    DURING GUILTY PLEA, ACTRESS’S KILLER CHANGES STORY TO ROBBERY
    excerpts from an article by Anemona Hartocollis – The New York Times

    diegp pillcoHis original confession had the ring of truth: He was an illegal immigrant working on a renovation job in a Greenwich Village building when the imperious woman upstairs confronted him over construction noise.

    They argued. She scratched him. Panicked that she would call the police and that he would be deported, he punched her and pushed her to the floor. Mistakenly thinking he had killed her, he hanged her from the shower rod of her bathroom, in a staged suicide.

    But in a courtroom on Thursday, the construction worker, Diego Pillco, 20, told a very different story of how he killed the woman, Adrienne Shelly, a filmmaker, on Nov. 1, 2006. Ms. Shelly, who was 40 and the mother of a 3-year-old daughter, had just finished a film, “Waitress,” which opened to warm reviews after her death.

    Mr. Pillco, a short, boyish-looking man, speaking softly through a Spanish translator, told a judge in State Supreme Court in Manhattan that the argument had not been over noise, but over a robbery.

    He told the judge that Ms. Shelly had caught him stealing money from her purse after he had slipped into the apartment at 15 Abingdon Square that she used as an office.

    “When she fell to the floor I saw a sheet and decided to choke her, and that’s what happened,” Mr. Pillco said.

    The judge, Carol Berkman, prodded him: “And you tied a sheet around her neck and strung her up?”

    “Yes,” Mr. Pillco replied, “and I made it look as if she committed suicide on her own.”

    It sounded like a straightforward confession to murder, which could have brought Mr. Pillco a sentence of 25 years to life in prison, if he had been convicted by a jury.

    Instead, Mr. Pillco pleaded guilty to a lesser charge, first-degree manslaughter, and was promised a fixed sentence of 25 years in a deal negotiated with the Manhattan district attorney.

    adrienne_shelly0427It was a hard choice dictated by the existence of the first confession, according to an official in the district attorney’s office, who was not authorized to speak on the matter and spoke on the condition of anonymity.

    If he had gone to trial, the official said, Mr. Pillco probably would have stuck by his original story, which might have convinced a jury that Ms. Shelly’s death was merely reckless, even though the prosecution would have argued otherwise.

    In that case, if convicted he could have received a maximum sentence of 15 years. It appeared that the defense may have feared the opposite outcome, that Mr. Pillco would be convicted of murder and sentenced to life. Mr. Pillco’s lawyer, Thomas Klein, of the Legal Aid Society, declined to comment on his strategy.

    Ms. Shelly’s husband, Andy Ostroy, her stepdaughter and other relatives sat quietly in the courtroom during the hearing and declined to comment afterward.

    But their grim faces conveyed what the judge said out loud: that their assent had been given reluctantly. “Well, I’m not going to ask whether they’re happy with this,” Justice Berkman said, after the lead prosecutor, Peter Casolaro, assured her that the family had agreed to the plea.

    There was little about Mr. Pillco’s first confession that added up, according to prosecutors. He told detectives five days after the pillco2.jpgkilling that Ms. Shelly had confronted him in the apartment where he was working. The floor of that apartment was covered in gypsum dust, the prosecutor said, yet Ms. Shelly’s shoes, socks and the hems of her pants were clean.

    Rather, it was Mr. Pillco’s shoeprints, traced in construction dust on the toilet and the rim of the bathtub where Ms. Shelly’s husband found her hanging, that gave him away.

    Mr. Pillco, an illegal immigrant from Ecuador, had come to the United States 8 to 10 months before the murder, the official said.

    Ms. Shelly, who was born in Queens as Adrienne Levine, had just finished “Waitress,” a film about an unhappily married, pregnant waitress who finds joy in baking pies (and having an affair) that she wrote, directed and appeared in. The film was later shown at the Sundance Film Festival and then went into wider release.

    Ms. Shelly was best known for her roles in Hal Hartley’s dark comedies “The Unbelievable Truth” and “Trust.” She also appeared in more than two dozen Off Broadway plays and in television shows.

    In court on Thursday, after Justice Berkman asked, “What happened?” Mr. Pillco gave this account.

    He had been returning from lunch in the basement of the building when he saw Ms. Shelly in an elevator. “The lady was coming up in the elevator,” he said. “So when I saw her, I decided to rob her.”

    He waited on an upstairs landing and watched her go into her apartment. She left the door open, he said, and he slipped in, took her purse, and removed money; he did not say how much.

    After describing the fight for the phone and the struggle that ensued, he stopped his recitation. After a conversation with his lawyer, he added one last sentence. Mr. Pillco’s final words to the court were, “I just want to ask forgiveness to her family.”

    The judge replied, “I doubt that you will get that, sir.”

    On March 14th, 2008, Diego Pillco was sentenced to 25 years in prison. Andrew Ostroy, the husband of the late actress and filmmaker Adrienne Shelly, gave Pillco hell at his sentencing hearing, especially when he spoke about the damage done to the couple’s young daughter Sophie:

    “You sentenced that little girl to a lifetime of anguish and sadness and questions and feelings of what could’ve been.”

    “No sentence would be enough for you.”

    “(I am) haunted by the image of you walking this earth, a free man 23 ½ years from now, as a man with much of his life still left to live.” (The 16 months that Pillco has spent in jail waiting to go to trial is considered time served.)

    “I want you to suffer like she suffered, the same fear she felt when she realized she was about to die.”

    Yes sir, Mr. Ostroy, we couldn’t agree with you more. And I’m sure I couldn’t improve on his words no matter how talented I was or how hard I tried. All the pain and sadness a man can feel over the loss of the love of his life, wrapped up in less than 75 words.

          Bo, I agree that this system can be a fucking joke but I must say (even though it didn’t apply to this POS) that I am happy with the fact that life means life in the US. Life doesn’t mean 12 years if you are good in prison. I am trying to turn a new leaf and finding the good in everything and if this is it, well than this is it.
          I also agree with E in that this piece would be a criminal no matter where he came from.

      Aw comon guys – I’m not saying we should allow anyone who feels like it to cross over into this country, but to condemn a whole group of people for the actions of a very small minority is really messed up. Some of you all sound like clones of Bill O’Reilly for God’s sake. A good rule of thumb is if my thinking starts sounding like O’Reilly’s rants, it’s time to take step back and reconsider things.

      Most Immigrants, illegal or otherwise, are law abiding for one simple reason – they don’t want to get sent back to their old countries. Would you want to lose out on free 1st class health care, good pay (relatively), great government benefits, etc, etc…? Alot of these folks are sending home money to support their families, where American dollars are as good as gold.

      The bottom line is this: no matter where they come from, people are the same all over. The largest chunk of the population is honest and hard working. It’s always a small minority of people who engage in the vast majority of criminal activity.

      Sure we have scumbags like Diego here, and the Mexican Mafia, and MS13, but it’s no bigger a problem that Larry Harris, Michelle Kehoe, the Aryan Brotherhood, the Mafia, the Gangster Disciples or the Latin Kings. It’s all just the same old shit with a different name.

        Max, I have to disagree with you on this. Yes, I do have a problem with illegal aliens as a group, even tho I’ve met individuals I’ve liked (nod to Princess Taylor Swift), but not strictly because some of them are murderers, rapists, drunk drivers, child molesters. Of course citizens break the law as well. (One could say, why add to that problem, by letting in more people to feed and maintain in our jails, who shouldn’t be here in the first place).

        I have lived in the Harbor Area of California for 9 years and I work in health care. Many, many illegal aliens live in the area and more arrive every year. The quality of life is deteriorating, crime is rising, both violent and broken-window style crime. I believe there’s a connection. Of course there will always be problem causers and trouble makers but increasingly the perps here are people who don’t speak English or have a social security number.

        Max, please don’t say most illegal immigrants are law abiding! Don’t you see the contradiction there? If they’re in the country illegally, even though they may not jaywalk or hold up liquor stores, then they’re breaking the law.

        And, you state, “they don’t want to get sent back to their old countries.” That’s just it — they don’t get sent back! Even when they break the laws here! The news is full of stories about gang members who murder, are deported, and come back; or, who aren’t deported in the first place; or “law abiding” illegal immigrants who are dropped off near the border and come back. I don’t think deportation is a deterrant, because there’s hardly any!

        Re/the argument that they’re working to support their families, whatever their reason is, their behavior is still illegal. I don’t want someone breaking into my house, taking my money, and sending it off to South America or wherever, even if they do scrub my toilet for me.

        I don’t like helping support people who are breaking the law by being here, won’t learn the language, won’t assimilate (to be fair, America doesn’t put enough pressure on them to do so), show a low regard for education, and generally create a drain.

        All of you probably know exceptions to the above, and I do too. Again I’m speaking in generalities. I think focusing on the big picture is important.

        I’m aware that if fewer illegals are doing manual work, prices for some goods or services may rise. I’d be willing to pay that price.

        A few years ago the illegal aliens I think in Southern California only went on “strike” for a day. It was wonderful. I listen to talk radio all day and that day heard stories about less traffic, and in the ER at the facility where I work, English speaking people needing emergent medical care could actually see a doctor within a reasonable amount of time.

        Regarding Bill O’Reilly, I don’t watch him regularly, but, I have heard him on occasion expressing sympathetic views toward illegals, that they’re not hurting anyone, just supporting their families, etc. So I DON’T think I sound like his clone . . . just based on what I’ve heard of him.

        And yes, I think corporations who hire illegals should face pressure. They’re contributing to the problem.

        To That-guy — I assume your comment means my rhetoric is “Intolerant, vaguely racist.” I’m not sure, because your language was, well, vague. Are you saying I’m not allowed to criticize people who are breaking the law, simply because they’re not of my race?

          While my comment included you, it was not directed exclusively at you alone; it was meant as a purposely vague critic of the thinking that the majority of posters on this page seem to be operating under. I kept it vague specifically because i did not want to get into a heated discussion about something i don’t think has anything to do with the article in question, whilst still making my position on the matter clear.

          In short (short because entire books have been written on this subject), I find it intolerant because it is a core belief of mine that it is easier to judge than to understand, and vaguely racist because i don’t find any of the comments specifically racist, only vaguely. Does that make sense? Perhaps if i elaborate. It seems to me (and perhaps I am the one jumping to conclusions in regard to your comments) that whenever the subject of illegal immigration is brought up, it is almost always, to a high exclusionary factor, a person of northern european descent speaking about someone of other descent. Very little is ever spoken of illegal canadian immigration, illegal european immigration or any other illegal immigration from traditionally ‘white’ and ‘western’ countries. While i can understand the argument that the scale of the problem is not as great as from poorer, ‘browner’ countries, i don’t think this is the primary motivation for the objections heard. After all, since when have you heard of a “fence jumping illegal alien” from Norway? Or China? I realize this quote is not your own, but it serves to illustrate the thinking i find inherent in the majority of arguments on this subject. It seems to me that the only time you hear this complaint is when the person comes from a country that is not western in culture and white in skin tone. Illegal immigration is just that, illegal. But immigration (i speak exclusively of the U.S.A) has been happening since the new world was first colonized. People have been arriving here over and over again, through ellis island and not, through proper customs and not, registered and not, as far back as you wish to look. And through each period there has always been the ‘evil’, ‘corrupting’, and ‘sub-human’ race / culture that was destroying america. Each time, once things settled down, everyone forgot, and found a new immigrant to hate. The only unifying factor in all of these immigration protestations has been that the ‘evil race’ was always of a non-protestant / non-western culture, and or non-european race.

          Gah…that’s a wall of text right there i tell you what. If you want to continue the discussion, feel free, but i think i (barely) made my point and don’t wish to further test the limits of the posting program.

            You admit it’s because of the numbers. Okay. We agree so far.

            Yes: Both kinds of immigration have always happened and will continue indefinitely. (So will murder.)

            Yes: Racism often fuels the debate. On that subject, interesting info exists on illegal immigrant policies outside the U.S. I can’t find one comprehensive source but there are good articles in the AZ Daily Star and San Bernardino County Sun, among others. Note tho that the articles are a couple years old.

            I think, where you and I differ is, whether racism alone, or racism mostly, causes these complaints. I’ve re-read your post and what I “get” is, you believe that racism, often in disguise, is the culprit.

            You do admit that you’re just making assumptions. Fair enough. But for a sec think about what other reasons there could be, besides racism. Many, many, other factors come into it. To be brief I will just say “quality of life” and “safety.” I could elaborate, and give personal examples; again, there’s always Facebook. Or go to http://www.fairus.org, “Immigration Issues” page, and scroll down.

            One last thing. In the first sentence of your 2nd paragraph, you say, “I find ‘it’ intolerant.” By “it,” you mean, “rhetoric” (comments) about i. immigration? Again I must disagree. Complaints/comments and intolerance are not the same thing.

              Whew, that went better than i’d hoped. I too thank you for being civil. It is sooo nice to have a discussion without it devolving into name-calling and childish tantrums. In these polarizing times it is also very nice to find someone actually willing to discuss the issue, rather than using the situation as an excuse to fling their favored form of rhetoric around (left, right, center, up, down, purple, ect).

My point was I get nervous when I see blanket condemnations of any one group of people, no matter who they are. That’s not necessarily a racist thing, and I wasn’t calling anyone a racist in my comment. Most people shy away and avoid making comments about any person of color or sexual orientation, etc. because they don’t want to be called a racist or homophobic, etc. Even when they speak the truth.             But the problem with this argument Eddy is that it’s foundation is based on falsehoods and misconceptions. Immigrants, illegal and otherwise, are not responsible for the vast majority of crime in this country, or even in the border states. they are a small percentage of the population, for one thing. Part of the problem is the career criminals, the drug dealers and gangsters, get lumped in with all the Jose Schmo’s who are here to just make a living. Those scumbags are going to be here even if we built the Great Wall of China across our boarders.

            Don’t misunderstand me – we need better controls at the borders. But I’m hearing a lot of complaining about being inconvenienced mixed in with the concern about crime, and I’m thinking the real problem might be good old human nature – when people are frustrated and angry because their daily lives have become extra stressful all of a sudden, they look for somebody to blame. Along come the Anti-Immigration Lobby telling you it’s all those illegals. And the thing is, they sound reasonable – in some cases they’re even right.

            But the thing is, these are not illegals, or Chicanos, or Asians, or Ecuadorans – these are people. Fuck PC – I’ve never been PC a day in my life. What it is is simple human decency and common sense. You don’t wrap up an entire group of people in the same “blanket” because of the actions of a few individuals. I don’t know about anyone else, but the day we start making decisions in this country based on that formula is the day I start looking for a nice revolutionary organization to join. The whole idea is so un-American that it boggles the mind.

            BTW, it’s not important how the Mexican Government would treat Americans who did the same thing – I’m not Mexican and this isn’t Mexico. This is the United States of America, and we’re better than that.

What a tragedy that one of our citizens is murdered by a fence jumping illegal alien. Man this curls my hair. He will be 43 when he is released. Still able to live a long life.
      I know that that Mrs Shelly is turning over in her grave right now. We have failed her. Justice is not served here. Justice is a plate best served cold and with a cock in your a-hole. If that was my wife I would blatantly steal something so that I would get locked up in the same jail as that mf and I would serve my own justice on his ass.

      to me, the detail about him being an illegal immigrant was relevant to the case b/c i was wondering if it would change his sentencing, but personally did not connect it with the crime itself… would have been just as awful a crime had he been a patriotic American. i don’t think the victim’s family gives a rat’s ass about what passport he holds.

          I don’t like illegal immigration, but I don’t think it’s the big picture here. I think there’s a big picture, but I don’t think that him being an illegal immigrant actual caused this crime. Him being a criminal and a soulless bastard is what led to this crime.

          To specifics, I think legal immigration should be streamlined, codified as an amendment to our Constitution and fiercely defended as the most valuable title our Republic can bestow. Citizenship isn’t a joke. It isn’t a right or even a gift. It’s a series of responsibilities and titles far more important than the titles of Pope, King and Emperor. A legal immigrant should be on the path to citizenship or granted some visitor status with a logical end in sight. An illegal immigrant should be arrested, given a trial that includes as an outcome the possibility of a grant of visa or asylum as well as the possible sentence of prison time and/or deportation.

          To this case specifically, this man should be executed. Not because he’s an illegal immigrant, but because he murdered someone. His aggravating crimes were, he initially lied to the police, he attempted to conceal the crime, he robbed her and he broke into her home.

          I don’t care where he’s from, I just want justice.

      What rights will the 26 year old woman have who grew up with out her mother? Will she be able to sue him? Will her father be able to afford a college education for her raising her alone?

      I’m afraid that the reality of this case is even worse than you heard in the ‘official’ version. If you look at the bizzare story Pillco told as part of the plea-bargain, then it makes even less sense than the strange tale he trotted out in police custody. A plea-bargain is a compromise between the Prosecution and the Defence to reach some kind of an ‘acceptable’ result. It is not the truth.
      This was NOT a opportunistic robbery gone bad. At the sentencing, Shelly’s husband called Pillco a ‘stalker, rapist and cold-blooded killer’. A position backed up the the NYPD officers who investigated the case. Pillco – an obsessive fan of Spanish horror flicks – killed Shelly on the Day of the Dead, the most significant date in the occult callendar. After he staged Shelly’s suicide, he erased almost every trace of forensic evidence and then calmly went back downstairs to finish his shift The first forensic investigation found nothing. It was the second – insisted on by Shelly’s husband – that found the shoeprint that led to Pillco’s arrest.
      This was the cold-blooded, predmeditated murder of a celebrity by a stalker. The most ironic thing about it is, Pillco did not actually know that the person he was stalking WAS a celebrity. He stalked her as a woman and not as an award-winning actress and film-maker. She could have any woman in the city!

      As our economy gets worse…by each day, month and year..we will see more of this..because few people HAVE EVERTHING and everyone else works their fuckin asses off..with no hope in the future. Every nasty revolt in history is due to oppression and suppression. We all can judge hime and say WE would never do that..but let me tell you something..you take any wealthy upper middle class folk..they would NOT be able to deal with poverty.

      This is why you had people jumping from buildings in downtown Manhattan the days following the Great Crash of 1929. Wealthy investors had no intention and could not mentally handle living in poverty. Plus there are a few jumpers these days also..you can read about in the news. (i.e. the guy who went to see a rental unit in a hi rise..and jumped off balcony while the agent stepped away) due to no ability to earn income anymore and increasing debt to sustain some kind of living ability.

      It’s so easy for us to sit here..in our cozy, stable jobs or steady invested incomes and not be put in a poverty situation. Trust me…most of us..taking our money and ability to be “given” income away….we could not handle ONE WORK shift under heavy labor such as package lifting, transit work, construction work, etc.

      I know people living in gated communities that would die first if they lost it all.

The year this happened was a difficult year for me stress wise and I was travelling a lot. But I am still surprised because living on the WEST coast where illegal immigration and crimes are a hot topic, this story seemed to have slipped between the cracks……….
