when we flipped once. My friend’s seatbelt snapped. Leandra Rosado just flew out and she was the one in the woods.”
Leandra Rosado was also the one who didn’t make it. The eleven-year-old was rushed to Saint Luke’s Hospital in Manhattan, where she passed away within minutes.
Lenny Rosado, the victim’s father, took the news of his daughter’s death very badly;
“It was very hard, very hard seeing your daughter there – the only child laying down.”
“My only daughter, my life and my joy, taken away. She used to like to be called Lilly.”
One of the other girls who was ejected from the car, thirteen-year-old Giselle Rosario, remains hospitalized in serious, but stable condition with two broken legs. A third young lady, 11-year-old Kayla Sanchez, suffered a long list of painful injuries, including a fractured cheek, nose and left arm and is still a patient at New York – Presbyterian/Weill Cornell hospital. Brittany Gonzalez broke her left wrist, and the other 3 girls were treated and released at local hospitals for a variety of injuries.
Carmen Huertas broke her arm and was in stable condition at Harlem Hospital Center. She blew a .13 BAC on a Breathalyzer at the scene, and is now facing vehicular manslaughter and 
DWI charges. She was formally indicted and arraigned on Wednesday, October 28th, at which time she entered a plea of not guilty. If convicted on both charges, Huertas faces up to 15 years in prison.
Carmen Huertas family has been remarkably subdued during this horrible tragedy, being supportive of Carmen without being obnoxious and showing much respect for the victims and their families. I don’t know why this surprises me – I guess I’m still a bit shell-shocked from the Diane Schuler story.
Carmen’s Lawyer, on the other hand, one Steven Rubin, is a totally different animal. Mr. Rubin suggested Wednesday that because some of the parents of a few of the victims attended the same party that Carmen got drunk at, they are somehow share in the blame for the crash that injured their kids. I’m not talking about Eduardo Henriquez or Ernesto Gonzalez either.
“There is so much blame to go around but it’s all coming down on Ms. Huertas’ head.”
“Some of the parents were at the party that Huertas attended in Chelsea before the wreck – and they did not stop her from driving off with their kids”
How many of them knew she was drinking, or how much she had to drink, Mr. Rubin? Who’s turn was it to watch Carmen Huertas that night, anyways? I’m not going to rehash this whole story again, but I think if Steven Rubin tries to use this defense on a real live jury, they may get up and kick his ass in open court.

After burying my best friend today, all I can think of to say is ” your a right piece of human garbage and deserve everything you get, you fucking toe rag”
up to 15 years in prison looks reasonable (a bit too low to my taste, but at least it’s something), but what’s the most likely sentence here?
Honestly DD, to a mother, with a spotless record? Probation is a real possibility here, but I think 3 – 5 years is more likely, because she killed a child.
Max is unfortunately right. Best estimate based upon existing case law is 4 years.
I have 2 kids; 3 and 6 years old. I cannot imagine losing them insuch a tragic manner like this one, especially when there were other sober people at the party that could have stopped Carmen from driving drunk. I will tell you this – there is no punishment good enough that any human being can conjure up that could avenge the death of my child. Carmen Huertas has to stand before God one day and account for herself. I find comfort in knowing that He has a punishment that is suitable for what she has done and far better than one we can give her on this earth.

I have hosted my fair share of parties in my time. ALWAS first thhing is you give up yer keys when you come in the door. You only get thme back when I feel you are not drunk. Should I feel you are too drunk to drive you have a few different choices to make. Take the bus. There’s a stop not 30 feet from my front door. Take a cab. I know the numbers to all the companies in my area. Walk. It’s that simple. I will not have the death of anyone on my head in which I could have prevented. No fucking way!
there has been a few people who bitched and complained. They were not invited back. I don’t care if I hurt someone’s feelings. I don’t care if someone tries to tell me they are OK to drive.
Why did anyone let this bitch drive let alone drive with a car full of kids? That is the question I want answered.

Again, the majority of the fault lies with stupid driver because she committed the act-BUT none of the adults could have said no one is getting in the car with her? None of the adults could have called the police when she drove off? No one could have done anything else? I don’t care what a fit she would have thrown, take her purse, hide the keys, call the police, take a pair of pliars and rip out the ignition wires-but it is incomprehensible how you would let a group of kids ride off with a nut you know is too damned drunk to drive.
That poor child. Thing is this wont be the 1st or the last case we hear on people drinking whilst under the influence. Very sad indeed.
The BITCH didn’t just act irresponsibly or make a stupid choice. That could somehow possibly be forgiven. You have to much to drink, you get behind the wheel, you crash and kill someone; I may actually have the tiniest little bit of sympathy for you. I can’t imagine having to live with that.
Carmen was so intent on venting her rage at being judged for being an irresponsible lush that she decided to take the girls on what I can only call a joy ride. It wasn’t only her intoxication that killed Leandra. It was her reckless driving, her speeding and her immaturity. She was acting like a spoiled kid who was pissed at being chastised by her parents and decided to take her anger out via a vehicular temper tantrum. With kids in the car.
Unforgivable all around. NOT GUILTY??????????? How the fuck can she? Does she have no conscience at all? In my opinion the woman is evil. Fuck her.
Part of the problem is – if someone wrestled the keys from her, any possible briusing would last way longer than her BAI, so if te bitch went to the police it would be a now sober bitch’s word against whomever. Maybe someday we will have the ability to check bruises to see if they hold the BAC while the rest of the blood is being filtered by the liver.
Given the way she acted in the car, it’s safe to assume that she’s a vengeful person when things are not going her way. So if the keys were taken away, I am sure she’d be there crying to the cops about being a victim of domestic violence.
If her father or X really stepped up, she’d not have her name here, but I am more than sure that her father or X would have had a sleep over with Bubba.
This bitch needs to die – - somehow she’s going to blame others for what happened and no lesson will be learned.
She made it clear that she only cared about her 18 month old so hopefully when she gets out, and we all know it won’t be long, she doesn’t have contact with her daughter.
I am not trying to place blame. It was ultimately stupid bitch Huerta who chose to be defiant under the influence while in the charge of young children but a simple call to the police from anyone at that party who was concerned could have possibly stopped this accident as well. If I have learned anything from being a frequent visitor on this site it is to be vigilant if you think anyone might be in danger. So if I were to run into a situation like this I wouldn’t hesitate to make that call. In this day and age where this is sadly becoming the norm it is that or move to the middle of nowhere to keep you kids safe!
Still – the police may not respond in time – gotta stop it before it happens – or call the police and keep her there – let the cops take the keys…

I too get tired of the family members telling about how wonderful a person the criminal was, how they helped the poor, gave blood, etc …like that justifies or excuses their actions. I worked in a correctional facility and remember several murders who didn’t lose a minute’s sleep over what they had done who religiously saved chips and fed them to the ground squirrels who ran amuck around the facility. Their good quality of being kind to animals certainly didn’t make up for their previous actions..I don’t care if she was a saint and made only a one time bad decision to drive drunk, that one action pretty much negates everything else she ever did for anyone.

I have to admit, I’m kinda disappointed Christian hasn’t returned with a clever rebuttal in defense of his auntie. But hopefully his parents caught him playing on the computer and gave him the spanking he should’ve gotten a long time ago with that foul mouth of his.
I stand by my ruling. Carmen is guilty as sin. And the fact she solicited the little petrified girls in her car about who thought they would get in an accident while driving so recklessly tells me she knew the possible outcome and STILL continued down her path of inevitable destruction. Drunk or not, this screams of premeditation. Either because she WAS drunk or because she WAS traveling at excessive speeds with a carload of innocent children.
This wasn’t a good person who made a “horrible mistake.” These were the actions of a self consumed fuck faced POS who put her own feelings of inadequacy before the safety of others.

What in the hell was this lady thinking??? An absolutely tragic situation that did NOT have to happen and could have easily been prevented. It broke my heart to read about the comment that her daughter Brittany said to her and that Carmen didn’t respond to her. My thoughts, prayers, and condolences go out to everyone that was affected by this tragedy.
I have a friend who works at St Lukes. Said that the father of the dead girl was so upset he had to be sedated to see his little girls body. They tried to not let him in but he insisted.

Some of those folks don’t even believe in Hell – some of us aren’t even religious. The voting is just a symbolic representation of our feelings about a particular perpetrator’s crimes. I can’t speak for everyone absolutely, but I can tell you that knowing many of the people here as I do, no one I know is so arrogant as to think we could ever influence God’s decisions in any way. Nor would we try.
Personally, I have very little use for organized religion – I sometimes refer to myself as a recovering Christian. I do, however, find that there is a lot of good advice to be found in the Bible, as long as you don’t leave your common sense at the door when you read it. For instance, isn’t there a passage where Jesus tells us, “Judge not, lest you be judged.”? We get that thrown in our faces all the time, when in actuality we have a much better understanding of those words than our critics ever could.
So lighten up Merci, OK. We’re here to have some fun, not to take over for the Almighty.

If Carment truly is your aunt then you should get away from these people that post negative and hateful things about her. I’m here to tell the truth, the real truth about what is going on. These people need to repent and focus on the 3 R’s. That is, restoration, reconciliation, and rehabilation. I choose to believe in Love, and I hope that one day they will know what Love is. Unfortunately, I’ve seen that instead embracing truth they will lash out at me instead. Not just here, but on other boards that deal with crime and punishment. People’s hatred has blinded them to the truth, and what is good and wholesome. They are demonized, but I won’t give up on them.

I’m going to tell you something my first sponsor told me when I was just beginning my 15 year journey to seven years of sobriety.
I was a real whiner back then. I complained about everything and everybody, especially about the way other people acted. I always had something to say about how this guy was living his new sober life or what mistakes so and so was making or how my boss was always picking on me unfairly. It seemed like everybody I knew was an asshole.
So anyways, on day, Dave (my sponsor’s name) took me aside and told me a little story. He said, “You know Steve, in the course of my day, I’ll sometimes run across a person who gets on my nerves, and I’ll think to myself, “what an asshole”. And you know, he may very well be an asshole.
“And sometimes it just isn’t my day, and later on I’ll run into another guy who really just busts my balls, and I’ll catch myself mumbling “what an asshole” to myself again. and possible, he could also be as asshole too and I’m just having a run of bad luck.”
Then he looked me in the eyes, and with a smile, he said to me, “But Steve, if I catch myself muttering the words, “what an asshole” to myself five or six times a day, every day, then maybe, just maybe, I need to take a look in the mirror to see who the asshole really is.
Dave was pretty damn smart, let me tell you. I find that it’s much better for me to try and make myself a better person that to think I’m even qualified to readjust another. Of course, that doesn’t stop me from trying to save fanatics like you from yourselves. LoL.

You have neither, you don’t even understand what an Apologetic is. You have to have a firm grasp of the bible before you can even begin to understand the argument you’re attempting. Additionally, you have to understand what you’re arguing against. You don’t know this site, you didn’t read the about PYSIH page from the top, so you fundamentally fail to properly address the topic. There is no light in you. Go find some before you continue to abuse Christ and act like you understand his word. You don’t. You haven’t bothered to even scrape the surface.
Jason why are you here? Are you witnessing to the people on this board? You said that I don’t know what this board was about because I haven’t read the “about” page (I actually have read it). But whether I read it or not I think it’s clear enough. The webmaster posts a story about someone who’s committed a heinous crime. Then he has a poll of whether that person deserves hell or not. Now while he has stated that a lot of the people here do not believe in hell, the poll is still there so that the voters can have a way of expressing their anger and their wishes that something truly horrible will happen to the people in the articles. They then post their comments which are full of hate, anger, and unmercifulness. This is evil. You can’t fight fire with fire, and two wrongs do not make a right. I believe that those who engage in this kind of behavior are without Christ. Now I’m not saying christians don’t sin. In fact a true christian may come in here one time, be angry at someone in the articles, and then vent that anger into the comments. However, I believe the Holy Spirit convicts christians of sin so chances are that may be the only time they do such a thing. And they would certainly be understanding and accepting of those who are here speaking out against such behavior.
I’m going to tell you a story. I normally don’t do this because this experience is personal and special to me and would not want it to get disrespected. But here goes. Back in May I was on a cross country road trip to see some friends who I Love very much. One in particular. She’s a christian and full of light. There was so much light in her that it made me open my eyes. I was so convicted. At that time I had simply “thought” I was christian but hadn’t really fully accepted Christ. But I was convicted. The entire way home I was convicted. All I wanted was to KNOW Him. I got home and I prayed and I poured my heart out to the Lord. I told Him that my sins were tormenting me, I wanted a new life. I truly accepted Him as my Savior. And then, He was there. No I couldn’t see Him, but I kenw He was there right next to me. I knew 100%. It was a sure knowledge rather than a feeling, but it did bring great emotion and joy. It was unconditional Love. And I just knew that He was there, it was as if He was saying “I’m here for you and will never forsake you.” I knew that I was saved and there’s nothing that can convince me otherwise.
You say there’s no light in me, but the gospel is the light, and that’s what I preach. I try to do so in gentleness, but sometimes it doesn’t seem that way to others because you MUST tell them that they are sinners and deserve hell. The gospel message is not complete without telling people that. “There is no one righteous, not even one.” Romans 3:10 “For all have sinned and have fallen short of the glory of God.” Romans 3:23 Both you and I, and everyone else in the world is guilty of sin. What are the wages of sin? “For the wages of sin is death, but the gift of God is eternal life in Jesus Christ our Lord.” Romans 6:23 The second death occurs in the lake of fire Revelation 20: 14-15. It says the gift of God is eternal life. A gift is a gift. It’s free and does not have to be earned. So we don’t go to Heaven by good works, instead we are guaranteed salvation by accepting Jesus who is the only way to Heaven. True believers will have Jesus in their hearts and will be lead away from sin, though they will sin at times due to the sin nature. Salvation is guaranteed for them however, because Christ paid for their sins past, present, and future. Again I try to teach this message in Love and gentlness. It is Love that drives me to teach it. But I can’t leave anything out. It has to be the full message. I can’t tell people that they need to come to Jesus without telling them why. I was labeled on this board as being self-righteous and hypocritical. Yet I have admitted and will always admit that I’m a sinner and deserving of hell. We are all in the same boat. I’m not preaching that i’m holier than thou since I do not believe that at all. But at the same time, I cannot and will not preach the new age universalist message of everything being fine and all roads leads to Heaven and everyone is going to Heaven. I do believe that God Loves everyone but I believe He is also just.
I too hate the heinous crimes that the people featured on this website commit. But I Love them and would like to see them repent and know Jesus. The bible tells us to Love our enemies, pray for them, and to forgive all people. It tells us that for a reason, and it’s a lot deeper than people think. I believe that if more and more people would practice unconditional Love and unconditional forgiveness, the value of Love is increased and we would see less and less of these heinous crimes. I’m not saying we should excuse the crimes, but if we met these people with Love and forgiveness and practiced that everywhere we go in our daily lives, then there is no doubt in my mind that these crimes would greatly decrease. I’m sure everyone who posts here would like to see them decrease, but I’m afraid the nature of this website is counterproductive to that cause. I just want people to know that we’re all in the same boat. We’re all sinners. But Jesus Christ is the Savior and with Him you will be guaranteed salvation in a place with no tears, no sadness. A place of happiness that surpasses all understanding. It’s a free gift. It just requires faith.

I knew your name sounded familiar Merci, but it was a total coincidence that I ran across one of your other posts under the Dylan Morse thread. I find this incredibly ironic, since my favorite folk definition of the word ‘coincidence’ is, “God’s way of remaining anonymous.” In that comment, you basically said many of the same things, but left out the religious angle. I found that a bit curious – just when did you become a self-appointed mouthpiece for the Almighty? It kind of makes me wonder whether you were disappointed by the reaction you got your first time around and added religion just to see if you could stir the pot a little bit more this time. Kudos to you – it seems to have worked.
Now claiming we are all minions of Satan because we think you are full of shit might sound like a great defense, but it really only works against simple minded folks who worry that they have no control over their own actions. Personally, it would be a hell of a lot simpler to blame the devil for every bad decision I’ve made in my life – I’d no longer be responsible for all the evil I visited on my loved ones during my addiction for one. Boy, wouldn’t that be a load off my conscience!
Your problem is that, like most religious fanatics, your can only take things literally. Other people come here to vent their anger at the terrible things these criminals do. They leave a lot of angry words on our message board – so what? They are just words, and the act of typing them on a place where other like-minded people will read them and not judge them for it must be very cleansing. I’ve done it on bad days, and I’ve felt better afterwards. The best part of all this is – no one got hurt. It’s just words on a computer screen. But once again, you fail to see what’s really going on, instead reading the words and judging the people for those words. Words that mean nothing outside of this website.

I went to a close friend’s birthday party this past weekend. The only reason I mention this is that it is completely relevant to the story.
One of our friends had a tad too much to drink. (Actually he had a shit load to drink, but he’s had a rough year.) He didn’t want to give up his keys either. Granted ,he wasn’t going to truck a cart load of kids anywhere that night, we were worried about other people on the road.
He got physically violent when we tried to take his keys.
Did we give up and just let him go home and wish him the best?
Nope, sorry. Human life is worth too much. We knocked his ass the fuck out, took his keys, and drove him home. We carried him to his bed, put a pitcher of water next to his bed, brought in a bucket and went home.
I hope she gets ass cancer.
