A judge yesterday tossed a one-year prison deal offered to a teenage girl accused of burning her ex-lover’s cat to death.
Judge Margaret Clancy, who had earlier approved the plea deal, said “nobody realized” at the time that reducing a violent felony charge to a nonviolent charge was illegal.
Prosecutors in July let Cheyenne Cherry, 17, plead guilty to attempted burglary and animal cruelty after investigators said her 14-year-old accomplice was the one who put the helpless Tiger Lily in the oven.
The judge yesterday said Cherry could plead guilty to a reduced charge and still be sentenced to a year in prison.
But Bronx prosecutors quickly pounced on the legal snafu to offer Cherry two years behind bars in exchange for a guilty plea.
That prompted Cherry’s lawyer, Danielle Follett, to accuse the prosecution of playing to animal-rights activists gathered in the courthouse.
“They are succumbing to public pressure,” Follett said.
Cherry is due back in court on Dec. 2.

Please continue to play to animal-rights activists. They appear to be the only voice for real justice in this case. Cheyenne Cherry roasted an innocent kitten to death in a slowly warming oven. How evil do you have to be to do that? How evil do you have to be before we kick you out of the world?

Fathers abandoned families in the recession eras that followed the war, and the children of abandonment tend to have a higher incidence of abandonment. Drugs, poverty, the long jobless recoveries of the 80’s and the demand for higher education can all be pointed to as devastating statistics. I think LBJ did a great job of establishing equal rights, but did a miserable job of weaving the details of foreign and domestic policy together to establish a tight weave of american values. He freed the share croppers and helped to cast off segregation and Jim Crowe, but provided almost nothing in the way of structure for these now liberated men and women to participate constructively in.

I know how you feel. I remember the year I looked at my taxes and saw if I’d made 6K less, I’d have paid 12K less in taxes. It was a brutal, brutal realization, that had a transformative process for me.
Why do you work for money? Do you still work for only money?
I work so the people I work for and with can have jobs, raise families and produce excellent products. When I have a crappy day, I could console myself by saying, “I can live a good life for less pay,” but that utterly defeats the purpose. The harder I work, the more responsibilities I have, the more I make at the next job/contract/responsibility. Combine that with an Ant versus the Grasshopper mentality, and you have the American work ethic. Does illegal immigration chap my hide? Yes! Do lazy people on the dole enrage me? Yes!

Do I think paying a larger tax burden makes me more a citizen of the United States than someone who makes less than me?

I live in a country that built the first modern computers, invented the internet for all intents and purposes, and more efficiently uses roughly half of the material resources of this planet. I grumble at inefficiencies, but I don’t blame the people who pay less in taxes. I blame the people who claim they can do the job and then fail miserably at it, whether they be Republican or Democrat.
As far as taxes go – I believe in a flat tax system, with deductions. that way there is a ceiling on how big a portion the government takes.
The problems I have with the progressive system is
“The more you make the more they take” that is a half truth which for promotional purposes is a lie – the reality is “the more you make the BIGGER PORTION they take”. Why should I work 20 minutes of every hour (33%) for he government when someone else only has to work 15 minutes of every hour (25%)?
With a flat tax I we’d all start out working 15 minutes of every hour and from there it would decrease. That is, IMO, Compassionate Capitalism.
An hour is 3600 seconds for both the guy sleeping in the subway station in any major city, the farmer on the tractor to Bill Gates and Donald Trump. Even God asks that each of us devote 6 minutes of every hour’s labor to Him – more expected of those who have more, but equal in the fact that 6 minutes is 360 seconds 1/10 of the same hour everyone has.
I actually support many of the “socialist” programs when they act as safety net, but I condemn their present forms which more resemble hammocks
We’re on a similar footing then. I like that the programs are there, but know they can be better. I agree on the flat tax, but I think it should be a progressive flat tax. If you earn money 9-5, putting in the hours of work, you should pay a smaller percentage than those who merely allow their money to work for them.
Fred I agree with you up to a point. But I do agree with you. When I was stationed at Ft. Hood I was going to CTC. I wasin a social studies class and we were discussing the role of government. Now remember I was deployed to Saudi and had been through a lot of training up to that point. We were debating and I had a great time as the kids were really getting worked up that government wasn’t big enough or didn’t do enough. the prof asked me what I expected from my government. “Protect our boarders and intrests overseas and deliver the mail on time.” I was called a nazi and all other kids of nasts things after that. You see I proved more than one point. I defended my opinion wiht facts. Yet the kids han no experience in life. Most were way over thier heads in debt and relied on mommy and daddy for spending money.
I argued that our present welfare system punishes those who try to better themselvs. I presented laws and examples of people who tried to save money for the future only to have to spend that money or lose the help they were getting. I was told by the kiddies that more money was needed so that people could maintain a high standard of living. When I explained how much money I was making an hour i the Army, living in a 50 squar foot room wiht 2 other men, sharing a fridge with those men, sharing a bathroom with 120 men, going to the field 2-3 weeks a month no matter what weather…. They looked me in the eye ad said that it was my own fault. they were right to a point. The money I was making after taxes at the time was $.25 per hour. Yep thats it. Now I’m not one to bitch and moan. ut these kiddies had never had to pay a phone bill or any bill for that matter. they had lived very sheltered lives. I was right and I still am right.
With our present “president” I can see my theories and opinions being proven right. I see our government exploding in size and our taxes along with it. I will continue to see less and less come of it.

Sadly, this is totally normal. In law school you learn about how everything works…as a lawyer, you learn about how much it doesn’t. I have seen judges and lawyers argue over whether certain defendants were eligible for certain deals or alternative programs…and no one knew the answer. I’ve seen deals get rejected because the lawyers didn’t realize that a certain person wasn’t eligible for a certain sentence…and the judges are often much worse. It’s a sad state of affairs up in state court!

I never really understood why race always comes into stories like this. I’m black/white biracial, educated, have friends of all races and backgrounds… I’ve lived in arguably the most liberal of cities (san francisco), i’ve lived in Atlanta, and I’ve lived in a couple of real small towns out in tennessee. Cheyenne Cherry has got to be one of the most heartless people I have ever read about.
I am a huge animal lover, I own two cats that were both abused as kittens. I even became a vegetarian because of the way animals are treated before they are slaughtered (although I am not one of those people who try to guilt other people into doing the same thing… it’s a personal choice).
The fear that poor little Tiger Lily was going through, the pain, the torture… it’s just plain evil. I don’t think there is another word in my vocabulary to describe it.
I, too, hope that the prosecution is caving in to the animal rights activists that have been protesting Ms. Cherry’s actions from the beginning. Animal cruelty isn’t taken as seriously as it could be in most cases, and 9 times out of 10 the people involved in harming animals are just warming up before they move on to harming their fellow man.
If I believed in Hell, I would believe she would fit the criteria to burn forever. Since I don’t, I will remember little Tiger Lily and help other animals in need if I am able… in her honor.

Hollywood — You ask “Why.” Here’s my opinion. Cats and kittens are beautiful, smart, endearing creatures. Most of them are loving and playful. The reserved ones show dignity and class. All are graceful. A cat atop a bookcase or lying in a sunny window is beautiful and evokes an image of the finer things in life.
In other words, cats are everything Cherry is not.
A creature like Cherry is going to regard anything like a cat with envy and hatred. And, lacking any kind of self discipline, it will act on those feelings, lashing out in the ugliest possible way. It probably enjoys committing acts that are not just violent but atrocities. It is anti life and should be stepped on, flattened.
