    ROOFING CONTRACTOR CONVICTED IN CALIFORNIA’S LARGEST PREMIUM INSURANCE FRAUD SCAM

    Released by The Orange County District Attorney’s Office

    02/11/2010 — A roofing contractor was convicted today of committing premium insurance fraud with his wife, in one of the largest known Workers’ Compensation Insurance fraud case in California’s history. Michael Vincent Petronella, also known as Michael Constantine, 51, was found guilty by a jury of 33 felony counts of insurance fraud and the sentencing enhancement for aggravated white collar crime over $500,000 was found true. The defendant now faces a sentence ranging from probation up to 48 years and eight months in state prison at his sentencing on April 23, 2010, at 9:00 a.m. in Department C-42, Central Justice Center, Santa Ana. Restitution will be determined at a later date.

    Petronella’s wife Devon Lynn Kile, 44, both of Laguna Hills, is also charged in this case. Kile is in-custody on $250,000 bail and is scheduled for a pre-trial mental health competency hearing Feb. 18, 2010, at 9:00 a.m. in Department C-58, Central Justice Center, Santa Ana.

    “This case is an outrageous example of a person who lavishly spent illegal profits on luxury goods by cheating the Workers’ Compensation Insurance system and legitimate businesses that play by the rules,” said Orange County District Attorney Tony Rackauckas. “Cheaters who defraud the system will be trading in their Pradas for prison garb.”

    “We simply will not tolerate anybody scamming the system and driving up the costs for legitimate businesses,” said Insurance Commissioner Steve Poizner. “I’m pleased that a jury convicted these swindlers on 33 counts of insurance fraud, helping execute justice and remind others committing workers’ compensation fraud that we will find you and you will be prosecuted.”

    WHAT IS PREMIUM INSURANCE FRAUD?

    California law requires that all employers maintain workers’ compensation insurance for their employees. Payroll records showing the number of employees and their income must be submitted to both the workers’ compensation insurance company and EDD, who oversee the collection of payroll taxes. Workers’ Compensation Insurance rates are determined by a formula, which takes into consideration the number and type of employees and the company’s history of injury claims.

    Premium insurance fraud is committed when an employer intentionally misrepresents to the State or insurance company the number of employees, the type of work performed, the amount of payroll, and the loss history. These illegal misrepresentations allow deceitful employers to calculate and purchase workers’ compensation insurance at a significantly lower premium rate, or to avoid purchasing the insurance at all. This practice places their competitors at a disadvantage because it forces them to compete against a company with fraudulently lower operating costs.

    Premium fraud drives up the cost of insurance premiums for legitimate businesses that pay higher rates for their employees’ workers’ compensation insurance coverage. These legitimate businesses are less competitive against crooked companies who are able to under-bid their competitors due to lower business costs resulting from insurance fraud. This also endangers injured employees who may be denied workers’ compensation benefits intended to meet their physical, psychological, and financial needs for a work-related injury.

    CIRCUMSTANCES OF PREMIUM INSURANCE FRAUD CASE

    Petronella is a roofing and general building contractor. At the time of their arrest, Petronella and Kile owned three businesses including Petronella Corporation, Western Cleanoff, Inc., and The Reroofing Specialists, Inc. (also known as Petronella Roofing). The businesses were located in Costa Mesa and Cathedral City, Riverside County, and had clients primarily in Southern California which included the Ocean Institute in Dana Point, the Pacific Amphitheater in Costa Mesa, and other commercial properties.

    In March 2006, an employee of Petronella fell from a roof and sustained injuries. A payroll stub was submitted to the State Compensation Insurance Fund (SCIF), listing his employer as Western Cleanoff, Inc., which SCIF did not insure. SCIF is a quasi-governmental non-profit insurance company established by the California State Legislature. SCIF reported the suspected fraudulent claim to the Orange County District Attorney’s Office (OCDA) and Department of Insurance (DOI).

    Following a 2-year investigation by the OCDA, with assistance from several agencies (listed below), Petronella and Kile were arrested April 29, 2009, at their Laguna Hills home. A search of six locations including two residences, two businesses, a storage unit and a Certified Public Accountant’s office turned up more than $500,000 in jewelry, $51,000 cash, and an application from Kile to be featured on the Bravo series Real Housewives of Orange County. A Receiver was appointed by the Court to oversee the seized property and determine which items and properties should be held as collateral or sold at auction as payment for back due taxes.

    THE PEOPLE ARGUED DURING TRIAL:

    Beginning in 2000, Petronella and Kile obtained Workers’ Compensation Insurance for their three companies through SCIF. Between 2000 and 2008, Petronella fraudulently submitted 42 claims for uninsured injured workers and underreported $29 million in payroll to SCIF in order to avoid paying his Workers’ Compensation Insurance premiums. The couple engaged in a scheme that resulted in SCIF incurring more than $253,000 in uncovered injured worker claims and insurance premium losses in the millions. Petronella and Kile reported $3 million in payroll to SCIF, while having an actual payroll of $32 million, ten times more than reported.

    Beginning in 2000, SCIF performed annual audits of Petronella and Kile’s companies, during which they provided false employee and payroll records. Between 2000 and 2008, Petronella and Kile fraudulently reported a $2.9 million payroll to SCIF for The Reroofing Specialists, Inc., while reporting $16.6 million in payroll to EDD for the same company during the same time period. Beginning in 2003, Petronella and Kile fraudulently reported no payroll to SCIF for Western Cleanoff, Inc., while reporting in excess of $13.9 million in payroll to EDD for the same company between 2000 and 2008. Between 2007 and 2008, they paid unreported payroll in excess of $200,000 in cash to day laborers.

    In order to avoid paying Workers’ Compensation Insurance for all of his employees, Petronella and Kile underreported the number of workers employed at each business, including claiming none for Western

    The couple, who lived in Laguna Hills at the time of their arrest, owned five properties in California and Texas and multiple luxury vehicles including a Bentley, two Ferraris, and a Range Rover. Between 2005 and 2007, Petronella and Kile spent more than $2.1 million on their American Express credit card for personal items. They spent thousands of dollars on jewelry, shoes, clothes, and other personal items at stores including Balenciaga, Bloomingdale’s, Chanel, Christian Louboutin, Gucci, Kitson, Neiman-Marcus, Nordstrom, Yves Saint Laurent, and others.

    This case was investigated by the OCDA and the Orange County Premium Fraud Task Force, a collaboration of investigators from OCDA, DOI, EDD, Franchise Tax Board, and Contractors State License Board.

    Deputy District Attorney Shaddi Kamiabipour of the Workers’ Compensation Insurance Fraud Unit is prosecuting this case.

    First off, I’d like to dedicate this update to all the family and friends of Michael Petronella and Devon Kile. You folks posted a stream of comments protesting Mr. Petronella’s Arrest and prosecution, and haranguing this website and it’s regulars for looking at the evidence against him and agreeing that Michael and Devon looked pretty guilty to us. I have just one question for you.

    Where are you now?

    I especially want to acknowledge Jordan Petronella, Wildcat10 and Michael V Constantine III; You three were my favorites, especially Jordan. For those of you who don’t remember, he had two sockpuppets he used to post under too (a sockpuppet is a just a phony nickname a person will post under to give the appearance that there are other people that share his opinion.) Jordan actually used one of his sockpuppets to threaten me. That was a first for me and PYSIH – I’d never been threatened by a person that did not exist before.

    Where are you now?

    My point is this. PYSIH has a policy of apologizing if we get a story wrong. If I write a story, and come to the conclusion that Person A is guilty of the crime he or she is accused of, and one day definitive proof comes out that Person A is completely innocent, not only will I remove the story, I will post an apology admitting I was wrong for all to see.

    So why don’t people like Jordan Petronella and Michael V Constantine III have to live by same set of rules. Wildcat10 insulted just about everyone who responded to him, and even though I thoroughly enjoyed slapping him around in the virtual world, it would be nice to see him apologize to some of the ladies here.

    Foolish, yes, I know, to think an idiot is capable of such sophisticated thinking. But you never know….

          Bri, as far as I’m concerned, they deserve what they got and more. They screwed over hardworking men and women, just to avoid paying out Workers’ Comp. According to the cold, hard evidence, they could have more than afforded it, but they chose not to avail their employees of everything they were entitled to. You think my previous comment was nasty?           My heart honestly bleeds for you, not because you’re right, but because it will hit so much harder later on. Your parents do love you, and this crime didn’t change that, it’s just that they didn’t consider the consequences of all of their actions. If they could read what you wrote here, I think they’d be proud of you and angry at themselves. There’s probably a lot of pain and guilt behind their eyes right now, and perhaps they’ll do better things later on. Right now though, the reason this all came up, is that in the construction industry and roofing specifically, there’s this insurance you have to have on all of your workers. Insurance helps when accidents happen, and when you’re working on a roof in 100 degree temperatures, accidents are pretty common. Some of your parents workers got hurt. When they tried to use the insurance to pay their medical bills and pay their light bill and rent, the insurance wasn’t there for them. The promises your parents made were lies, and for whatever reason, they didn’t pay those bills when they were supposed to. So now, there are a lot of people with broken arms and backs who have to live far more poorly, depending on welfare and disability when a doctor could have made them a little better earlier on. They have to live the rest of their lives in pain because your mom and dad made decisions that they thought were okay and/or wouldn’t hurt them. The Government of California has to make this right. The only way they can make this partially right is to put your parents in jail for a while, and to seize your parents assets and sell them so the victims can be paid. If your parents made some of the right choices along the way, you will probably not suffer too much, but things will change and all of those changes may not be for the better.

          I know you’re 12 and you’re reading this and thinking I’m treating you like a baby, but it’s not my intention. I’m trying to explain to you what you need to know to understand how to deal with the future that awaits you. The future is uncertain, but sharpen your mind, your wits and your skills. When someone makes a promise to you, make sure they keep it. If they lie to you, make sure they know how badly those lies can hurt. You can be better than this. You can choose to not make the same mistakes your parents made and the end result can be your parents being even more proud of you than they already are. Be strong, be kind, be brave, be good, be smart, behave.

            Jason, thank you for your kind words to Bri, I cannot believe the language and words people say to a 12 year old. I worked for the family for 7 years and had the opportunity to meet and spend time with Bri and her brother, they are both good kids. What their parents did was wrong, but they are paying the price. Their children are just protecting them. I would have Bri on my side any day it least she has chutzpah. Obviously you would leave your parents in the dust .Oh and that you can be proud of. You want to pick on someone bring it on. You should be ashamed off your selves.

              I don’t feel any shame for telling Bri how it is, and you’re naive to assume so. She made public comments, she will get all manner of public responses and that’s how it is everywhere. The world isn’t packaged for your safety or for hers.

              It seems to me that the children of this planet could do with a little more honesty and reality than most parents are willing to give them, which means that they are released into their adult lives ill-equipped to handl reality. Shame on YOU for wanting to coddle someone to the point that they cannot honestly deal with the real world. Shame on YOU for setting kids up for a fall, for failing to arm them with warnings, and failing to specifically point out what the real-world dangers are, and that you must deal with them instead of hiding your damn fool head in the sand.

I don’t think any of the serious posters ever told her to turn her back on her parents – I know that I didn’t, and neither did Becky or Jason – in fact, most of us encouraged her to love them and support them.

              We refused to lie to her. That’s just not how things are down here – and when is it ever a bad thing to tell the truth anyways?       It’s so funny that these two doorknobs were quickly and successfully prosecuted (and rightfully so) for a mere few million dollars, but executives at companies like AIG suck billions from US taxpayers as bailouts, then turn around and pay themselves multi-million dollar bonuses, and no one bats an eye prosecution-wise. Perhaps if these two had bilked California for billions instead of a mere few million, they would have gotten away with it. I guess they should have thought bigger and greedier :)

I’m sick of crooks robbing people and frauding agencies to make millions while the rest of us have to work our asses off and do things the honest way. This article didn’t even mention the fact that one of Petronella’s employees was LEGITIMATELY hurt and when he tried to get worker’s comp. he couldn’t because the company he worked for wasn’t insured because Petronella was too busy scamming the system.

          One thing you have to learn is that, just because you love them and they’re your parents doesn’t mean the rest of the world owes them any respect unless they earn and keep it, like everyone else. It’s a painful lesson. Your parents are human, with all the frailties and faults of the species.

          You also need to learn to be strong, and to truly think for yourself. You’re at an age where you can do this. You obviously have a heart and a soul, and you’re hurting very deeply now. Don’t feed that pain by reading this website. YOU didn’t do anything wrong – YOU don’t deserve to suffer for it.

          Please, I’m begging you now, don’t come back to this website. Stop posting, stop hurting yourself, and stop trying to fight a losing battle on a blog that, in the scope of things, really shouldn’t matter to you.

      My interest in this? I competed with him and tried to tell people he was crooked, but the cheap prices lured them in. And he lured in some big fish–gated communities looking for a deal. No scam was too small and he held the homeowners hostage with his “roof warranty.” That warranty is worthless now.

        I don’t understand your first sentence. They committed crimes. The truth got out, and was repeated here. Jesus is on the right hand side of God if you’re Christian, a mere prophet if you are Muslim and an uppity Carpenter if you’re Jewish. He’s not on the side of the temporal, else there’d be no wrongfully executed prisoners, no need for a evolution debate, and Sarah Palin would have been struck by a lightning bolt a long time ago. Jesus also doesn’t drink Gatorade or make sports athlete great. Try reading the Bible and at least understanding Christ’s side before you choose to treat him like he’s a member of your clique.

        If you are in fact her daughter, and not the same spammer who claimed to be his son/nephew a few months back, then listen carefully, you’re not going to be able to make a case for your parents here. This isn’t a court room, isn’t innocent until proven guilty and your parents have a lot of evidence against them. if you can present a logical, reasonably grammatically correct defense that provides new information, the first step would be to use that in your parent’s legal defense. If that succeeded, then Max and/or admin, would post an update with a reasonable retraction. That’s the easiest and most efficient way to deal with the comments on this site. If you can’t do that, you’re in for a lot of heart ache if you focus on this site instead of first learning to accept what your parents did.

        I hope you live a happier and more fulfilling life than these comments suggest you plan on living. Sharpen your mind, your body and your wit, because the next few years are going to be even tougher than the last few. Eventually you’ll accept what had to be and learn to see your father and mother for what they are. There are other people who have had to deal with this sort of thing. Look up on wikipedia for Jim and Tammy Faye Baker for example. They were admittedly much worse than your parents, but the scandal has some interesting parallels. Look for them and try to take the time to figure out where this is all going.

          I could not have said it better myself. Bri Constantine, the nature of truth is that it cannot be changed, only accepted. When the truth is flattering, acceptance comes easy, but when it hurts the first, instinctive reaction is to deny it. Jason here makes some seriously good points, and though I’ve ribbed you in my comments above, here I speak in earnest: you could do a lot worse than follow his advice.

          Defending your parents because they’re your parents is fully understandable, and people calling them douchebags and whatnot on the internet does not deny you the right to love them. But none of this changes the simple truth that what your parents did was wrong. And it does not give you the right to call anyone who disagrees with you an asshole.

          Until you come to terms with what has happened, you’ll be stuck in that painful place you are now. And once you have accepted the truth, no matter how disappointed and cheated you feel, I hope you will continue to love them. Because that’s another thing that will never change. They will always be your parents, faults and all.

            As a side note Bri, I’m fairly certain Jesus isn’t on anyone local’s team. He’ll pick us up after the game and make us feel better, but as it stands, with a cervical collar around my neck, I can assure you he doesn’t have to make this easy on even the people who aren’t at fault. If you think your folks have it bad, read about Diane Schuler some time and imagine your last name is Bastardi, or that you lost one of your kids to Diane’s garbage. No matter how many years your parents finally get on this, the sentence they got is a lot longer, and I think they were pretty sure Jesus was on their team as well.

        When people like your parents commit crimes like this, they make it harder for people that have actually been hurt to obtain worker’s compensation. They screw up the entire system.       I worked at Petronella Roofing from May 2001 to June of 2003 when they wanted me to take a 25K cut in pay. Not all of the illegal activity has been charged. In the time I was there all overtime was paid under the table and recorded on back of time sheet. I know of one customer that was charged for 70 sheets of plywood replacement, but I sent only 35 sheets to the job and 6 sheets came back. I know he gamble big bets on football with a local illegal bookie. But what really irked me when once he could not make payroll, but showed up at Cathedral City office with a brand new Cadillac escalade.

        You don’t “know” anything special about this case. There’s no magic wand to wave and say what Michael VIncent Petronella did was right. What he did was defraud his employees, the government and his customers while taking the profits from that fraud and turning them into excess. There is nothing “Christian” about what he did. There is nothing “Christian” about his actions. A Christian is not merely what you call yourself, but it depends on how you live and act. Therefore, I find nothing “Christian” about what he is.

        This is not a saint, awaiting lions. This is not a man being crucified upside down, so that he can stand beneath his lord. These are not monsters who come here and decry with imagined violence what Petronella deserves, these are Americans and other freedom loving folk saying to their free speech limit what the believe and know.

        As to the actions of a 12-year-old on the internet? I am not her mother and I am not her father. Were I her mother and father, I’d have told her where and what to say. Talking about your father’s case in public is not the right or justified way to handle the discovery of information or the quality of character. You cannot defend him in the public eye at this time. What he did is fairly damning and fairly hard to fake. When he’s done his sentence, he can talk with his children about the details, but I hope she actually grows and becomes a better person over time.

        I think it’s pretty clear that those who said nasty things to Bri regretted it when they learned she was a child, and would never have done so in the first place if they had known. After she revealed her age, there was a demonstrable shift in the tone of people’s responses to her: not coddling her or sheltering her from reality, but expressing concern and understanding.

        If you want to blame someone for causing poor Bri unnecessary pain, try her parents. I can’t imagine any amount of online snarkiness could ever hurt as much as the prospect of toughing out your teenage years as the daughter of a couple of convicts. And it’s perfectly natural that Bri is grieving and in denial now. She’s lost her parents; she’s lost her home; she’s lost the style of living to which she had become accustomed. In a few years, though, she’s going to understand what her parents did, and she’ll have to face the reality that her parents cared more about living the high life than watching their little girl blossom into a young woman. If they’d really cared about her, they would have wanted to set a good example of basically honest, decent behavior, as well as conducting their own lives in such a way that they weren’t likely to be hauled off to prison.       I worked for this guy in the 80s he was doing this a yerry long time before he was busted he used to pay his employes with cash or cocaine then aprx.1986 i can not believe he got away with that for that long
